AGREEMENT - USE OF SWIMMING POOL AT MORNINGSIDE REC CENTER ~ .c ~ ;, !' .~I , AGREEMENT THIS AGREEMENT, made and entered into this 26 day of July , A. D. 1973, by and between the CITY OF CLEAR WATER, FLORIDA, a nnmicipal corporation, hereinafter referred toas "City", and DISTRICT BOARD OF TRUSTEES OF thEIST. PETERSBURG JUNIOR COLLEGE, PO Box 13489, St. Petersburg, Florida 33733,. hereinafter referred to as "Junior College"; WITNESSETH: WHEREAS, the Clearwater Campus of the St. Petersburg Junior College is desirous of using the swimming pool in the Morningside Recreation Complex, which is owned by the City, for its physical education classes; and WHEREAS, the City is willing to cooperate in this matter under certain conditions and. provisions; NOW, THEREFORE, in consideration of the covenants herein contained and other good and valuable consideration, the City hereby agrees to permit .' the Junior College to use the following described premises, Ice ated in the City of Clearwater,. Pinellas County, Florida, to wit: The swimming pool in the Morningside Recreation Comple~ 2400 Harn Boulevard, Clearwater, Fiorid.a, . under the following conditions and provision~: . . ~ , 1.. The~term of this Agreement shall commence August , 1973, and shall continue until a thirty (30) day notice of termination in writing is given to either party by the other. 2. The: premises shall be used by the Junior College in its physical education program and shall not conflict with any City programs and shall conform with the hours the facility is normally open to the public. The- Junior College covenants that it will, prior to using said facilities, obtain. and keep in force during the term of this Agreement a liability and property damage insurance policy covering said facilities in the minimum limits of $100,,000/$300,000 and $10,000, which said policy shall name the City of Clearwater' as an. additional insured. P/. copy of said insurance policy shall 'be furnished to the City Clerk of the City of Clearwater prior to the use of said facilities by the Junior College. 5.. All notices hereunder shall be sent to the City of Clearwater City Manager, PO Box 4748, Clearwater, Florida 33518, and to St. Petersburg Junior College" Carl M.
