you meet the requirements as set forth in the aforementioned Code section.

installation requirement is ranted on the above-referenced property. Should
it lie determined that a sidewa 1S required at this location in the future,
it will be installed'oy the assessment process.

REASON FOR REQUEST (1) The existing cross (north/south) slope between the south R/W & the
south edge of curb of Ottawa Road is too steep & therefore unsafe for use by a pedestrian
(slope = 11 in 41T or + 25%); (2) A proposed walk could create maintenance problems; (3) A
-
proposed walk could create liability problems; (4) Elimination of the walk removes any
encouraged use by motorized cycles or bikes; (5) The City Board of Adjustment previously
approved a variance with the condition that no ingress/egress would be allowed to and from
Ottawa Road for this site.
Section 133.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructeq by the OWner on, across or adjacent thereto.
The OWner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of

I have reviewed the request for Sidewalk Waiver on Ottawa Road for property being
developed on lakeview Road. Ottawa abuts the rear of the property. Upon investigation
in the field I found that Ottawa is totally developed with no sidewalks on either side
of the street. In view of this, the location meets the requirements for the waiver and
I recommend that one be granted.
