The Chair called the meeting to order at 1: 12 p.m. at City Hall.
To provide continuity for research, items are in agenda .order although not necessarily
discussed in that order.
ITEM '#2 - Aooroval of Minutes:
Trustee Hooper moved to approve the minutes of the August 16, 1999, meeting, as
recorded and submitted in written summation by the City Clerk to each Trustee. The
motion was duly seconded and carried unanimously.
ITEM #3 - Reauest for Acceotance into Membershio:
The City Manager presented the recommendation of the Pension Advisory
Committee to approve membership for the employee{s) listed below: '

Trustee Clark moved to accept the recommendation of the Pension Advisory
Committee. The motion was duly seconded and carried unanimously.
ITEM #4 - Reouest for Pension:
The City Manager presonted the PAC IPension Advisory Committee}
recommendation that Sara Ruby be granted a regular pension under Section(s) 2.393 and
2.397 of the Employees' Pension Plan. Sara Ruby was employed on September 13, 1976,
and her pension service credit is effective on that date. Her pension will be effective
October 1, '999.
On August 12, 1999, the PAC approved this pension. Section 2.393 (p) provides
for normal retirement eligibility when a participant has reached age 55 and completed 20
years of credited service or has completed 30 years of credited service. Ms. Ruby qualifies
under the age 55 and 20 years of service criteria. Based on an average yearly salary of
approximately $56,751 over the past 5 years, the formula for computing regular pensions,
and Ms. Ruby's selection of the Joint & Survivor Annuity, this pension will approximate
$35,960 annually.
Trustee Johnson moved to accept the recommendation of the Pension Advisory
Committee. The motion was duly seconded and carried unanimously. "
ITEM #5 - Reouest to Vest Pension:
The City Manager presented the PAC recommendation that Eugene M. Tobias, Jr.
and James M. Lewin, Sr. be allowed to vest their pensions under Sectionls) 2.397 and
2.398 of the Employees' Pension Plan.
Eugene M. Tobias, Jr. was employed on March 29, 1989, and his pension service
credit is effective on that date. James M. Lewin, Sr. was employed on August 20, 1974,
and his pension service credit is effective on February 10, 1975.
The Employees' Pension Plan provides that should an employee cease to be an
employee of the City of Clearwater after completing 10 or more years of creditable service
(pension participation), then such employee shall acquire a vested interest in the retirement
benefits. Vested pension payments commence on the first of the month following the
month in which the employee normally would have been eligible for retirement.

'completed 20 years of credited service in a type of employment described as "hazardous
duty" and further specifically defines service of a Police Officer as meeting the hazardous
duty criteria. Mr. Tobias would have completed 20 years of hazardous duty service on
March 29, 2009. His pension will be effective on April 1, 2009.
Section 2.393 (p) also provides for normal retirement eligibility when a participant
has reached age 55 and completed 20 years of credited service or has completed 30 years
of credited service. Mr. Lewin would have completed 30 years of service on February 10,
2005. His pension will be effective March 1, 2005.
On August 12, 1999, the PAC approved these requests.
Trustee Hart moved to accept the recommendation of the Pension Advisory
Committee. The motion was duly seconded and carried unanimously.
ITEM #6 - Other Business:
In response to a question regarding legislative changes to Police and Fire pension
requi,rements affecting the Pension Plan, Pension Trustee Attorney Lee Dehner said, if
needed, ordinances must be enacted by December 31, 1999. The plan's actuary is
preparing information regarding what improved benefits would be needed if ours do not
meet the minimum required. Mr. Dehner will have this information by October 1, 1999.
