a. Set Hearing Date Regarding Status of Thomas Stubblefield's Disability Pension:
Human Resources Director Joe Roseto said Thomas Stubblefield, a disabled firefighter,
had reported his employment as a police officer in another jurisdiction. The Pension Plan
mandates forfeiture of a disability pension if a person works in a similar profession. The
Pension Plan's attorney opined that firefighter and police officer are similar professions.
The City is beginning the process and will contact Mr. Stubblefield, obtain records, and
seek another evaluation to determine if the conditions of his disability still exist. A PAC meeting
will be scheduled to determine if Mr. Stubblefield remains disabled and if the disability meets the
parameters of the ordinance.
Member Schmalzbauer moved to schedule a hearing regarding the status of Thomas
Stubblefield's Disability Pension on January 8, 2009. The motion was duly seconded and
carried unanimously.
