CLEARWATER POLICE SUPPLEMENTARY PENSION FUND Board of Trustees Meeting MINUTES Minutes of meeting held on May 28, 1968 in the Office of Police Chief Booth, Police Headquarters. J Meeting was called to order at 10 A.M. by the Chairman, Mayor H.Everett Hougen. Those present were Mayor Hougen, Assistant city Attorney Guy L. Kennedy, Mr. Jack Martens, Chief Booth, Secretary - Capt. William McClamma and Sgt. E. Lester Marston. Mr. Guy Kennedy, Assistant city Attorney, gave a report on Agenda #1 which was, "A'discussion and appropriate action by the Board of" the 1% · voluntary deductions. These deductions were made from the salaries of articipating police officers from December 1959 until December 1963. H~ explained the basis for which it was established and explained that the 1% deductions were needed to qualify in accordance with the law and that in checking with Mr. Harry Boggs of the state Treasurer's Office, that the 1% deductions were an int~~~al ~art of the assets controlled by the Trustees, that the f~e~~ ~r~dicated' on these funds being available,. and that the Trustees do not have the right to refund these monies except under certain conditions. Mr. Kennedy enumerated these conditions, and they are: If an officer withdraws from the Fund after having less than ten years' service, he would get back the lesser of two amounts, either the cash value of his insurance or 100% of his contributions to the Fund. More than ten years' service, he would get back a sum equal to the cash surrender value of his insurance. In surnmation~ Mr. Kennedy rendered his legal op~n~on that since the 1% deductions' were originally required and are a part of the assets of the Fund, they definitely cannot be withdrawn and refunded except as outlined above. Mr. Martens made a motion that, liThe Board of Trustees upon receiving the legal opinion submitted by Guy Kennedy, and supported by the . opinion of Harry Boggs of the Insurance commissioner's Office, it is apparent that the Trustees do not have' the authority to withdraw and refund to the participants any of the voluntary contributions that we~e submitted during the initial stages of the pension plan, inasmuch as any such action would be completely illegal. .....".; Chairman Hougen said he did not think a motion was needed since ,the Board had the legal opinion fram Mr. Kennedy. Mr. Kennedy said that before the Board can make any determination the Board is required to' go ahead and select a medical authority and this authority should furnish a ,,/ritten report to the Trustees regarding the subject. .C~, ( . ,., ,'. Mayor Hougen advised that the City Commission had unanimously approved and authorized the city Manager to employ two physicians to examine Sergeant Schineller and reper t thei:t~ findings, and that this Board could select one physician to join with the two the city has appointed. '. .," At this point the Chairman, Mr. Hougen, wished the following be placed into the minutes, "This Board is taking this action in the interest of Vincent Schineller himself, and if he is disabled, and such disability is a result of his occupation and in the line of duty, then we want to give him every benefit to which he is entitled. The Board agreed with Mayor Hougen. .:'<. ';" C.J Captain McClamma made a motion that the Chief of Police be authorized to contact the City MQnager and work with him in obtaining a third physician to work with the other two physicians to determine whether Sgt.
