BOARD OF ADJUSTMENT AND APPEAL ON BUILDING/FLOOD CONTROL
CITY OF CLEARWATER
April 9, 1997
The Chair called the meeting to order at 2:02 p.m. at the Municipal Services
Building.
To provide continuity for research, items are in agenda order although not necessarily
disclJssed in that order.
ITEM #1 - Approval of Minutes

Member Nail moved to approve the minutes of the regular meeting of January 8,
1997, as recorded and submitted in written summation to each board member. The
motion was duly seconded and carried unanimously.
ITEM #2 - Continued Requests - None.
ITEM #3 ~ New Reauests
a) 979 Bav Esplanade. Clearwater. Florida. Owners - Philip H. & Michele Eaton. Jr.,
Representative - Harry S. Cline, Esq. Request for variance to code prohibiting
construction within 1 8-feet of seawall. Applicant wants to build to within 1 O-feet of
seawall. Located at Carlouel Sub, Blk 265, Lots 3 & 4.
Representative Harry Cline indicated the newly constructed seawall will not
involve typical deadment for support and a construction setback is not necessary. The
applicant wishes to construct a structure within 10-feet of the seawall.
Mr. Cline said the applicants had razed an existing structure and constructed a
seawall using steel treated to avoid corrosion and featuring 30 to 40-foot deep vertical
I-beams, spaced 7-feet apart, for tie-backs. The City had approved the design. He
said the request is consistent with the zoning code and provides adequate space to
maintain the tie-backs. In response to a question, he said replacing the seawall would
require breaking up the poured concrete.

Michael Matlat, of Keen Realty Consultants, Inc., said the property, which
previously housed a paint store, is part of a pending bankruptcy. Real Estate taxes are
owed. Keen Realty is selling 36 related properties nationally. He said the windows
and door were boarded after repeated damage. He said his company is close to
accepting an offer. He offered to include a clause in the sales contract stipulating the
property will be brought up to code immediately after closing. It was stated that
requirement may be difficult to enforce.

It was noted the seawall is within 5 feet of the house. Central Permitting
Assistant Director Vic Chodora said the standard setback distance in this area is 12 to
15 feet. Even with an 18-foot setback, access to the site would have to be via the
harbor. The City does not object to the request.
Member Walker moved to approve construction within 10-feet of a seawall at
979 Bay Esplanade. The motion was duly seconded and carried unanimously.

47. 161 unsafe buildings to allow additional time the build ing may be board ed. Located
at Sec. 13-29-15, M&B 42.05.
Building Construction inspector Bill Wright distributed the April 2, 1997, Unsafe
(;~ Structure Report Photo Sheet. He said the building, constructed in 1969, would
appear more attractive if the wood is camouflaged with paint that blends with the
current color scheme. In response to a question, Mr. Chodora said the owner will be
required to appear before the Municipal Code Enforcement Board if code violations are
not corrected within established time limits. Mr. Wright recommended the structure be
required to meet code within 30 days of closing. He expressed concerns dangerous
interior violations, such as live, hanging wires, could endanger trespassers. The
Pinellas County School District has expressed concern regarding safety issues related
to students who attend nearby Clearwater High School. He said the structure is a
blight on a main entrance to the City.
Member Shah moved to approve a 90-day extension for the structure at 2027
Gulf-to-Bay Boulevard to meet Section 47. 161 unsafe buildings with conditions: 1)
building shall remain secured and 2) plywood, used to temporarily secure building, will
be camouflaged with paint that blends with structure's current color scheme. The
motion was duly seconded.
Member Walker amended the motion to require the Realtor, Keen Realty
Consultants, to replace the glass within 30 days of closing. The seconder approved
the amendment.

ITEM #4 -Pendina Matters
Mr. Chodora reported the May 14, 1997, BAABF meeting will be held'in the
Large Conference Room ,at City Hall. Members requested staff forward the 1997
parking permits prior to the meeting.
