Dear Mr. Spanos:
In accordance with Section 138.09 of the Code of Ordinances of the City of
Clearwater. I have reviewed your request for a temporary sidewalk installa-
tion waiver.
Since installation of a sidewalk at 2590 U. S. 19 North could result in its
damage or removal during construction of an interchange at Countryside
Boulevard and U. S. 19. a temporary waiver of the sidewalk installation
requirement is granted on the above-referenced property with the following
stipulation:
In the event that the Florida Department of Trans-
portation does not install the sidewalk as part of
the interchange project. Plymouth Plaza. Ltd. or
the property owner at that time will install a 5-foot
wide sidewalk at the appropriate location within 60
days after the completion of the interchange at
Countryside Boulevard and U. S. 19. If this sidewalk
is not installed within this 60 days previously men-
tioned. the City of Clearwater will perform the
installation and assess the property owner.

Uncertainty of public right of way boundary and the extent of
prospective riqht of wav improvements.
Section~J8.09 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it,
either for residential, commercial, industrial or other purposes, shall have
sidewalks constructed by the Owner on, across or adjacent thereto.
The Owner understands and agrees that if the waiver is granted, the City may
install sidewalks at a future date and as~ess the owner for the full cost of
said sidewalks. Owner reserves the right to install sidewalks in lieu of City
assessment for same.

We have reviewed the request for a sidewalk waiver from Plymouth Plaza at
2590 U.S. 19 North. Although there is a sidewalk within 200 feet of this location
and the sidewalk could be built, we are recommending that it be waived at this time
due to the impending construction of the interchange at Countryside Boulevard and
U.S. 19. We do not know whether the construction would result in damage or removal
of the sidewalk installed now, but believe that there is a veroy high probability
that this would occur due to the proximity of the frontage roads in relation to the
property line. In the event that the Florida Department of Transportation does not
install the sidewalk as part of the interchange project, it would be appropriate to
have the owner install a sidewalk upon completion of the road project.
