In diacueeing thie matter with Mr. Ayres he mentioned that he told Mr. Frank Felix of U. S. Steel that the City would be prepared to act on the application for a building permit on South Beach IV before this week i. over. Mr. Felix notified Mr. Ayres that U. S. Steel intende to amend its application for South Beach IV. Mr. Ayre8 r.eponded that the City would be pleased to allow an amendment, and conaequentiy no permit will be ieaued on the application pending U. S. Steel' a amendment. Any future applications will be reviewed for their compliance with health and aafety codea purauant to the normal City procedure.. Mr. Felix concurred that thia was ae U. S. Steel intended. Steel Realty Development 200 St. Andrews Drive Be11eair, Florida 33516 Dear Don: This letter is in response to your request to construct carports on the property located at 1500 Gulf Boulevard, referred to as South Beach III. In accord with our conversation, this i. to advise that I have no objection to the i.suance of a permit for the row of carports located immediately north of and closest to the building, with the exception of the four we.terlu-most spaces and wall. With this exception, this row of carports is, for the most part, within the envelope within which structural location would be permitted based on water- front setback provisions. It should also be noted that the emergency generator, ifovver thirty (30) inches in height, would appear to need to be relocated or a variance sought. The portion of the four eaaternmost carports which project beyond the setback dimension i. inconsequential and, in my view, doe. not require that a variance be obtained in order to locate this installation. The second row of carports proposed to be situated north of the first tier above described rests entirely within the required waterfront setback area and cannot be permitted without authorization of a variance by the Board of Adjustment and Appeal on Zoning. If it is your desire to locate such additional carports, 1 recommend you make application for such variance. In fsirness to you, I should also point out that my position would be to oppose such variance as a major departure from the waterfront setback requirements that would appear to be without suffici.nt jU8tification to warrant variance. For your further information, in reviewing the file 8S to the i.suance of a permit for the South Beach III building at 1500 Gulf Boulevard, I find nothing that would exempt this site from the waterfront .etback section of the Zoning Ordinance. Since the waterfront provision has been in effect since Jun., 1974, I a. un.ble to determine why the site plan, which i8 the basls on which you are proceeding, wa. approved if, indeed, it was, in contradiction to the waterfront setback requirements. It is our interpretation that the fixtures in the parking area meet the code requirements. 16. The only reference I can find in the above documents which corresponded in time to any action by the City is Mr. Paroby's letter of June 13, 1975, in which he said, among other things, about the meeting of June 11, 1975: liThe Building Permit Review Committee decided, subject to the City Attorney's review and concurrence, that a building permit be issued. . . . Your building plans are now being reviewed by appropriate City Departments." All other and subsequent correspondence, I am sure you agree, are only recollections and explanations of past actions; they in no way attempt to make any official determinations. ' On the other hand, while you may disagree, we cannot believe that the letter of June 13, 1975, quoted above, constitutes advice that a building permit has been issued or that the letter itself constitutes the issuance of a building permit. That letter, as indicated, states that there are two conditions precedent to the issuance of a building permit, namely, the City Attorney's review and concur- rence and review by appropriate City Departments. My client has not been advised that either of the conditions had occurred. At one meeting, attended by Messrs. Felix, Blanton, and Bustin, among others, I understand that Mr. Bustin indicated that he did not know whether or not his office had ever reviewed the matter and Mr. Blanton indicated that his department had not approved the building plans. Our client requests that the building permit captioned above immediately be issued. Please advise the undersigned when it can be picked up. In the absence of such issuance, we request the opportunity to meet with you at an early date and discuss this matter further in an attempt to avoid litigation. The date of this meeting was May 14, 1976 at which we specifically asked if the City Attorney or the Building Department had ever reviewed our request for application as was indicated and required in Mr.. Paroby's letter of June 13, 1975. Upon receiving an answer in the negative, we then requested that the City inform us once this administrative process had been fulfilled by the City. Building Permit Reque:: DATE: June 13, 1975 '" On June 11. 1975 the Building Permit Review Committee considered a request from the U. S. Steel (U. S. S.) Realty for building permits for a high-ris e build- ing on Sand Key consisting of 144 units. This request was received by the Building Department about thirteen months ago. The Committee had deferred . the request since then b,ecause of the uncertainty regarding the status of the City's proposed expansion of the Marshall Street Sewer Treatment Plant. This project is now under way. The Committee was uncertain as to whether it should treat. the requ,est under grandfathering rules. or to consider the project under current restrictions pertaining to the 80-foot building height limitation and the current 28-unit density restriction. The proposed building exceeds both of these criteria which were not in effect when the plans were submitted. The Committee decided that, subject to your concurrence. certificates of occupancy would be issued for 25% of the units, and that additional certificates of occupancy could be requested when those 25% of the units were 75% occupied. The Committee could not issue 144 Certificates of Occupancy as there are not that many units available at the treatment plant. The action taken by the Committee is consistent with City Commission policy. and similar action has been taken in the past by the Committee for similar structures. As you know, your building plans were submitted to the City Building ~epartment over a year ago, "The City took no action on the matter because of the uncertainty r I dating to the status of federal funding for the City1s planned expansion of the Marshall Street Sanitary Treatment ~lant. This facUity serves 5and Key and the plant does not presently . have the capacity to serve your proposed building. Federal'funding has been received and the expansion is now under way. The Building Permit Review Committee decided, subj ect to the City Attorney's review and concurrence, that a building perm.it be is sued but that Certificates of Occupancy would be issued only for 25% of the units. Further, when these units are 75% occupied, then Certificates of Occupancyfor the remaining units could be requested. The granting of the remaining Certificates of Occupancy would, of course, be contin- gent upon the capacity to serve being available at the Marshall Street Plant. Your building plans are now being reviewed by appropriate City V Departments.
