". f , , /~ MINUTES OF THE MEETING OF BOARD OF TRUS TEES OF THE CLEARWATER POLICE SUPPLEMENTARY PENS ION FUND HEW NOVEMBER 18, 1975, The November meeting of the Board of Trustees of CLEARWATER POLICE SUPPLEMENTARY PENSION FUND was held on November 18, 1975 in the Conference Room of the Police Building, 644 pierce Street, Clearwater,' Florida. The following Board members were present: GABRIEL CAZARES, Chairman FRANK DANIELS, Secretary DONALD HIBBARD JERRY ROBERTS BERNARD ENLOW Also present were Guy L. Kennedy, Jr., Assistant city Attorney, and Betty Ward, Chief Daniels' secretary. ........ Mayor Cazares, Chairman of ,the Board of Trustees, called the ,.~........J meeting to order at 2:00 P.M. He requested the approval of the minutes of the meeti~g held on October 9, 1975. Officer Roberts made a motion that the minutes be approved. Motion seconded by Donald Hibbard. Motion carried unanimously. The first item on the agenda was a request from Edwin Kent for pension benefits under the supplementary pension. Mr. Kent had indicated that he would like a lump sum settlement. Frank ' Daniels, secretary, called upon Mr. Kennedy to report on the lump sum ordinance. Mr. Kennedy advised that the ordinance would be read at Commission meeting on December 4 and on December 18, 1975, and subject to this ordinance being passed by the City commission, Officer Kent could defer taking any benefits at the present time, and would have to sign a waiver and be fully apprised that he would be waiving a right to any future benefits if he chose,the lump sum, this could be done. Captain Enlow made a motion that Officer Kent's request be approved sUbject to signing the necessary waiver 'which Mr. Kennedy would prepare, and sUbject to the Lump Sum Ordinance being passed by the City commission. Motion seconded by Jerry Roberts. Motion passed unanimously. .....J Item Number Two on the agenda was a request from Moses Moore for pension benefits. ".t, ". ~ ."t" , , ,- Page Two CLEARWATER POLICE SUPPLEMENTARY'PENSION FUND of November 18, 1975 Minu tes motion that the Board approve both requests, subject to their election in writing upon receipt of a detailed outline of alternatives available, based on the lump sum settlement ordinance passing. Motion seconded by Jerry Roberts. Motion carried unanimously. Jerry Roberts made a motion that the Board approve and recommend that the ordinance on Lump ,Sum Settlement, which has been prepared by Mr. Kennedy, be sent to the City commission for passage. Motion seconded by Donald Hibbard. Motion passed unanimously. Item Number three on the agenda was a request from Dorothy Smith, ',Traffic Enforcement Officer, . to become a participant in the Supplementary Pension. Chief Daniels asked Mr. Kennedy to report on this matter. Mr. Kennedy reported that he had requested an opinion from James R. Vereen, Insurance Commissioner's Office, Tallahassee, and that he had received correspondence from Mr. Vereen~s office. Said opinion stated that since Mrs. Dorothy Smith has been certified by the Police Standards Council, and she is participating in the General Employees' city of Clearwater Pension Plan, she is qualified to become a participant in the Supplementary Pension. Said opinion also stated that Mr. Dennis Becky, Traffic Enforcement Officer, was grandfathered in under the Police Minimum Standards, however he must participate in the General Employees' Pension Fund of the City of Clearwater in.order to be eligible to participate in the Supplementary Pension. Since Mr. Becky was excepted under Section 1 of the City of Clearwater General Employees' Pension Fund due to being over forty-five years of age at time of employment, Mr. Becky would not qualify to patticipate in the Police Supplementary Pension Fund. Attached to and made a part of these original minutes is a copy of Mr. Vereen's correspondence to Mr. Kennedy dated November 6, 1975 relative to Dorothy smith and Dennis Becky. Mr. Hibbard made a motion that Dorothy Smith be included in the Supplementary Pensipn and that the Secretary be authorized to complete the necessary paperwork to accomplish this. Motion seconded by Jerry Roberts. Motion carried unanimously. Meeting was adjourned at 2:30 P.M.
