LEASE AGRE>>1ENr dayof ~L 'IHIS LEASE AGREEMENT, made and entered into this ;J.. ,..t , 1980, by and between the CITY OF CLEAlMATER, FIDRIDA, hereinafter referred to as "Lessor" and RELIGIOUS roMJNITY SERVICES, INC., a Florida non-profit oorr:nration, hereinafter referred to as "Lessee "; WITNESSmH : WHEREAS, there is need for erceIgency musing and a transitional housing program to rreet the erceIgency musing situation existing in Clea:rwater, Pinellas Cb1.D1ty, Florida; and t"IIEREAS, the Lessee is desirous of srx:>nsoring an emrrgency housing program but is without a suitable site for ~; and WHERE, the Lessor is desirous of providing assistance to the citizens of Clea:rwater and is the lessee of a suitable site for the location of said enErgency housing program. Nav, 'mEREroRE, in oonsideration of the covenants herein oontained of the granting of this Lease and of the sums paid and to be paid heretmder, the Lessor hereby leases to the Lessee and the Lessee hereby leases from the Lessor acoording to the tenns, oonditions and oovenants herein oontained, the following describedpremi.ses located in the City of Cleal:Water, Pinellas County, Florida, to wit: That portion of the Pa~tto Elem:mtary- CleaJ:Water Canprehensive School Q:xnplex which is located on the East side of Holt Avenue from the fenced in area which is current! y being used by Clea:rwater Canp:rehensive, Northward to Engman Street, 1. The tenn of this lease shall be for the period of n..o (2) years beginning with the execution hereof, and ending on the 30th day of April, 1982. 2. The Lessee hereby covenants and agrees to pay rental therefor in the sum of 'I\..o Ibllars ($2.00), payable at the time of execution of this Agreanant, receipt of which is hereby ackrx:Mledged by the Lessor. 3. The leased premises shall be used for the purposes of locating thereon house trailers to accamodate an anergency transi tionallDusing program. b. The Lessee, its agents and assigns shall have the exclusive use of the leased pranises for the duration of this lease and the Lessee agrees to use the property in a manner which will not interfere with the educational programs at PaJ..rretto EIE!la1tary or Clearwater Ca'cprehensive. c. The Lessee is to provide all maintenance and upkeep of the premises and stnlctures located thereon and hereby covenants and agrees to keep and maintain the premises in good condition and repair during the tenn of this lease, and to exercise all reasonable diligence in making certain that the premises are maintained in a condition safe for hum:m habitation. The Lessee is to provide sewer, water and electrical service to the premises at its own expense and shall leave said facilitiE'.s at or on the premises upon expiration or tennination of this lease. d. The Lessor covenants and agrees to allow the Lessee peaceful and quiet enjoynent of the premises during the tenn hereof. e. The Lessee further covenants that it will protect all persons entering upon said premises during the tenn of this lease and save the Lessor hannless and thereby indemnify the Lessor on account of the negligent acts of its enployees or on account of any unsafe conditions that may exist as a result of the negiligent operation of the said housing program. 'lbe Lessee agrees to be responsible for the safety of its own inviteesin the case of accidental injUlY. f. The Lessee further covenants and agrees to pay all bills incident to the maintenance of the housing program, including, but not limited to, sewer, water, and electricity. g. The Lessee further covenants and agrees not to cut or damage any existing trees on said premises and to restore said pranises to its original condition upon the eJq')iration or tenni.nation of this lease. h. It is hereby mutually agreed be1:YJeen the parties hereto that in the event of tmforseen questions arising from the use of the preni.ses by the lessee, then said questions will be resolved by mutual agreem::mt between the Superintendent of Schools of Pinellas COl.mty, Florida, the City Manager of the City of CleaJ:Water, Florida, and the lessee's Director of the Errergency Housing Program.
