Parks and Recreation Board Minutes
Monday, September 25, 1995
The regular meeting of the Parks and Recreation Board was held at City
Hall on Monday, September 25, 1995 , at 6 : 30 P . m. Members present
included; Mr. Henry Cruise, Mr. Gary Giordano, Mr. Donald Harris, Mr.
Stephan Guss, Chairperson Charles Weaver, and Mr. William Kirbas. Mr.
Michael Stafford, Mrs. Deborah Hobbs, and Mr. Doyce Haggard were not in
attendance. Staff members in attendance included Mr. Art Kader, Mr. Steve
Miller, and Mr. Ream Wilson.
Chairperson Charles Weaver called the meeting to order and asked for a
motion regarding the Parks and Recreation Board meeting of Monday August
28, 1995. There being no recommended changes to the minutes, Mr. Harris
made a motion to approve the minutes as mailed, which was seconded by Mr.
Kirbas and approved.

Mr. Weaver stated he had received some correspondence for board action.
First, he read a letter of resignation from board member, Mrs. Deborah
Hobbs. Mrs. Hobbs thanked the City for the opportunity to serve on the
board, and explained she would have to resign ,from the board due to family
responsibilities. Also,}1r. Weaver read an ..E-Mail message" from Mr.
Doyce Haggard. Mr. Haggard indicated he would have to resign from the
board because of personal and physical reasons.
" 0 UPCOMING ,RECREATION EVENTS - Mr. steve Miller, Superintendent of
:,',. Recreation, passed out a list of Recreational Activities scheduled to be
held during the month of October. He said staff was working on a larger
board ,so that these type acti vi ties could be shown on the television
screen for, residents viewing the board meeting. Mr. Miller highlighted
each of the activities included on the sheet that was passed out to board
members which included the Turkey Trot Track Team Cross Country Meet,
;, \ Downtown Comes Alive Concerts, First Annual Collegiate Women' 5 Tennis
" Invitational Tournament, City Expo/Clearwater Parks and Recreation
,Department Mall Show, etc. A complete listing to these activities as
explained by Mr. Miller is attached to these minutes.

Mr~ Weaver explained ,the next item on the agenda was old business.
A. Roller Skating in City Parks - Mr. Weaver introduced Mr. Tom Sellhorst
who'attended the meeting to speak about roller skates in City parks. Mr.
Sellhorst said he owns a business at 611 Palm Bluff. He said Clearwater
,is a great community and the Parks and Recreation Board was one way that
, citizens could become involved. He said the Board represents all citizens
'and should look at all activities. He informed members he had just
returned from Holland where he participated in a 126 mile roller skating
race. Mr. Sellhorst said he lived at 880 Mandalay and during the Fourth
,-:,e'O- ' of July Festival held at Coachman Park, he decided to skate to avoid
. ' pollution and, traffic problems. He said when he arrived at the park, a
police officer informed him that he could not use his skates in the park.
He said he went to another side of the park and was 50 informed by another
officer. He

asked board members why people are not allowed to skate in City parks. He
said he had contacted Mr. Wilson regarding accident reports that might be
available, and there were none.
~Mr. Kirbas said the Parks and Recreation Board had discussed this subject at
the last meeting. He said skates were allowed at parks but felt the Parks
and Recreation Department might lopk at additional opportunities that could
be held for roller skaters at City facilities.
Mr. Weaver read city Ordinance Section 22.49. which addresses dangerous games
in parks including roller skating. Mr. Sellhorst confirmed that this was the
ordinance that he was referencing. He said the number of people roller
skating now exceed the number of people that run for exercise. Also, he said
people from ages 8 - 80 years use roller skates.

Mr. Giordano indicated safety was the major concern regarding roller skates
in parks. He said that during the Fourth of July Festival, many thousands of
people were at Coachman Park and it would have been a safety problem to allow
roller skates on the sidewalks. Mr. Sellhors t felt they should be warned
before people are asked to leave parks. He suggested we look at the
ordinance recently passed by the City of Tampa regulating roller skates. He
also said we should look at other ordinances of nearby communi ties. Mr.
Sellhorst feels the City's ordinance is discriminatory to him. He didn't
know who should have the responsibility' and authority to tell him he could or
could not skate in a city park. He said Lake Seminole Park of the County
has skating and encourages it. He also said the City has a $10,000,000 budget
but have no places for people to skate. He feels the City has gone overboard
o with concerns about liability.
Mr. Wilson responded that skates are allowed in City parks. For example, he
said Mr. Sellhorst could go today or tomorrow to Coachman Park and he would
have no problems in roller skating on the sidewalks. He also said that
people could skate on the sidewalks on Crest Lake Park and at other parks. He
said that Section 22.49. of the City ordinances does not prohibit skating in
parks, but rather it gives police an opportunity to stop skating if they feel
it will be a dangerous situation. For example, he said skating with 30 or
40,000 people at Fourth of July in Coachman Park would be a safety problem.
Therefore, it was stopped. Otherwise, people are allowed and are encouraged
to skate in parks. Mr. Wilson went on to explain that the Recreation
Division is purchasing a uBorder Patrol" which will be 'used on the basketball
court at Morningside Recreation Complex so roller hockey can be played.
Basically, the uBorder Patrol" will stop the puck or ball from going outside
the area. Also, Mr. Wilson said the City will be constructing an asphalt
oval at the new park on Soule Road for youngsters to roller skate. Further,
he suggested future sidewalks to be located in parks be increased in width
from six feet to ten feet acknowledging the fact people not only use a
sidewalk for walking, but also for bicycling and skating.

. . Mr. Harris felt the ordinance is good as it is and it prevents accidents from
. happening. He said roller skating at Coachman Park could have been dangerous
during the Fourth of July Festival just as it could be dangerous during Jazz
," 0 Holiday when many thousands of people attend the park. other than during
" special events of this type, he feels skating should be allowed in parks.

Mr. Kirbas felt that city staff should be investigating and studying special
facilities to accommodate people using roller skates.
~Mr. Guss said the October schedule of special events read by Mr. Miller did
f" ~ not indicate anything for roller skaters. He felt this should be done. He
feels the current ordinance might be amended in a manner so that roller
skating would not be prohibited until such time as a specific number of
people are in attendance at a park for an event. This might be a different
population at different parks. He said it is hard for skaters to tell when
they can or cannot skate.
Mr. Kader said there was a lot of freedom in the current ordinance and that
skaters can now use all of our parks except when it might be deemed to be
dangerous. He said it gives people considerable freedom to skate. Also, Mr.
Kader said that many of our parks have signs that read "No Dogs in Parks" or
~Dogs Must be on a Leash". He said some people pay attention to these signs
and some do not. He feels the same might occur if there were signs regarding
skating.
Mr. Kirbas feels the City would have problems setting limits by the number of
people. He said a letter might be sent to the city Manager to look into the
situation.

Mr. Weaver said staff should review the Tampa ordinance and Mr. Wilson
responded that this would be done. Mr. Harris said it might be possible to
set dates up front as to when skating would be or would not be allowed.
. 0 Mr. Miller said that the current ordinance allows staff to stop other
:, dangerous activities that might occur in parks such as golf, baseball when
,: conducted when there might be safety concerns, etc.
Mr. Sellhorst again reiterated that the city should get input from Tampa and
other communities and to look at these ordinances before making a decision.
A' consensus of the board was for staff to look at other ordinances and to
agenda this subject again for the october meeting.
,B. Capital Improvement Projects - Mr. Kader provided board members with an
update of various capital improvement projects. These include:
Clearwater Beach Recreation Complex - The deck has been completed and is
currently in use.
Frank Tack Park Re-Lampin9 - Two baseball fields will be re-lamped and
the City is currently receiving bids. Once received, lights will be
installed by City forces.
Jack Russell Stadium - A.D.A. improvements including the elevator is
currently under construction. The rehabilitative building, storage
building and garage building at Carpenter Field are also under
construction.

Crest Lake Park Restrooms - This project is currently out for bid and we
plan to go to the city Commission for approval on October 5.

Countryside Recreation Center Building - Mr. Kader said the low bid for
the Countryside Recreation Center Building was $1,425,218. He said this
~ was approximately $185,000 over budget. He said staff has their
. ...,' archi teet talking to the apparent low bidder to do "value engineering"
to see if prices could be reduced. The first objective is to reduce the
cost. If additional funding is necessary, the best source of moneys
might be dollars set aside for the East/West Bicycle Trail. Mr. Kader
stated there is currently $202,000 available for this trail and some of
this money could be reallocated, if approved by the city Commission, to
the Countryside Center.

Mr. Giordano asked what problems would exist if residents in the area opposed
the parks development. Mr. Wilson explained that he did not feel this would
be the case since the development of the site would take into consideration
" leaving a buffer between the closest residences and the entrance road and
facili ties. This would be far superior to any other type of development.
However, if residents should oppose, the direction and response as to what
would happen to the property would have to be answered by the Department of
Environmental Protection. Chances are, the City would have to enter in to a
uconversion" situation where other property of equal value was acquired and
developed as originally intended.
Lake Chautauqua Park - Mr. Kader reminded members that the Department of
Environmental Protection has contacted the City and indicated that this
park must be developed since it was acquired with a "Land and Water
Conservation Fund Grant" in early 1970. He said staff prepared a time
table and sent it to the D.E.P. which was approved. He said that the
City'S consultant, Post, Buckley, Schuh, and Jernigan, Inc. of Tampa,
has been asked to make a proposal regarding the first phase of
development which would culminate with a "Master Plan of the Park".
Mr., Kader said that this plan and other concepts of a plan would be
presented to the board for consideration at the October meeting.
Subsequently, a meeting will be set with residents around Lake
Chautauqua Park during the early part of November to gather their input
and preferences for park development. A representative from the
Department of Environmental Protection would probably also attend this
meeting will more than likely be scheduled at the Countryside
Library.
Mr. Kader said the City has $260,000 budgeted for Phase 1 in 1995/96 and
$120,000 for Phase 2 in 1996/97.
c. Other Reports to Board Member Inquiries - Mr. Wilson informed members
that the Swedish National Team has made arrangements to use the Long Center
. in July of' 1996 for Olympic training. Mr. Miller indicated other "Water
Polo" teams are also negotiating for use of the Long Center.
Members were informed the City Commission discussed the letter the Board sent
recommending that benches and shelters be placed along the south side of the
Memorial Causeway. Mr. wilson informed members that the Commission directed
O. that only'benches be placed at this time without roofs. Also, the Commission
" indicated that benches should be made of recycled materials. Mr. Wilson
stated that he would proceed with this direction.

Mr. Wilson also informed members that their letter to the City Commission
regarding direction for the Parks and Recreation Board was discussed. Mr.
Wilson has been infor.med that beginning in April of 1996, one board per month
~will have approximately 30 minu~es to sit with the City Commission during a
work session to discuss activit1es of the board and direction from the City
Commission. Mr. Kirbas said that the City conunission wants to know more
about the advisory boards and these meetings might help to provide
information.
Mr. Wilson also distributed a memorandum he had sent to the City Manager,
Mrs. Betty Deptula, regarding a potential park site being considered at the
former Bayview Mobile Home Park property. Mr. Wilson stated that
Commissioner Justice contacted his office and inquired as to whether or not
this property might make a nice park. Mr. Wilson said he and Mr. Kader
visited the site and found it consisted of beautiful old oak trees and that
it possibly could be developed in a manner similar to Crest Lake Park, but on
a much smaller scale. This would include grass, trees, scattering of a few
picnic tables, playground equipment for young children, etc. He said it is
separated from Tampa Bay by property owned by the County. Other positive
factors for a park include; it would preserve about 4 acres of open space on
a major artery in to Clearwater, it would provide a park site in a section of
town which currently has no City parks. For example, the City owns no park
property south of state Rd. 60 or east of U.S. 19. Also, if arrangements
could be made with the County, access might be made to the bay by way of a
boardwalk. However, Mr. Wilson reminded board members that the current
owners of the property might not be interested in selling and appear to be
interested.in a long term lease or to see what the market might bring. Also,
O Mr. Wilson indicated that if the site was to be considered a neighborhood
.' park, there would be approximately $1,66,000 available from impact fees that
could be used forward it's acquisition. Also, if the City Commission
determined that it was of City wide significance, impact fees from throughout
the City ($425,000) could possibly be used. Finally, Mr. Wilson indicated
this information had been forwarded to the City Manager for her consideration
and for that of the City Commission. No further action will be taken until
such time as direction is received from the City Manager.

Mr. Kirbas said residents of the Bayview area are very concerned that a lot
of the area could be changed to commercial. He said preservation of the
property would preserve it in open space. He feels the city should pursue
it's purchase. Mr. Giordano indicated that it appears the current owners are
not interested in selling the property. Mr. GUBS also indicated the owners
might not want to sell. Mr. Kirbas felt the City should still pursue the
purchase. Mr. Weaver said that if the zoning goes through and the property
becomes commercial, the price probably will be more expensive. Mr. Weaver
also felt if the City was going to pursue the site, staff should talk to
current owners face to face. Mr. Harris felt that the City should go for the
property. He also felt a lease might be a good idea.
Mr. Kader responded that the City currently leases property from various
sources including Florida Power at the Clearwater Beach Recreation Center,
and will be leasing right-of-way from Florida Power at the new Countryside
c:) Recreation Center.

Mr. Weaver explained the next item on the agenda was new business.
~A. Towar Proposed for Clearwater Beach - Mr. Wilson informed members that the
-.,. City Commission directed staff to negotiate a contract with the owner of the
tower for possible placement of the tower on the parking lot of the Memorial
Civic Center building. Mr. Guss said he felt any consideration of a tower on
Clearwater Beach should go before the residents at a referendum. He felt
many people are against it but it now appears to be a done deal. He said the
board was opposed to it in the past.
Mr. Weaver doesn't feel a tower is in the best interest of the city but that
the project is being forced on people.
Mr. Kirbas said there is a big problem on the beach and that businesses need
attractions. He said there is very little for people to do on the beach
during the evenings and other times and that activities are needed to bring
people to the beach. He said if businesses do not succeed, people could go
out of business and higher taxes could result.
Comments by Board Members - Mr. Kirbas said beach volleyball and other
., activities should be sought and promoted for Clearwater Beach. He said
activities such as this will be a tremendous help to businesses. Mr. Kirbas
also asked who was re-sodding the north side of the Memorial Causeway. Mr.
Wilson responded that this could be a utility contract where the contractor
. is asked to restore the property to the original condition or work could be
,. . ~ pe~formed by the Department of Transportation where the shoulders of the road
.. 'Q are being shaved to allow water to drain off the road pavement. Either way,
\., . he. said sodding is being done by others and not the ci ty .
Mr. Cruise had no comment.
Mr. Guss asked about weeds being pulled from Stevensons Creek ditch. He
. asked which department would be responsible for this type proj ect. Mr.
Wilson advised Mr. Guss to contact the Public Service Department which
handles sto~ water activities.

Mr. Weaver asked who removed the two or three ducks from Crest Lake Park. Mr.
Wilson responded that as soon as ducks are found at Crest Lake Park, staff
normally arranges with "The Duck Truck or other organization" to remove the
ducks to outlying lakes. He said they multiply very rapidly and become
problems to adjacent residents. Mr. Weaver also asked about "scum" that
.exists along the edge of lakes. Specifically, he said this condition exists
along the shoreline of Crest Lake where water is discharged from a pipe. Mr.
Wilson and Mr. Kader indicated they would look in to the situation.
Mr. Weaver also invited residents who might be viewing the board meeting to
show their interest in Parks and Recreation Board activities by registering
at the City Clerk's office to serve on the Parks and Recreation Board. He
indicated to viewers that two vacancies existed.
