SUB LEASE AGREEMENT FOR PORTION OF CURTIS FUNDAMENTAL SCHOOL . r I I ~ '; '. aUa-LEASE AGREEMENT -- r;Jf-- THIS LEASE AGREEMENT, made and entered into this I day of .-----.')Y"\~ ., 1988, by and between the CITY OF CLEARWATER, FLORIDA, hereinaft,r referred to as "Lessor" and RELIGIOUS COMMUNITY SERVICES, INC., a Florida non-profit corporation, hereinafter referred to as "Lessee": WITNESSETH: WHEREAS, there is need for emergency housing and a transitional housing program to meet the emergency housing situation existing in Clear- water, pinellas County, Florida: and WHEREAS, the Lessee is desirous of sponsoring an emergency housing program but is without a suitable site for same: and citizens location WHEREAS, the Lessor is desirous of providing assistance to of Clearwater and is the Lessee of a suitable site for of said emergency housing program. NOW, THEREFORE, in consideration of the covenants herein contained of the granting of this Lease and of the sums paid and to be paid hereunder, the Lessor hereby leases to the Lessee and the Lessee hereby leases from the Lessor according to the terms, conditions and covenants herein contained, the following described premises located in the City of Clearwater, Pinellas County, Florida, to wit: That portion of the Curtis Fundamental-Clearwater Comprehensive School Complex which is located on the East Side of Holt Avenue from the fenced in area which is currently being used by Clear- water Comprehensive, Northward to Engman Street. I. The term of this lease shall be for the period of two (2) years be- ginning May 1, 1988, and ending on the 30th day of April, 1990. 2. The Lessee hereby covenants and agrees to pay rental therefore in the sum of One Dollar ($1.00), payable at the time of execution of this Agreement, receipt of which is hereby acknowledged by the Lessor. 3. The leased premises shall be used for the following purposes and under the following terms and conditions. a. thereon program. The house locating housing leased premises shall be used for the purposes of trailers to accommodate an emergency transitional b. The Lessee, its agents and assigns shall have the exclusive use of the leased premises for the duration of this lease and the Lessee agrees to use the property in a manner which will not interfere with the educational programs at Curtis Fundamental or Clearwater Comprehensive. c. The Lessee is to provide all maintenance and upkeep of the premises and structures located thereon and hereby covenants and agrees to keep and maintain the premises in good condition and repair during the term of this lease, and to exercise all reasonable diligence in making certain that the premises are maintained in a condition safe for human habitation. The Lessee is to provide sewer, water and electrical service to the premises at its own expense and shall leave said facilities at or on the premises upon expiration or termination of this lease. d. The Lessor covenants and agrees to allow the Lessee peaceful and quiet enjoyment of the premises during the term hereof. e. The Lessee further covenants that it will protect all persons entering upon said premises during the term of this lease and save the Lessor harmless and thereby indemnify the Lessor on account of the negligent acts of its employees or on account of any unsafe conditions that may exist as a result of the negligent operation of the said housing tf- I, Fi..4"J4{.,.e.r:t. 0, / \ JP('<<""... The Lessee agrees to be responsible for the safety of its own invitees in the case of accidental injury. f. The Lessee further covenants and to the maintenance of the housing program, sewer, water and electricity. agrees to pay all bills incident including, but not limited to g. Either Lessor or Lessee may cancel this lease upon forty-five (45) days written notice to the other. i. It is hereby mututally agreed between the parties hereto that in the event of unforeseen questions arising from the use of the premises by the Lessee, then said questions will be resolved by mutual agreement be- tween the Superintendent of Schools of pinellas County, Florida, the City Manager of the City of Clearwater, Florida, and the Lessee's Director of the Emergency Housing Program.
