Assistant City Attorney Leslie Dougall-Sides reported the sign company has
-flied a lawsuit against the City related to these signs in Circuit Court. She said the
lessee claims the City must pay compensation prior to removal of the billboard. If
the board issues a fine, the property can be Iiened. The sign could come into
compliance jf it were smaller. The amortization period is long over. The billboard
violates the Code's height and size restrictions but meets setback requirements.

Ms. Dougall-Sides reviowed City efforts to reduce signage blight. In 1985,
the City Commission approved an ordinance to change .the ~Imensional requirements
of slgn!1~ which Included a 7-year amortization period requiring signs to be in
compliance or be removed by October 1992. A 1988 ordinance addressed
exceptions on Gulf-to-Bay Boulevard and also provided a 7-year amortization limit
, with a compliance deadline of January 19, 1996. The City Commission repealed
the previous land Development Code and approved the Community Development
. Code in 1999. The new Code Includes a section listing transitional rules, which
indicate signs are subject to amortization provisions in the previously adopted land
Development Code. The City Commission has directed staff to pursue compliance
issues regarding sign rogulations and enforce the Ordinance, which the courts have
not struck down. She requested the billboard be found in violation.

Development Services Director Jeff Kronschnabl stated he has supervised
code inspectors for the City's CRT (Community Response Team) since 1993. He
reviewed the City's sign amortization program, noting residents had requested
implementation of an ordinance to address sign blight from billboards and other
signage. Since 1993, staff has inspected more than 13,000 signs. Of 40
billboards, 9 remain. .

In response to questions from Attorney Aileen C. Reilly, representing the
billboard owner; Mr. Kronschnabl said the amortization period was provided for
billboard owners to recoup the costs of the structures. That deadline is long past.

In response to questions from Ms. Dougall-Sides, Inspector Mary Jo Fox said
she was a Code Inspector I, who had received internal and external training and was
certified. She said she had replaced a previous inspector and took over those
duties, including Citywide sign inspections. She had inspected the subject property
on April 13, 2000, after review of the amortization file developed by previous staff,
and observed the billboard, which violates the Community Development Code
related to height, size, and lack of landscaping. She reviewed the procedure used to
measure the billboard and estimated it is 40 feet in height with two faces oJ 300
square feet each. The Code limits signs to 14 feet in height, 64 square..feet of
signage, and includes a 12 square.foot landscaping requirement. Notice of Violation
was issued on May 10, 2000, citing the nuisance section of the Development Code,
mailed certified, by regular mail, and posted on the property and at City Hall.

This property was reinspected on June 14, 2000, and remained in violation
as the billboard had not been removed. An affidavit of violation and request for
hearing was issued on August 1, 2000. Ms. Fox said she had not been in contact
with the owner or lessee following the citation. She identified City Exhibit 7 as
photographs she had taken of the billboard on the subject property on April 13,
2000 and after the posting on May 10, 2000. Ms. Fox stated she had visited the

conditions. She recommended the property be found In violation and to provide the
property owner and lessee 30 days to bring the property into compliance before
imposing a $250 a day on each party until compliance is reached.

Ms. Dougall-Sides submitted City Exhibits 1 - 19.
In response to a question from Ms. Reilly, Ms. Fox deferred questions related
to the interpretation of Code to the Legal Department. Ms. Reilly said the billboards
are protected by State and Federal law and must be compensated upon removal. In
response to a question. Mr. Kronschnabt said Code Inspectors bring information
related to possible violations to the appropriate staff for interpretation. Mr.
Kro'nschnabl reviewed the series of steps taken by staff prior to bringing a case to
the board.
Ms. Reilly said the City had issued a sign permit for the billboard on January
23, 1977. In response to a question, Ms. Fox said the amortization period was
enacted after the ,billboard was constructed. Ms. ReHly read Chapter 44.55, which
was cited In the Notice of Violation. She recommended the board continue this item
until the Court. makes a determination. The board declined. Ms. Reilly presented a
copy of the Community Development Code relating to non-conforming signs.

Herbert C. McAtee, Asset Manager, Diversified Investments, for property
owner, requested the board continue the item until after the court decision. He said
his firm had purchased the property three years ago and has no control over the
billboard; Ms. Reilly stated the subject billboard contract is in its first year of a 10-
year option. She refused to submit the contract into evidence. Concern was
expressed the sign company should make more at, an effort to educate new
landowners regarding terms of the lease.
Susan Rosetti, FOOT (Florida Department of Transportation) Right-at-Way
Administrator, said she is charged with implementing federal highway rules. She
said SR 60 '(Gulf-te-Bay Boulevard) became part of the National Highway ~ystem on
November 28, 1995, prior to the end of the City's sign amortization period. The
billboard. had been I.awfully erected. She said related regulations indicate the
billboard cannot be moved without just compensation. She said FOOT feels the City
is causing the removal of signs on SR 60. She submitted the March 1 5, 2000 letter
to the City Manager from Kenneth M. Towolmak, Director of the Office of Right~of.
Way, which stated the CIty may be liable. She said a letter from USOOT (U.S.
Department of Transportation) indicates FOOT must implement rules related to
federal highways.

, Ms. Rosetti said the billboards are permitted by FOOT. She said she
routinely addresses boards related to rezoning and outdoor advertising issues. Ms.
Dougall-Sides said the only indication of when SR 60 was placed on the National
Highway System is a date printed on the map presented by Ms. Rosetti. In
respons'e to a question, Ms. Rosetti said current FOOT permits have not been
renewed nor revoked. Their status is in litigation. She said the court could require
FOOT to remove the biilboards..

Connie Warehime, Assistant to Leasing Manager, Lamar Whiteco Outdoor
Corporation for billboard.owner, said the billboard had been constructed 'by valid
permit' a~d a tand tease agreement. She said her firm's lawsuit against the City is
requesting just compensation prior to its removal. Ms. Dougall~Sides stated the
Circuit Court will determine that issue.. The City may be prepared to pay.
Ms. DougaH~Sides reviewed the history of the subject billboard. The process
to bring the sign into compliance has lasted 6 years. Technically, the billboard could
be brought into compliance if its height and the size of its face were reduced. She
said' FOOT rulings can not supersede local government ordinances. The Court will
address related legal issues. If the board rules against the sign company, the firm
can file a p.etition for writ of certiorari. It was noted the sign company had been
noticed first in 1994 that the billboard. was out of compliance. It was stated the
reported change of the designation of SR 60 had occurred after that.

Ms. Reilly made legal arguments the billboards do not violate the Code. . She
said Chapter 44 related to signs had been repealed when the new Community
Development Code was adopted and cannot be enforced. In response to a question,
Attorney for the Board Andy Salzman said the board was not being asked to
interpret the faw but to determine it they feel a violation of code exists.
Ms. Reilly said if the board does not rule on whether or not the sign is
nonconforming, the client's rights of due process are being denied. In his April 10,
1996, memorandum from the Federal Highway Administration regarding the National
Highway System, Thomas J. Ptak wrote that removal of lawfully erected billboards

exempt nonconforming signs. She said the bilfboard is protected under the Federal
Beautification Act and came under Federal jurisdiction before the amortization period
had expired. She said the sign is not unsafe and should not be subject to an
excessive fine. She opposed a resident's testimony ~egarding related citizen efforts,
stating that testimony is not relevant.
Discussion ensued regarding court issues. Ms. Dougall-Sides said
nonconforming signs refer to those with violations that are not egregious, such as
the billboard. The subject billboard never was considered legally nonconforming. In
response to a question, Ms. Reilly said the sign company did not act after the
previou~ notice of violation as the City took no action between 1996 and 1999.
She said the firm thought the City had agreed with their position that the billboard
does not have to be removed. Ms. Dougall~Sides noted the owner only acted after
receiving another notice of violation. She opposed Ms. Reilly's request to defer a
decision.
Discussion ensued regarding the Court's considerations, the length of time
since the billboard originally was cited, the amortization period, and the related
wishes of City residents. In response to a question, Mr. Salzman said unless named
in the board's ruling, the property owner will be held harmless for the fine.

Sec. 44.55(3)(b) of the previous land development code required sign compliance or
removal by 1/19/96. The billboard/sign still exists as a nonconforming sign. The
transitional rules of the current land development regulations Sees. 1-106. Band
106.G require that signs/billboards not lawfully existing at the time of this
development code be brought into compliance with this code. The billboard/sign
fails to be lawful under the current code.
CONCLUSIONS OF LAW

inspected in April 1 997 and a Notice of Violation was issued as the fence was not .
screened by plants as required. In August 1996, a previous board, DCAB
(Development Code Adjustment Board), had approved a variance to install a fence in
the front yard with the condition that a continuous visual screen would obstruct the
fence from the neighborhood.

Mr..Kurleman reinspected the property on May 25, 2000, and filed a Notice
of Violation on June 2, 2000. He has reinspected the property several times but
has not been in touch with the property owners despite attempts to contact them c
via telephone and mail. He saw no change 'when visiting the property yesterda'y.
He suggested one option would be to remove the fence, noting the homeowners

had been unable to achieve the required screen during the past four years.. No
irrigation system is nearby but it is possible to hand water the plants. Although he.
had suggested the homeowners irrigate and mulch the plants, he. felt they had done '
