AN ORDINANCE AMENDING THE ZONING ATLAS OF
THE CITY OF CLEARWATER,VLORIDA, 1984, AS
,AMENDED, 13Y ZONING CERTAIN PROPERTY RECENTLY
ANNEXED INTO THE CITY OF CLEARWATER, AS
DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH TO THE EXTENT OF SUCH
CONFLICT; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMENT; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS, on November 15, 1484, the City Commission of the
City of Clearwater, after proper public notice, held a public
hearing for the determination and establishment of zoning classi-
fications for certain property annexed into the City of Clearwater
in accordance with procedure as established; and
WHEREAS, certain of the amendments to the zoning atlas for
establishing zoning for such newly annexed real property were
approved by the City Commission after its evaluation of all
evidence presented at the said public nearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments
thereto related to an adopted comprehensive plan or element thereof,
be reviewed by the Local Planning Agency (LPA) for conformance with
plans adopted pursuant to LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the
PCPC has adopter] guidelines with reference to such required referral,
process; and
WHEREAS, this ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater,
Florida, is hereby classified and zoned as hereinafter indicated,
and."The Zoning Atlas of the City, of Clearwater, Florida of 1984",
as amended, is amended to indicate that fact as hereinafter set

Zoned RM-8 - Single Family Duplex-ARn rtment Residential District
A parcel of land located in the SE 1/4 of Section 9,
't'ownship 29 South, Mange 15 Fast, Pinellas County,
Florida, being more particularly described as follows:
Begin at the NW corner of the SE 1/4 of the SE 1/4
of said Section 9; thence S 89°27'02" E, along the
southerly boundary of Del Oro Groves Subdivision,
'k as recorded in Plat,Book 12, page 2, Public Records
of Pinellas County, Florida, 602.81 feet to the arc
of a non-tangent curve of the northwesterly right-
of-way of Bayshore Boulevard - County Road No. .30
(a 100 foot right-of-way); thence along said right-
of-way, along the arc of a curve to the right, concave
northwesterly, radius 39£.27 feet, delta angle 39°
1613711, arc 271.65 feet, chord bearing S 56 2926" W,
266.36 feet to a point of tangency; thence S 76°07'44" W,
247.28 feet to a point of curve; thence along the arc
of a curve to the left, concave southeasterly, radius
1004.91 feet, delta angle 08°29'01", arc 148.79 feet,
chord bearing S 71°53'14" W, 148.66 feet to the westerly
boundary of 5E 1/4 of SE 1/4 0` said Section 9; thence
N 00°08'53" E, along said boundary 258.33 feet to the
P.D.B..
Section 2. The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in con-
formance with the City's Comprehensive Plan and-individual elements,
thereof adopted pursuant to the LGCPA and directs that same be
forwarded to the LPA for their receipt and appropriate action.
Section 3. All ordinances or parts of'ordinances in•conflict
herewith are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this oidinance,be'
declared by a,court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole, or
any part thereof other than the part declared to be invalid.
Section 5. Notice of the proposed en7ctment of this ordinance'

has been properly advertised in a newspaper of general circulation

Section 6. The Planning.Director is directed to include and
set out and show upon the official zoning atlas of the City of
Clearwater the foregoing amendment as hereinabove set out.
