AGREEMENT RE USE OF THE FINE ARTS AUDITORIUM ,I I A G RUE E MEN T THIS AGREEMENT, made and entered into this 20th day of Mav , A. D. 1976, by and between the CITY OF CLEARWATER, FLORIDA, a municipal corporation, hereina!!er referred to as lICity", and the DISTRICT BOARD OF TRUSTEES OF ST. PETERSBURG JUNIOR COLLEGE, P. O. Box 13489, St. Petersburg, Florida 33733, hereinafter referred to as 11Junior College"; WITNESSETH: WHEREAS, the City is desirous of using the Fine Arts Auditoriwn of the Clearwater Campus, which is owned by the Junior College, for recreational programs both independently and in cooperation with like groups of the Junior College; and WHEREAS, the Junior College is willing to cooperate in this matter under certain conditions and provisions; NOW, THEREFORE, in consideration of the covenants herein contained and other good and valuable consideration, the Junior College hereby agrees to permit the City to use the following described premises, located in the City of Clearwater, Pinellas County, Florida, to wit: The Fine Arts Auditoriwn at The Clearwater Campus 2465 Drew Street, Clearwater, Fl. under the following conditions and provisions: 1. The terms of this Agreement shall commence May 20 1976, and shall continue until a sixty (60) day notice of termination in writing is given to either party by the other. 2. The premises shall be used by the City in its recreational programs and shall not conflict with any Junior College Programs and shall conform with the hours the facility is normally open. If the City does desire usage of the facility at a time other than normally open, the City will be required to pay a fee of $5.00 per hour for said usage. Further, the City shall, -1- ..-It .. .. ... .. . I I prior to scheduling or using the facility, obtain the approval and consent of the Assistant Director, Division of Communication, of the Clearwater Campus of the St. Petersburg Junior College to said schedule and use. 3. The City shall provide for its own personnel for the supervision of the programs it conducts. 4. The City will, prior to using the facility obtain and keep in force during the term of this Agreement a liability and property damage insurance policy covering said facility in the minimum limits of $50,000 bodily injury for each person, and $100,000 for each occurence, and $25,000 property damage for each occurence, which said policy shall name the Junior College as an additional insured. A certificate of such insurance shall be furnished to the St. Petersburg Junior College Attorney's office prior to the use of said facility by the City. 5. All notices hereunder shall be sent to the City of Clearwater City Manager, P. O. Box 4748, Clearwater, Florida 33518, and to St. Petersburg Junior College, Carl M. Kuttler, Jr., Dean of Administrative Affairs, P. O. Box 13489, St. Petersburg, Florida 33733. IN WITNESS WHEREOF, the parties hereto have executed this Agreement the day and year last above written.
