The meeting was called to ordor by the Chair at 2:00 p.m. in the Commission Chambers of City Hall.
Ms. Nixon led the Invocation and Pledge of Allegiance. Chairman Merriam outlined the procedures for
conditional uses and advised that anyone adversely affected by a decision of the Planning and Zoning
Board, with regard to conditional uses, has two weeks from this date in which to file an appeal through
,the City Clerk Department. Florida Law requires any party appealing a decision of this Board to have
a record of the proceedings to support the appeal.
By motion duly seconded, the minutes of the May 2, 1995 meeting were approved as submitted.
B.

',Mr. Shuford gave the background of the application and presented, In writing, the staff
recommendations.
Questions 'from the previous meeting were discussed in regards to the storago trailers in the back. Ms.
Nixon asked about the ordinance that is being proposed pertaining to the request in this item. The
board member wanted to know if it wouid deal with the aesthetics of an area.
Mr. Shuford stated that the ordinance would address aesthetics and be tied to charitable organizations.
A short discussion on having the trailer located in the back ensued.
Mr: Keyes recalled that at the last meeting they had denied sidewalk sales, approved the other storage
trailer location requests and that at to day's meeting they were to decide on the location of the trailer.
It was noted by a board member that Wal-Mart today, the sidewalk was covered by plants, and people
were walking In the street.
Speaking for Goodwill lndustrles-Suncoast, Inc., Denny Sullivan, 545 77th Avenue North, St.
Petersburg, stated that it is very important to have a visual representation for this trailer. When a drop-

Instances where this has occurred. Mr. Sullivan briefly stated his reasons for selecting this location
for the trailer.
Ms. Nixon stated that she was not making a comparison between Goodwill and Salvation Army. She
wondered If they had signs posted at Sun City and/or Sunset Point locations. Mr. Sullivan stated that
he had signs at the access Into the shopping center at Sunset Point, and other sign at the back of the
shopping center, but only received 10 donations a week at that location. At the Sun City location, he
had no signs and has tremendous donations.
There were no persons present to speak either in opposition or support of this item.
After lengthy discussion concerning the location of the trailer, the conditions of approval were revised.
A motion was made by Mr. Mazur to approve the request subject to the following conditions: 1) The
requisite occupational license shall be obtained within six months from the date of this pUblic hearing;
2) there shall be no display or storage of trailersl merchandise on this property except as expressly
allowed under previous conditional use permits, and this conditional use permit; in particular, there shall
be no sidewalk sales; 3) the applicant shall meet all supplementary conditions for outdoor retail sales,
displays, and/or storage in accordance with Section 41.053 (23) of the City Land Development Code;
4) the applicant shall amend the certified site plan to reflect the proposed addition/changes within six
months of the date of this public hearing; 5) the proposed Goodwill trailer shall be managed by an
attendant with no Items to be stored outside the trailer; 6) the number of trailers at this facility shall

unnamed street an W, zoned IL (Limited Industrial). CU 96-32
Mr. Shuford gave the background of the application and presented, in writing, the staff
recommendations. He indicated that there Is a revised site plan In their packets which proposes the
use of the west side of the building Instead of the east, and he also explained that an associated
outdoor storage conditional use permit application will be before them June 13, 1995. Mr. Shuford
stated that Mr. Rehm was waiting on a determination of zoning issues In that area before he continued
with the conditional use permit.
A board member wanted to know why there are no suggested hours of operation listed in the
conditions. Mr. Shuford stated that there is not going to be any vehicle outdoor service, and as no one
came to object to the noise if that were to occur, there was not a reason to have hours listed.
Discussion regarding the site plan ensued. There Is no way to access a bus on the west side, but It
was brought to staft's attention that they are putting a loading door on the north side of the building,
so It would not interfere with the use of the railroad right-of-way.

Representative, James Bond, 109 S. Ft. Harrison, Clearwater, spoke regarding the site plan. He stated
the bus does access the north door, and the dimensions are 90 ft. long, and the width Is 25 ft., and
stated that there would be no way to got a bus to come in from the west, taking Into considerations
these dimensions. Mr. Bond stated that this is not for a new vehicle service at this location, but for
a relocation of an existing fleet maintenance area currently downtown. He concluded that he agrees
with all the conditions set forth by staff, except for the warding in condition #10. This building Is
12,000 sq. ft. of warehouse and 2,500 - 3,000 sq. ft. Is vehicle service. There are occasional trips
to pick up records, stage lighting, at this warehouse, but definitely no business going on there. He
would still like to access the east side of the warehouse for storage purposes.
Mr. Bond noted that the original application was for the east side of building, but after talking to staff,
Mr. Band changed the application to the west side.

Mr. Bond stated that this is a conditional use, and there is a trial period stated in the conditions. He
would like to eliminate the condition regarding curbing (#10). He statod they have leased this bunding
for eight years now and as far as he knows there have been no complaints from anyone. He stated
he will only be using this warehouse 2.3 times a week.
Ms. Nixon stated the 200 ft. radius does not really take into account the homes that would be
Impacted by the traffic traveling down Dempsey. Mr. Shuford stated that condition #10 could be
rewritten: "Vehicle access for the vehicle service operation to the property and parking lot shall be
limited to only Lakeviow Road with access to the property from Pamela Avenue and Dempsey Street
prohibited" .
The property owner, Gerald Rehm, 721 lakevlew Road, spoke. He stated that the east end of the
building still needs to be accessed, whether It be emergency vehicles or fire trucks. He stated that it
is not a residential street, there Is only one house. Mr. Rehm stated he does not want to give up a
curb cut on the east end of the building and would seek legal advice as to the City's ability to address
this matter.
The following are persons to speak in support of this application.
Robert Float, BOO Dempsey, was present. He stated that he sees people making trips to the
warehouse and sees no problem with this type of business, even adds to the security of the area.
Greg Rehm, 721 lakeview Road, stated the security factors are most important. He stated there is
drag racing on Dempsey and he has called the Pollee Department numerous times about this, illegal
dumping, and spray painting. He has noticed when there are late activities in connection with the
Sclentologlsts, that it has helped to keep down thase other activities In the area.
The following person spoke in opposition to this application.
Lois Cormier, 625 McLennan St., spake. She lives to the west of this area and stated she knows what
goes on at this property. She is very concerned about this business, and wanted to remind the board
members that noise travels. She likes the staff's conditions, especially the trial period, and hopes the
board keeps these conditions, but the preferred the previous staff recommendation of denial. She Is
concerned along with her neighbors about the industrial and commercial businesses extending into the
residential areas.
Next, Greg Rehm spoke in rebuttal. He stated he appreciates the noise issue that concerns Mrs.
Cormier. He stated that there is no noise due to vehicle repair. Mr. Mazur asked if, when testing
motors, the door could be closed. Mr. Rehm stated it could if there was adequate ventilation.
James Bond spoke In rebuttal. Mr. Bond stated that this residential area had to be far enough away
not to be Impacted by any noise, if there was any. He stated there are only five buses, and seven vans
. to be serviced. Mr. Mazur stated that if this was a commercial business open to the public, this board
would be purting a restriction on that business' hours of operation, and he would like to see them do
so with this request.
Mr. Baron briefly discussed the carbon monoxide problem with having the doors closed, what entails
In the regular maintenance for these buses, and concluded that he would like to also see a condition
regarding hours of operation. Mr. Bond stated that late night hours would be for emergency type
problems only, would not be on a regular basis.
Mr. Blckerstaffe stated he would like it kept commercial, the trial period should be left in and if there
are any problems In that time span, they will be back in front of the board and will get turned down.
Mr. Keyes stated he would like to eliminate the curbing aspect and use it for parking, and keep the
access on Lakeview.
A motion was made by Mr. Keyes to approve the request subject to the following conditions, amending

general public; no more than one bus or other similar large vehicle shall be serviced or stored on the
property at anyone time: 3) there shall be no outdoor service or storage, and no inoperable vehicles
shall bo atored on the site for any longer than 24 hours; no doors shall bo open during any vehicle
service operation between 7 p.m. and 8 a.m. and all doors shall be insulated: 4) the applicant shall
meet all supplementary conditions for vehicle service uses as provided in Section 41 .053(30) of the
City land Development Code; 5) the site shall meet all Sanitation Division requirements, and the
applicant shall maintain the property In a litter-free condition: 6) all parts, tires and other materials used
In the conduct of the business shall be stored indoors; 7) the applicant shall provide an appropriate
dumpster to handle the disposal of trash: this dumpster shall be located according to Sanitation
Division standards and screened within 30 days from the date of this public hearing; 8) all required
parking shall be provided or a variance obtained from the Development Code Adjustment Board; 9)
required open space shall be provided or a variance obtained from the Development Code Adjustment
Board; 10) Vehicle access for the vehicle service operation and to the property and the parking lot shall
be limited only to Lakevlew Road with access to the property from Pomelo Avenue and Dempsey
Street prohibited; 11) approval shall be for a ~ month trial period (from the date of Issuance of an
occupational license) at the end of which the application shall be re-evaluated for compliance with code
enforcement; 12) the parking lot shall be striped consistent with specifications provided by the City
code and subject to the final approval of the City Traffic Engineer; and 13) there shall be no body work
between tho hours of 10 p.m. and 6 a.m.

31-36, 44-46, 51. and part of Lot 52. zoned CG (General Commercial). CU 94-47
Mr. Shuford, gave the background of the application and presented, in writing, the staff
recommendations.
Mr. Shuford stated that a letter and petition was sent in after the staff reports have gone out and
presentation boards from neighbors in the area for the board members to look at. He stated staff
hadn't had a chance to share these with the applicant before this meeting, and suggested this item
be continued to next board meeting.
Owner and lawyer for Kapok, Pamela Kerls, 923 McMullen Booth Rd., was present. She stated she
had code enforcement come with a noise meter, and couldn't even get it to register outside. Mrs.
Keris stated they have chosen to close Kapok on weekends for banquets and it Is going to be used
exclusively for a retail establishment. It will not be open to the public starting October 1, 1995. She
will use it 6 - 10 times a year for charity type functions, and stated she would like them to approve
the liquor license, so they can continue to have charity functions there.

The following are persons present to speak in opposition.
'Sharon O'Flannery, 3200 San Bernadino, who presently is the vice president of the Delara Groves
Association. She had a list of concerns regarding the Kapok Pavilion, such as noiso, not enough
parking for activities they have, rodents, and changing plans constantly as to what their plans are for
the property. Mrs. O'Flannery stated she does not like them having a liquor license, and suggested
that they give them another trial period of six months and review again their plans for the pavilion.
J.B. Johnson, 3237 San Bernadino Street. He stated that the two main problems are with the parking

and noise Issues. Mr. Johnson would like the board to continue this and have a 6 month trial basis.
Linda Vollo, 3119 San Bernadino. She is a Del Oro Gardens resident. She brought to their attention
the petition and the presentation boards Mr. Shuford spoke about earlier. She stated she dIdn't know
about the changes that were being proposed at the Kapok Pavilion until now. She Is concerned about
the constant change in the management, the loud music, the inadequate parking, and that seem
unwllling to communicate with the neighbors about these problems. The neighborhood has had to call
pollee frequently about the noise. In conclusion, they would like the board to grant a continuance of
the permit they have now, until they define themselves as a specific business and be reviewed at a
later time, as to it's negative impact on the neighboring area.
Pamela Keris, spoke in rebuttal. Management, nor ownership has changed. They bought it to preserve
the Clearwater landmark. but they have to make it economically feasible to keep it open to the public.
Again she stated that starting October 31 st, the entire 89,000 SQ. ft. will operate as a retail
establishment. Mrs. Keris stated she is there for the conditional use permit for the liquor license to be
used for the special events throughout the year. She stated that these homes were built 2ftgr Kapok
was established, and Kapok was originally built by Mr. Baumgardner, who was a member of a band
and wanted to have an on-going faCility for them to play and made it to accommodate musicians.
A motion was made by Mr. Keyes to continue this request to June 27, 1995. The motion was duly
seconded and carried unanimously.
Mr. Shuford left the meeting at this point, and was replaced by Sandra Glatthorn, Central Permitting
Manager (3:55).

Ms. Glatthorn gave the background of the application and presented, in writing, the staff
recommendations. During the four month trial period, there was one complaint concerning trash, and
later was found to be untrue. Staff did report several sign violations on the property, which were
reported to the Community Response Team, and due to this, staff Is asking for another four month trial
period. The applicant is requesting for additional hours of operation: 11 pm Closing time on weekdays,
and 12 am on weekends.
Applicant, Jamel Khameel, 1048 N. Ft. Harrison Avenue, stated he kept his promises and did what he
was told at the last meeting. He stated it Is very different from the previous ownership, it is clean and
much improved: the health department to'd him it has never been this clean before. He is working 7
days a week and working very hard. Regarding the sign violations, he stated he didn't know about
them until the notice came, but has taken the signs down today.
There were no persons present to speak in favor or in opposition to this request.
A motion was made by Mr. Biclcerstaffe to approvo the request subject to the following conditions:
1) Landscaping which has been provided In accordance with Section 42.27 shall continue to be
continuously maintained; 2t the hours of operation shall be limited to weekdays, 8:00 a.m. to 11 :00
p.m., and weekends, 8:00 to 12:00 p.m.; and 3) there shall be an additional trial period of four months
from the data of this meeting to determine compliance with the sign code violations and what impact

was a semi-truck blocking his access. His property has a chain link fence around it. Ingress/egress
is on the east side and he does not know who it belongs to, and stated Florida Power easement is also
on the east side.

with a revision to #4:

The expansion of this business and the parking spaces required were discussed.
Applicant representative, Mr. Timothy Johnson, 911 Chestnut Street. Enclosing a carport and using
it as a storage area is their request. This Is a family operated business for 16 years. There have been
no complaints from surrounding area, to their knowledge. A parking variance Is needed from
Development Code Adjustment Board. Mr. Johnson stated the conditions are acceptable as stated by
staff.
A motion was made by Mr. Carassss to approve the request subject to the following conditions: 1)
Applicant shall obtain a variance of three parking spaces or otherwise meet parking requirements; 2)
the requisite building permit shall be obtained prior to the start of construction but no later than six
months from the date of this public hearing; and 3) the perimeter landscaping requirements of See
42.27 shall be provided to the extent possible given site conditions. The motion was duly seconded
