Dear Mr. Geiger:
In accordance with Section 133.09 of the Code of Ordinances of the City of
Clearwater, I have reviewed your request for a temporary sidewalk installa-
tion waiver.
The subject location is approximately one mile North of Countryside High School
on the same side of McMullen-Booth Road as is the school. Since no school bus
service will be available for students in the area of 3280 McMullen-Booth Road,
the subject sidewalk and others to be installed will become a part of a school
walk route. However, the site does have construction problems because of the
County maintained ditch.
Accordingly, you will need to construct a five-foot sidewalk on either side of
your entrance drive. This sidewalk will go to your property line on the North
U6 feet) and to the existing ditch on the South (18-2Q feet MOL). For the
remaining portion, a temporary waiver of the sidewalk installation requirement
is granted. Should it be determined that a sidewalk is required at this location
in the future, it will be installed by the assessment process.

Section 133.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said sidewalks.

I have reviewed the above location on the site and found the following conditions:
1. The property frontage is 99' along McMullen-Booth Road.
2. The driveway is 24' wide and is located 16' from the north
property 1 i nee
3. A wide ditch is about 15' from the south edge of the driveway.
4. There is a width of approximately 18'-20' from the ditch to the
south property line.
This location is approximately one mile north of Countryside High School on the
same side of McMullen Booth Road. Since the walking distance (no school bus
service) is two miles, it must be concluded that the sidewalk would be part of a
school walk route if the sidewalk existed. Much of the property where the side-
walk is missing is owned by the City.
Although there are no sidewalks within 200', there is a subdivision less than
200' to the north which will provide sidewalks when the houses are built.
The portion where the ditch exists should be waived under the provision of the
ordinance allowing a waiver due to physical conditions which can not easily be
overcome. The portion south of the ditch will be inaccessible. The portions
between the ditch and north property line (less the driveway) can be built and
are required by the ordinance. It should be remembered that with the driveway
~~ constitute a walkway 60' long.
