(Meeting rescheduled from October 18, 1995, due to lack of quorum). To provide continuity for research, items are in agenda order although not necessarily discussed in that order. '::, ITEM #1 - 1578 Ewina Street. Clearwater. Florida. Linda J. Cottrell. Homeowner. Requesting to extend the time allotted for repair of structure. Located in Belmont 2nd , Subdivision, Parcel #: 22/29/1 5/07938/007/0140 Central Permitting Assistant Director Vic Chodora reported no representative for the homeowner was present. Staff Assistant Barbara Borgan stated a letter had been sent regarding the rescheduling of the October 18, 1995, meeting to today. Mr. Chadora said the applicant, Linda Cottrel! who lives in Christmas, FL, sent a Fax this morning that did not state she would attend. A previous Fax indicated she could not attend' the October 18, 1995 meeting, due to a schedule conflict. Vern Packer, Housing Inspector II, reviewed the history of the case and said a Stop Work Order due to violations was issued in December 1994. In July 1995, the home was cited as unsafe and staff sent Ms. Cottrell a certified letter stating the scope of the propertyls renovation needs and permitting requirements. He stated follow-up letters and a title search were sent in accordance with City procedure and no additional work had been completed as of August 11, 1995. Ms. Cottrell sent a Fax on September 1, 1995, stating the Cityls actions were unjust and noting her difficulty in communicating with local contractors. Mr. Parker said Ms. Cottrell must hire a general contractor to pull permits because she does not reside on the subject property. The applicant has had an opportunity to appeal the notice. Mr. Packer circulated the faxes Ms. Cottrell had sent. He reported the asbestos survey was completed and the City is ready to begin demolition. Member concern was expressed that the applicant may not have a clear understanding of the City's requirements. Mr. Packer reviewed the City's correspondence. In answer to a question. he said the Unsafe Building Notice spells out the permit and inspection requiruments and deadlines. He noted the electrical inspector had issued a violation in November 1 994 due to the unpermitted installation of a service panel. Mr. Packer noted even if an extension is approved, Ms. Cottrell may take no action. Concern was expressed the language in City correspondence be in layman's terms for clear understanding. He said staff had recommended Ms. Cottrell contact Community Development for help. Ms. Borgan said, in a recent telephone conversation, Ms. Cottrell did not indicate a specific plan for the property. Mr. Packer stated the requirements and conditions were clearly explained in the follow-up letter sent by s~aff. In answer to a question, Mr. Packer said the house is repairable if the roof is replaced and windows are properly installed. He had not inspected any of the completed work and could not state if it met City standards. Mr. Packer circulated photographs of the subject property taken in July and October 1995. He said serious problems exist and the building detracts from the neighborhood. ("M,*,- . ,~~~., , Member Shah moved to grant the request to extend the time allotted for repair of structure at 1578 Ewing Street in Belmont 2nd Subdivision with the condition that the applicant have a licensed contractor pull the requisite building permits within 30 days and work on the house be completed within 90 days. The motion was duly seconded and carried unanimously. Chair Logan stated the demolition process will begin in 30 days if the first condition is not met. ITEM #2 . 249 Windward Passage. Clearwater Marine Science Center. Clearwater. Florida. Thomas J. Graham. President. Reoresentative. Requesting a variance of 41 to allow a temporary, portable building to be located within an AE-Zone (EL~ 1 2) with a finish floor elevation of 81. Located on Island Estates, at Marina Way, approximately 140' south of Windward Passage. Parcel #: 08/29/15/00000/130/0700. Jim Graham, President of the Clearwater Marine Science Center (MCSC), said the center wishes to use a donated trailer on a temporary basis until a new addition can be funded end built. He reported the center needs office and library space due to increased space requirements for necropsies required by the Environment Protection Agency (EPA) caused by the large number of recent whale and dOlphin beachings. All offices have doubled up and the team from Duke University is housed in a closet. He said the variance is needed because of hardship and not to increase income. Mr. Graham said flood zone requirements require the portable building to be flood- prOOfed or raised and excessively ramped. He indicated the trailer is in poor condition. The center hopes to use it "as islt and locate it in the parking lot. The trailer would be provided electricity, ramping, and a cinder block foundation with proper tie downs to meet established wind loads. He said construction trailers only can be located on construction sites. The board needs to consider the portable buildingts impact on surrounding properties should flooding occur and the impact on the City providing services. Mr. Graham said a four-foot variance is requested beceuse the structure's bottom is wide. Mr. Chodora said staff supports the variance and suggested establishing a two year limit. Member Walker moved to approve a four foot variance to allow a temporary, portable building to be located within an AE-Zone (EL-1 2) with a finish floor elevation of 8' for property locBted on Island Estates, at Marina Way, approximately 140' south of Windward Passage with a condition to limit the variance to 24 months. The motion was duly seconded and carried unanimously. Board Letter to City Commission Mr. Chodora reported the Board would not have to appear before the City Commission but must send them a letter. He provided a draft that introduced the board and reviewed their past year's activities. Chair Logan signed the letter.
