SHOW and KATHERINE M. SHOW, his wife, parties of the second part, hereinafter referred to as the "Owners", of the County of Pinellas, State of Florida; WITNESSETH: WHEREAS, Robert B. Show and Katherine M. Show, his wife, are the owners of the following des cribed real property lying and being in the County of Pinellas, State of Florida, and more particularly described as follows, to wit: Begin at the NE corner of the NW -1/4 of the SE - 1/4 of Section 13, Township 29 South, Range 15 East and run thence o 0 N 89 23'11" W, 866.2 feet; thence S 0 32131" E, 332.34 feet; thence S 89020143" E, 107. 5 feet for P. O. B. ; thence N 0032'31" W, 82.43 feet; thence S 89023111" E, 118.50 feet; thence S 0032131" E, 82.52 feet; thence N 89020'43" W, 118.50 feet to P. O. B. LESS the South 30. 0 feet for road right of way; ALSO Begin at the NE corner of the NW-l/4 of the SE-l/4 of Section 13, Township 29 South, Range 15 East and run thence,N 89023111" W, 981. 8 feet; thence S 0036'11" E, o 332. 24 feet for P. O. B. ; thence S 89 20 '43" E, 341. 25 feet; thence S 0032131" E, 332.49 feet; thence N 89018'16" W, 340.89 feet; thence N 0036'11" W, 332.29 feet to P. O. B. LESS the North 30.0 feet for road right of way; and WHEREAS, said Owners have requested the City to rezone said property in order that the same may be developed by them; and WHEREAS, the City is willing to rezone said property as lIR-3 (LD)" (Low Density Multiple Dwelling) provided that the Owners will agree to certain stipulations in reference to the development of said property; NOW, THEREFORE, for and in consideration of the sum of One Dollar and other good and valuable considerations passed by and between -1- c .., ~ .. '.. -': -~ . .... . - the parties, the receipt and sufficiency whereof is hereby acknowledged, it is hereby agreed by and between the parties with reference to said prope rty as follows: 1. The Owners agree that in the development of the above described .. property Rogers Street will be extended into the property with a cul-de -sac and said Street shall be the entry for approximately one -half of the parking for the project and the other one -half of the parking area shall have entry from Canterbury Road. 2. The Owners further agree that the cost of all paving and any other costs involved shall be borne by the developer. 3. Upon the execution of this Agreement, an ordinance shall be prepared by the City to rezone said property as "R- 3 (LD)" (Low Density Multiple Dwelling),. 4. All the parties hereto mutually agree that this contract shall be binding upon the owners, their grantees, their heirs, executors, administrators, successors and assigns and all parties claiming through them.
