'?'u?.a'.i"?Sl'. ?.r.r 0 ORDINANCE NO. 3842--84 tIIII ?:1 ' ? ; . 0 AN ORDINANCE AMENDING THE ZONING A'T'LAS OF THE CITY OF CLEARWATER, FLORIDA, 1984, AS AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY ANNEXED INTO THE CITY OF CLEARWATER, AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH-TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS H.EREOF;PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, on November 15, 1984, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the determination and establishment of zoning classifications for certain property annexed into the City of Clearwater in accordance with procedure as established; and WHEREAS, certain of the amendments to the zoning atlas for establishing zoning for such newly annexed real property were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; and WHEREAS, the Local Government Comprenensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC)fhas been designated the Local Planning.Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS, this Ordinance has been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1'. The Tollowing described property in Clearwater, Florida, is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas of the City of Clearwater, Florida of 1984", as amended,'is amended to indicate that fact as hereinafter set out: FOR AFFIDAVIT SEE: ORD, w? -1- Ord. 3842-84 1/24/85 It Zoned RS-75 -Sinale Family Residence District That portion of the NW 1/4 of the NE 1/4 of Section 2, Township 29 South, Flange 15 East, Pinellas County, Florida, more particularly described as follows: Beginning at the SW corner of the NW 1/4 of the NE 1/4 of Section 2, 't'ownship 29 South, Flange 15 East, Pinellas County, Florida; thence N 00°03'09" W, along the West boundary line of the NE 1/4 of said Section 2, 500.04 feet to a point on the southerly boundary line of Windsor Woods,'Plat Hook 78, page 9 extended; thence along said line by the following six calls: (1) S 89°23'04" E, 609.13 feet; (2) S 00°03'09" E,.43.50 feet, (3) S 44° 44149" E, 137.32 feet; (4) S 89°23'04" E, 168.°27 feet; (5) S 00°00'02" E, 285.04 feet; (6) S 89°23'04" E, 96.81 feet to a point, on the Westerly right-of-way line of Nugget Drive (a 60 foot right-of-way); thence along said line by a curve to the left, radius 280.00 feet, arc 66.31 feet, chord S 09°31'37" W, 76.07 feet to a point on the South boundary of the NW 1/4 of the NE 1/4 of Section 2, Township 29 South, Range 15 East, said line also being the North boundary line of Sunset Lake Estates, Plat Book 54, page 21; thence N 89°22' 31" W, 957.88 feet to the P.O.F. Section 2. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances in conflict t herewith are to the extent of such conflict hereby repealed. Section 4. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be..,inva'1_c, •.?t:e same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 6.
