CONSTRUCTION CONTRACT - FIRE HOUSE NO. 3/BELLEVIEW COURT SUBDIVISION BLK. C. LOTS 5 AND 6 J I ""~,","- CONSTRUCTION CONTdACT If;- THIS AGREEl\/IENT made the ,j day of January, A, D, ,1950 by and between R, M, THOMPSON CO., a Florida corporation, herein- after called the Contractor, and CITY OF CLEARWATER, FLORIDA, a Municipal Corp~ration, hereinafter called the Owner, WI'i'NESSE~H : That the Contractor and the Owner for the considerations hereinafter named agree as follows: ARTICLE 1. SCOPE OF THE ~ORK: The Contractor shall fur- nish all of the IIR terials and perform all of the work shown on the Drawings and described in the Specifications for Fire House No.3, City of Clearwater, prepared by J. A. Altschuler, Architect, acting as and in theBe Contract Documents entitled the Architect; and shall do everything required by this Agreement, the General Conditions of the Contract, the Specificati ons and the Drawings. Said fire house to be constructed on Lots five (5)and six (6), Block "c" BELLE'HE\'I' COURT SUBDIVISION, according to the map or plat thereof as recorded in plat book 10 at page 42 of the public records of Pinellas County, Florida. ARTICLE 2. TI1m OF COMPLETION: The work to be performed under this Contract shall be commenced at such time as to insure completion for occupancy and use by July 1, 1950. ARTICLE 3. THE CONTRACT SUM: The Owner shall pay the Contractor for the performance of the Contract, subject to additions and deductions provided therein, in current funds as follows: Seventeen Thousand Seven Hundred Fourteen Dollars (~l7,714.00), Where the qU!l.Iitities'"Qriginally contemplated are so changed that application of the a.greed unit price to the quantity of work performed is shown to create a hardship to the Owner or the Contractor, there shall be an equitable adjustment of the Contract to prevent such hardship. ARTICLE 4. PROGRESS PAYMENTS: The Owner shall make payments -1- (2) (tiS!! - / o-c~.. "" ____.,_j .J I ~ on account of the Contract as provided therein, as follows: On or about the 26th day of each month 85 per cent of the value, based on the Contract prices, of labor and mat,erials in- corporated in the work and of materials suitably stored at the site thereof up to the 25th day of that month, as estimated by the Architect, less the aggregate of previous payments; and upon substantial comple- tion of the entire work, a sum sufficient to increase the total pay- ments to 85 per cent of the Contract price. ARTICLE 5. ACCEPTANCE AND FINAL PA'{MENT: Final payment shall be due 30 days after substantial completion of the work pro- vided the work be then fully completed and the Contract fully performed. Upon receipt of written notice that the work is ready for final inspection and acceptance, the Architect shall promptly make such inspection, and when he finds the work acceptable under the Con- tract and the Contract fully performed he shall promptly issue a final certificate, over his own signature, stating that the work provided for in this Contract has been completed and is accepte9 by him under the terms and conditions thereof, and that the entire balance fbund to be due the Contractor, and noted in said final certificate, is due a1 d pa~Table . Before issuance of final certificate the Contractor shall submit evidence satisfactory to the Architect that all payrolls, ma- terial bills, and other indebtedness connected with the work have been paid. If after the work has been substantiaL ly completed, full cOl~letion thereof is materially delayed through no fault of the Con- tractor, and the Architect so certifies, the Owner shall, upon cer- tificate of the Architect, and without terminating the Contract make I .- _ - , payment of the balance due for that portion of the work fully completed and accepted.
