AN ORDINANCE OF THE CITY OF CLEARWA'T'CR, FLORIDA,
AMENDING SECTION 110.04, TRADING ON STREETS--
WHEN PROHIBITED, OF CHAP'T'ER 110, IN GENERAL, OF
TITLE IX, STREETS, SIDEWALKS AND OTHER PUBLIC
PLACES, OF CODE OF ORDINANCES, CI'T'Y OF CLEARWATER,
TO PROVIDE FOR THE OPERA'T'ION OF SIDEWALK CAFES
' AND THE CRITERIA FOR INSTALLA'T'ION OF SUCH USE;
PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWI'T'H TO THE EXTENT
OF SUCH CONFLICT; PROVIDING I'OR THE SEPARABILITY ;
OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER
NO'T'ICE OF PROPOSED ENACTMENT; AND PROVIDING FOR
THE 1' P EC'T'IVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 110.04, Trading on streets--when
prohibited, of Chapter 110, In General, of-Title IX, Streets, c
c
Sidewalks and Other Public Places, of the Cade of Ordinances, City
of Clearwater, be and the same is hereby amended to read as ;
follows:
Sec. 110.04. Trading on streets--When prohibited.
It shall be unlawful for any person to sell., barter,
exchange, or offer to sell, barter or exchange any
goods, wares or merchandise of any kind or nature
whatsoever in, or on or over any street, right-of-way
or public property, sidewalk or park within the city;
pEevided7-heweveF except that this section shall not
apply to curb service furnished by any regularly
estblished and licensed place of business in the city,
and-further provided that this section shall not apply
to the holding of bazaars : or other sales not made or
carried on for personal profit, where the same are
operated in front of or adjacent to a store or place
of business with the consent of the owner or manager
thereof:; and further provided that the prohibition set
out herein shall Pot 2revent the operation of an
outdoor cafe on the public sidewalk where the following
requirements have been met: ;
(1) At least five (5) feet of unobstructed #
sidewalk available for edestrian use must be available following installation of the
sidewalk cafe. '

(2) A revocable permit to.install. the sidewalk '
cafe must be obtained from the City b the
licensed restaurant owner and recorded in
the Public Records of Pinellas Count Such use may only be considered for installation
adjacent to a restaurant use.

L3) All elements or components utili;.ed to
construct the sidewalk cafe must be movable
and no element or component may be bolted
or otherwise affixed to the public sidewalk.
Prior to the Installation of an element or
cam oszerit a building permit shall: be obtained.
(4) The applicant obtains an occupational license
to apply to the activity.
(5) The applicant provides the City with a copy of
a policy of insurance wnich olic shall name
the City as a named insured covering both
pro ert damages and ersonal injuries that might
occur b reason of such use of the public
sidewalk. Sucholicy shall have- limits of at
least $50,000 for property damages and $500,000
for Personal injury liability, and must be approved
by the City prior to the issuance of a revocable
permit.
Section 2. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance
be declared by a court of competent jurisdiction to be invalid,
the same shall not affect the validity of the ordinance as a whole,
or any part thereof other than the part declared'to be invalid.
Section 4. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 5. The provisions of this ordinance shall take effect
immediately upon its passage.
