Gentlemen:
In accordance with Section 133.09 of the City of Clearwater Code of
Ordinances, I have reviewed your request for a temporary sidewalk
installation waiver for 730 Old Coachman Road.
All sidewalk with the exception of approximately 20 to 30 feet at the
north end has been installed. Since the installation of this remaining
footage cannot be completed because of a deep drainage canal, I am pleased
to inform you that a temporary waiver of the sidewalk installation
requirement is granted for this area. Should it be determined that
a sidewalk is required at this location in the future, it will be
installed by the assessment process.

Section l33.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and assess the owner for the full cost of
said sidewalks.

The sidewalk for the above location has been installed all but 20' or 3D' at the
north end. This can not be installed due to a deep drainage canal along the
north side of the property. Since it meets the requirements regarding the
inability to construct the sidewalk due to the physical terrain it is my recom-
mendation that the waiver be granted.
