Mr. Hooper stated' he reviewed all the legal opinions in his possession and could find no t,h in g
that referred to an employee being eligible to apply for: a job~connected disability pension
once the employee has terminated. Pamela Akin. City Attorney, advised the Committee that
under the terms of the Pension Plan, specifically Section 2.407 and 2.396, an employee who
terminates has vested rights and could apply for a non-job-connected disability pension or a
regular pension but has no right to apply for a job-connected disability pension. Ms. Aki n
stated the only exception to' this would be if the employee were terminated for a disability, at
which time this would have to be reviewed further.
In light, of the opinion from Ms. Akin, Mr. Hooper moved to deny Mr. Stafford's request for a
job-connected disability pension since Mr. Stafford was terminated at the time he made
application. Mr. Stafford can proceed with legal action or request a return of his pension
contributions. The motion was duly seconded by Fred Ratley and carried unanimously.

Mr. Stafford left the meeting. Ms. Akin witl put her opinion in writing. Further discussion
ensued as to whether or not Mr. Stafford could apply for a non-jab-connected disability
pension. Ms. Akin staled he could under the terms of the Plan provided he was disabled at the
time he terminated. This would have to be determined by the Committee. Mr. Hooper requested
that Mr. Stafford be advised in writing of his four options: 1) pursuit of a non-job-connected
disability pension; 2) vesting of his pension until age 55; 3) legal action; or 4) withdrawal of his
pension contributions. Should Mr. Stafford be convicted of the alleged charges, he would lose
his right to everything except a return of his contributions.

The Committee considered' the request from Thomas Coleman, Fire District Chief, Fir c
Depa'rtment, ' for a job.:.connectcd disability pension based on a blood condition' that has
resulted from his' employment as a Firefighter. There was a question regarding the diagnoses
in Mr. Coleman's letters but it was determined after some discussion that the letters were i n
order. Mr. Coleman's condition' does not appear to fall under the Firefighters' heart and I u n g
presumption bill.

Mr. Hooper stated there is a possiblity that the Fire Chief will be making a change in the
assignment of one Fire District Chief which involves changing this position to a 40-hour
position with no, firefighting duties. If this were to occur, it may affect Mr. Coleman's pension
request.
After further discussion. it' was determined that Mr. Coleman should be sent for an IME.
Mr. Coleman's Workers' Compensation file was in order.

Richard Dreest moved that Mr. Coleman be sent for' an IME. The motion was duly seconded and
carried un~nimously.
The Committee considered the request from Joseph Stonclake, Marine Facility Operator,
Murine, Department, fora job~connected disability pension. Mr. Stonclake currently works
at the toll plaza but this job will be eliminated when the Sand Key Bridge closes in September.
In, that event, Mr. Stonelakc' would be moved to the fuel dock at the Marina. However,
,Mr. Stonelake is unable to perform the duties of this position due to his physical restrictions.,

would not be reasonable. The Committee was comfortable with the documentation submitted
and will tuke action on this request at the September 6th meeting.

Department,for a job.connected disability pension based on a back injury suffered in the
line of duty. Mr. DeBord's documentation was acceptable and the Commiuee will take action on
