3803-84I ` ORDINANCE NO. 3803-84 i AN ORDINANCE AMENDING THE ZONING ATLAS of THE CI'T'Y OF CLEARWAT'ER, FLORIDA, 1984, AS AMENDED, BY ZONING CHR'T'AIN PROPERTY RECENTLY ANNEXED INTO THE CITY OF CLEARWATER, AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLIC'T' HEREWITH TO THE EX'T'EN'T' OF SUCH CONFLIC'T'; PROVIDING FOR THE SEPARABILITY OF THE PlIOV181ONS HEREOF; PROVIDING FOR PRO-1,B11 NO'T'ICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DA'L'E OF THIS ORDINANCE. I WHEREAS, on October 4, 1994, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the determination and establishment of zoning classifications for certain property annexed into the City of Clearwater in nccordance with procedure as established; and WHEREAS, certain of the amendments to the zoning atlas for establishing zoning for such newly annexed real property were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; and WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with. plans adopted pursuant to LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS, this ordinance has been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following described property in Clearwater, Florida, is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas of the-City of Clearwater, Florida of 198411, as amended,'is amended to indicate that €act as hereinafter set outs SEE ORDINANCE Ord, 8903.84 12/20/84 .t ' Zoned RS-50 - Single Family Residence District Jr; "Commence at the NW corner of the NW 1/4 of the NE 1/4 of Section 2, Township 29 South, Range 15 East for a P.O.B.; thence S 00°07'06" E, along the Uorth-South centerline of said Section 2, 363.00 feet; thence S 89°15.'23" E, 133.23 'reet; .thence N 01°34'59" R, 363.00 feet to the North boundary of said Section 2; thence N 89°15'23" W, along the said North boundary of Section 2, 144.00 foot to the P.O.B.; together with right-of-way of Union Street (County Road No. 194) over the Northerly 33.0 feet thereof. Section 2. The City of Clearwater does hereby certify that the measures contained in this ordinance are 'c'onsistent and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the. same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 6. The Planning Director is directed to include and set out and show upon the official zoning atlas of the City of Clearwater the foregoing amendment as hereinabove set out. Section 7. Section 1 of this Ordinance shall not become effective until the requisite authorization has been received from the Pinellas County Board of County Commissioners pursuant to its powers under Chapter 171.062 (2), Florida Statutes, and filed with the City Clerk.
