THIS AGREEMENT, made and entered into this Y7 day of ~ ~ ,1980,
by and between the DISTRICT BOARD OF TRUSTEES OF ST. PETERSBURG JUNIOR COLLEGE, FLORIDA,
P.O. Box 13489, St. Petersburg, Florida, 33733, hereinafter referred to as the College,
and the CITY OF CLEARWATER, P.O. Box 4748, Clearwater, Florida, 33518, hereinafter
referred to as City,
WIT N E SSE T H:
WHEREAS, the City is desirous of improving and developing College-owned land into
soccer fields for use by the City of Clearwater; and
WHEREAS, the College physical education classes will benefit from the improvements
to be made to the fields by the City; and
WHEREAS, the College and City are each willing to cooperate in this matter under
certain conditions and provisions;
NOW, THEREFORE, the parties agree as follows:
1. The College-owned property, to be improved and developed into six soccer fields by
the City, is as described on Exhibit A, attached to the Agreement. Further, the area desig-
nated as a College parking lot which may be used for participants is as described on Exhibit A.
2. The City agrees for the purpose of improving the property described on
Exhibit A, which property is to be used for the purpose of providing soccer fields, to
provide fill dirt, grading, grass seeding, and, if determined feasible, irrigation. All
improvements shall remain property of the College.
3. The City will be responsible for the payment of all utility bills resulting
from the City's development and scheduling of the fields, and said util ities will be
metered to the City.
4. The College, to the extent possible, will allow the City to use the existing
deep well located north of the existing gymnasium, approximately 850 ft. west of Old
Coachman Road and 75 ft. south of Sharkey Road, for irrigation purposes, with the
understanding that irrigation will be coordinated with the College's Department of
Physical Plant so that the capacity of the pump is correctly utilized.
5. The City will provide all maintpnance required to keep the designated area
clean and in condition for playing soccer, with the exception of normal mowing, which
will be the responsibility of the College. Normal mowing is defined as a regular
schedule of mowing the grass as needed, using equipment presently aV<lilable at the Col lege.
6. The Col legc wi I I have priority usc of the fields with all other programs
scheduled by the City so as to avoid conflicts between various user groups and Col lege
programs, viz., physical education, athletics, intranlural~, and social club activities.
The City, prior to use, shall, unless emergency situations -~i5e, submit for College
approval a schedule of all games and practices planned for he premises including
month, day, time, and fields. Since the City.s usage will "wolve primarily evenings and
weekends, the College wi II make every reasonable attempt to schedule colleqe activites

~ 10. The City will, prior to using College property, obtain and keep in force
during the terrn of this Agreement a liability and property damage insurance policy
covering said property in the minimum limits of $50,000 bodily injury for each person
and $100,000 for each occurrence; and $25,000 property damage for each occurrence,
which said policy shall name the College as an additional insured.
