AN ORDINANCE OF THE CI'T'Y OF CLEARWATER, FLORIDA,
VACATING A POR'T'ION OF AN U'T'ILI'T'Y EASEMENT IN
BECKETT LAKE ESTA'T'ES, PINELLAS COUNTY # FLORIDA;
PROVIDING FOR PROPER NO'T'ICE OF PROI?pSlab ENACTMENT;
T'MENT;
AND PROVIDING FOR THE EFFECTIVS D;tTE OF `T'EAS
ORDINANCE.
WHEREAS, it has been requested by William SVnlmsley and Grace
Walmsley, his wife, owners of certain real property in Beckett
Lake Estates, in the City of Clearwater, Florida, that the City of
Clearwater, Florida, vacate a certain portion of an utility
easement; and '
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said portion of an utility easement
is not necessary nor required for municipal use and it is deemed
to be to the best interest and advantage of the City and the general
public that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
The North 3 feet of the South 10 feet of the utility
easement on Lot 3, Block 2? Beckett Lake Estates, according
to the map or plat thereof as recorded.in Plat Book 65, pages
94 and 95 of the Public Records of Pinellas County, Florida,
be and the same is hereby vacated, closed and released, and the city
of Clearwater hereby quit claims and releases all of its right,
title and interest thereto to the persons, firms or corporations
entitled thereto by law.
Section 2. That the City Clerk is hereby directed to record
this ordinance in the Public Records of-Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 4. This ordinance shall become effective immediately
upon its passage.
