In Mr. Reis' absence, Mrs. Garvey called the meeting
to order at 1:00 P.M. Mrs. Garvey reported that a memorial
fund has been established for Mrs. Audrey Patouillet, a former
Library Board member, by the Friends of the Library.
Mrs. Andersen reported on the May 19, 1977, City commission
meeting. The Winn Dixie site was discussed at the meeting as
a possible main library headquarters. A report was prepared by
the Library staff for the Commissioners' study. It was decided
at the meeting that the site might be considered for other
purposes, but that the Commissioners wanted to go ahead with
the downtown site for the main library.
Mr. Barre questioned whether the figure ($4.4 million)
for the Library on the referendum was adequate. Mrs. Andersen
stated that the cost includes the opening and operation of a
new main library and a Starcrest branch for one year. The
figure is not as cushioned as that for the proposed Civic Center,
but it is adequate.
Mrs. Andersen discussed the guidelines for distribution
of free materials in the Library. A memo from the City Attorney,
Thomas Bustin, states that an actual policy has not been
established for this issue. Mr. Bustin listed guidelines to
be considered in a recommendation to the City Manager (see copy
attached). Mr. Barre asked what the Library's policy has been
in the past regarding the distribution of free materials.
Mrs. Andersen stated that non-profit, community related, or
government materials have been allowed; however, private
businesses are not allowed to distribute sales brochures or
advertisements. Mr. Rogers suggested waiting until the next
Board meeting for further discussion on this issue when more
members might be present.

Mrs. Garvey questioned the status of the leased space
proposal. Mrs. Andersen stated that funds had been requested
from the surplus salary account to open leased space at this
time. However, this request was not approved, as new services
are not started in mid~year. This matter can be requested
in the new fiscal year budget for 1977/78.
. Mrs. Andersen reported on the requested appointment
to the new Reference Librarian position. Mr. William Jackson
from Dothan, Alabama, was chosen from the top .five applicants.
Final approval had not been received at the time of this
meeting from the City Manager. If approved, Mr. .Jackson will
start on June 15, 1977.
Mrs. Garvey noted that the last Peanut Butter Buffet was
May 19, 1977. The slide presentation shown to various clubs
and groups in the area was presented at this buffet. Mrs.
Garvey asked that members continue writing Uletters to the
editor" of local papers on the library issue.
Meeting was adjourned at 1:30 P.M.

This is in response to your ~ernorandwn relating to the distribution of
materials received from various groups free of charge.
If I un.JyrtJtand thc question posed in the mernorandwn, it appears to relate to
the kind of policy to b~ established by the City Manager regarding the decision
whether or not to display such items. See Section 12-6 of the Code of Ordinances.

Initially I should point out that this departrnc1Jl has not authored an opinion
for any of the other departments of the City regarding this issue.
While this office cannot establish the actual policy, it would appear that the
following are pertinent guidelines that should be cons idered in any recommendation
to the City 1vlanager:
1. Since the material is received free, no obligation arises to
distribute any material.
2. Does the material' relate to the operation of the Library,
the us e of the Library or any function associated with a
library use? If BO, it probably should be distributed.
3. Does the ma terial relate to a problem of health or charity?
If BO, it probably should be distributed.
4. . Does the material relate to a recl'eation program? If so, it
shoulcl be considered for distribution.
5. Does it fit in with a travel program? If so, normally such
information is typically found in and as sociated with a llbl'a ry.
In other words, utilizing the above criteria, the Board should focus its attention
