With respect to the request from Kenneth Castelli, Tree Trimmer, Parks & R eel' e n ti 0 n
Department, for a job.connected disability pension, the IME report from Dr. Michael Slomka
was received and reviewed.

I A short discussion ensued concerning the circumstances surrounding Mr. Castelli's accident
which occurred when his bucket truck lipped over. There were somc concerns as to w h e the r
employees have been properly trained on the use of these trucks. Secretary Michtlcl Lilurscn
has addressed these concerns with Risk Management and training will be forthcoming.

Mr. Castelli's Workers' Compensation file is in order and this injury is compensable.
Jim Heinz moved that Kenneth Castelli be granted a job-connected disability pension effective
on a: date to be determined bused on Mr. Castelli's disability that resulted from on-the-job
circumstances which is described as a cervical discectomy, said disability making hi in
permanently unable to perfol'm his job, and documented by medical statements 0 f
Dr. Michael D. Slomka, dated March 10, 1995; Dr. William W. Dodson. dated February 20, 1995, and
January 25, 1995; Dr. Jeffrey S. Walker, dated February 17,1995, and January 31, 1995; and
Dr. Gary G. Moskovitz, dated January 27, ] 995. The motion wa~ duly seconded by Fred Ratley and
carried unanimously. This matter will go before the Pension Trustees on April 17, 1995.
With respect to the request from Michael Szuba, Fire Lieutenant, Fire Department,
. for a job-connected disabiWy pension, Mr. Szuba had an IME performed by Dr. Rutledge. We
have not yet received the report. Mr. Szuba was working light duty at the time he applied for
his pension. However, in light of the letters rccei ved from his doctors which state that h c
should not be performing as a Firefighter, he has been placed on sick leave.
There was some confusion as to how the City's light dUlY policy applied in this case. After n
lengthy . discussion, it was determined that the Committee would recommend to the Trustees that
a policy be established that any t i III e an employee applies for pension, he/she will
automatically be placed on sick leave pending the outcome of the request. Ed I'looper moved to
f"!,1~, recommend this to the Trustees. He stated he would draft language to be presented to the
.\:ri Trustees and bring it to the Committee at the next meeting for a formal vote. He withdrew his
motion.

Discussion ensued concerning the. letters from Dr. Sanchez and Dr. Hazlil1. TheSe letters urc not
explicit as to the permanency of. Mr; Szuba's problem. It was requested that he try to obtain
clarification' 'from his doctors. It may be necessary for the doctors to indicate that the
conditi?n is permanent pending thc development of some new procedure or medication t hat
will correct the problem., Should Mr. Szuba's disability no longer exist, he could be rcquired
under, the ordinance to return to his position.
. Michael Laursen' suggested the Committee address the heart and lung presumption law at the
time it makes a recommendation. Further discussion ensued concerning the Workers'
Compensation benefits payable to Mr. Szuba for this compensable injury.
The Committee will consider this matter at the meeting on April 5th provided all necessary
documentation has been recei ved.
The Committee considered the request from Emanuel' Hutchinson, Solid Waste W 0 r k e r,
SoUd Waste Department, far a job-connected disability pension. There was some concern
with Mr. Hutchinson's letters which do riot contain any of the necessary information.
Jon Marcin, Risk Management Spccialist, advised the Committee that Workers' Compensation
has determined that Mr. Hutchinson is totally and permanently disabled from any lype 0 f
employment.
Discussion ensued as to whether or not Mr. Hutchinson should be 'required to obtain
letters since one City agency has already declared him tOlally and permanently disabled.
. conclusion of the discussion, Mr. Hutchinson was asked to obtain new letters.

The Committee reviewed the Annual Certification of Pension Entitlement Forms. All were
acceptable.
At the Jast meeting the Committee asked that Mr. Mosley's and Mr. Phmips' forms be senl back
for clarification of the disability. Mr. Laursen asked the Committee if this was necessary since
neither pensioner is working and the reason for the disability is a maller of record. Discussion
/,,';ll,. ensued. It was determined that the only area of concern for the Commiuce was the
~j)' relationship between the pensioner's disability and his/her current type of employment.
The current forni will' be reviewed in the near future for modification.
