3816-84 D IV ORDINANCE NO. 3816-84 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ORDINANCE NO. 2019, RELA'T'ING TO THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN, TO CHANGE' THE LAND USE DESIGNATION FOR CERTAIN REAL PROPER'T'Y WITHIN THE CI'T'Y OF CLEARWATER; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PRO- VIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to the LGCPA; and WHEREAS, the Pinellas County Planning Council. (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS, this Ordinance has been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Pursuant to the provisions of the Local Government Comprehensive Planning Act, 1975, as amended, and pursuant to all applicable provisions of law, Section 1 of Ordinance No.? 2019%is amended by placing the hereinafter described property in the land use category as follows: Property Land Use Category._ (L.U.P. 84-49) Lots 16 and 17, From: Residential/Office Block 14, Section "A", Chautauqua Unit 1, according To: Commercial/Tourist to the map or plat thereof as Facilities recorded in Plat Book 9, page, 52 of the Public Records of Pinellas County, Florida, together with the right-of-way of Third Avenue South, lying between the East right-of-way line of Main Street and the northerly extension of the West lot line of said Lot 17. Sectin 2. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in con- : formance with the City's Comprehensive Plan and individual elements- thereof adopted pursuant to the LGCPA and directs that same by for- warded to the LPA for their receipt and appropriate action.
