Kennedy, Jr., Chairman Larry W. Lord, Secretary Reverend Thomas M. Johnston Frank Daniels Douglas Ort Also present: R. G. Whitehead Representing City Attorney Jr. Chamber of Commerce Ministerial Association Police Chief Chamber of Commerce City Clerk The Chairman called the meeting to order and presented four app- lications which had been verbally approved previously and were now ready for confirmation by the Board. 1. UPARC (Upper Pinel1as Association for Retarded Children), for solicitation from March 25 to April 17, 1976. 2. Kiwanis Club of Clearwater, for Peanut Dayan April 9 and la, 1976. . 3. Clearwater Little League, for solicitation on April 3, 1976, only. 4. Pinellas County Interfaith Coalition on Aging, Inc., for direct mail solicitation from April 15 to September 30, 1976. Mr. Lord moved to confirm the verbal approval of the applications outlined by the Chairman. Reverend Johnston seconded the motion which carried unanimously. The application of the College Fund of Pinellas County, Inc., was presented for consideration for solicitation from Hay 1, 1976, to January 31, 1977. While it was considered a longer time than usual, Chief Daniels moved to approve the application of the Col- lege Fund of Pinel1as County, Inc., in accordance with their app- lication. Mr. Ort seconded the motion which carried unanimously. :' The next application to be considered was that of The Salvation Army, for mail appeal from May 10 to June 30, 1976. Hr. Lord moved to approve the application of The Salvation Army for soli- citation in accordance with their application. Mr. Ort seconded the motion which carried unanimously. The next application was that of the Veterans of Foreign Wars, Post 2~73 and Auxiliary, to conduct a Poppy Day on May 28 and 29, 1976. Considerable discussion ensued when it was found the costs were about 30% of the money collected for 1975, because of the portion of the ordinance that states that anything over 20% would ~ be excessive. " "I;: , r ~ . , "... -, . ~ '" dJo'd Reverend Johnston moved to approve the application at this time, but the Clerk was to request information from them as to who makes , the poppies and point out to them the 20% portion of the Charity Solicitations law. Mr. Lord seconded the motion which carried unanimously. The next application was that of Ladies For Life, an organization composed basically of wives and clients of chiropractors, to sell tickets for a benefit drawing for the period of April 14, 1976, to June 12, 1976. The Chairman read portions of Florida State Statute, Chapter 849, with particular reference to 849.09 which prohibits lotteries, and it was his feeling that this was directly a lottery and, therefore, in violation of the State Statute. Con- siderable discussion ensued on the matter, after which Chief Daniels moved to deny the application and notify them of the Florida State Statute on this matter as outlined by the Chairman. Mr. Ort sec- onded the motion which carried unanimously. The minutes of the meeting of March la, 1976, were presented for approval. Mr. Lord moved to approve the minutes of March 10, 1976, as presented to each Board member in writing. Chief Daniels sec- onded the motion which carried unanimously. The Clerk reported that he had received a request from Dunedin Band Boosters to solicit funds in Clearwater and he questioned whether they needed a permit in accordance with the Charity Soli- citations Ordinance. Reverend Johnston, who is also a member of the school board, noted that the school board had made a donation for the first time for bands. Considerable discussion ensued as to whether the Dunedin group should come into Clearwater and whether Clearwater went into Dunedin, and so forth, but it was the final consensus that they be allowed to come in without a permit with the recommendation that they solicit only in the northern portion of the City of Clearwater.
