AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING ARTICLE IV, PARKING-METERS, OF CHAPTER
121, STOPPING, STANDING AND PARKING, OF TITLE
X, TRAFFIC AND MOTOR VEHICLES, OF THE CODE OF
ORDINANCES, CITY OF CLEARWATER, TO AUTHORIZE
THE CITY MANAGER TO INSTALL PARKING 14ETERS AND
DETERMINE THE PARKING SPACES WITHIN THE PARKING
METER ZONES; TO AUTHORIZE THE CITY MANAGER TO
REGULATE AND CONTROL THE OPERATION AND USE OF
PARKING METERS; AND TO CLARIFY THE USE OF
PARKING FEES; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR THE
REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH.TO THE EXTENT OF SUCH CONFLICT;
PROVIDING FOR THE PRIPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE
OF THIS ORDINANCE.
WHEREAS, it is necessary to revise Article
of Chapter 121, Stopping, Standing and Parking
and Motor Vehicles, of the Code of ordinances,
the article to current practice;
NOW, THEREFORE, BE IT ORDAINED BY THE

Section 1. That Section 121.31, Establishment of zones; design-

Stopping, Standing and Parking, of Title X, Traffic and Motor
Vehicles, of the Code of Ordinances,, City of Clearater, be and
the same is hereby amended to read as follows:

Sec. 121. 31. Establishment of zones; designation of
spaces.
In accordance with the rovisions of this article
the City Manager is authorized to establish areas
both on-street and off-street where fees must be aid
for parking and to designatethe manner in which the

the same is hereby amended to read as follows:
Sec. 121.34. How meter and space to be used; manner
of parking.
(a) When any vehicle shall be parked in any space along-
side of or next to which there is located, under this
article, a parking meter, the owner, operator, manager
or driver of such vehicle shall upon entering the parking
space immediately deposit the proper coin or coins of
the United States in the parking meter alongside of or
next to the parking space and the parking space may then
be used by such vehicle during the parking limit provided

elty for the part-of-the-street area in which such parking
space is located.
(b) Any vehicle parked in any parking space in any parking
meter zone or parkin s ace shall be positioned in the

Section 4. That Section 121.35, Overtime parking, of Article
IV, Parking System, of Chapter 121, Stopping, Standing and Parking,
of Title X, Traffic and Motor Vehicles, of the Code of Ordinances,
City of Clearwater, be and the same is hereby amended to react as
follows:
Sec. 121.35. Overtime parking.
(a) If any vehicle shall remain parked in any parking
space beyond the parking limit designated -fixed-by

display a sign showing illegal parking, and in that
event, such vehicle shall be considered as parked over-

(b) It shall be unlawful for any person to permit•a
vehicle to remain or be placed in any parking space
alongside of or next to'which any parking meter is

the period of time allotted for the type of coin

Section 5. That Section 121.36, Depositing coins to extend
parking beyond legal time, of Artic1c: IV, Parking System, of
Chapter 121, Stopping, Standing and Parking, of Title X, Traffic-
and Motor Vehicles, of-the Code of Ordinances, City of Clearwater,
be and the same is hereby amended to read as follows:
Sec. 121.36. Depositing coins to extend parking
beyond legal time.
It shall be unlawful for any person to deposit or cause
to be'deposited..in a parking meter a coin for the purpose
of extending the parking time beyond the time fixed by

for parking in the parking space alongside.of or,next to
which such parking meter is placed.

Parking, of Title X, 't'raffic and Motor Vehicles, of the Code of
Ordinances, City of Clearwater, be and the same is hereby amended
to read as follows:
Sec. 121.38. Use of parking fees.
The coins de osited as provided in this article
shall utilized in the manner provided bj the parking
system bond ordinance, and until such bonds have been
satisfied or otherwise redeemed.

declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole, or
any part thereof other than the part declared to be iPValid.
Section 8. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict, he repealed."
Section 9. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166«041, Florida Statutes.
Section 10. The provisions of this ordinance shall take effect
immediately upon its passage.
