Comments have been received with regurd to the proposed Storlllwiller Ordinrlllc.e.lIowevcr, II revised druflllas
not been completed. A revised drnft will be presented to the EAC for review on December 9, 1993 meeting.
Mr. Miller indicated that the ordinance will address not only the storm water system, but also surface waters of
Clearwater. Penalties for non.complinncc were also discusscd. Mr. Hunt requested that if l\ drllft is available
for the ~ovember 4, 1993 meeling, to present it Dt thut lime.

A meeting is scheduled for October 14, 1993 for nllthe purticipanls. The members were presented with a draft
copy of The Alligator Creek lnterlocal Agreement for review. At the October meeting the tangunge will be
finalized. Mr. Miller informed the committee of the funding problem for the implemenlation of the project.
Some of the other concerns of surrounding municipalities were 1Ilso presented. Mr'. MilJer stated he would
welcome any suggestions EAC may Imvc regarding funding and il11plt:lllenting the project Mr. Hunt stated that
EAC had endorsed expediting: proceeding with lhe plan illdepelldently from olher municipalities 'financial
participation. The,re was fmtller discussion on the cost ill1plemcntlllion. The isslle presently is an environmental

REVlEW EAC MEMBERS RECOMMENDATION UESPONSES

The Chairmun made referdnce to the EAC Assesslllent Form, which was 11111ilcd to members, and discussed the
,purpose for the questionnairc~ He stated that he had documented what the EAC had done, llnd his concerns,
were what the EAC should have don~, or could do next ycnr. The synopsis of these questionnaires will be
presented to, the Commission after all comments have been received from the commillee members. Mr. Hunt
presented a handout on Alternative EAC Procedural Candidates. A discussion followed. Some suggestions were
reviewed. For' example, a task leader, U aile person committee, i.e. a person who will volulltarily to do n
particular job with EAC's uuthority. Mr. HUllt reviewed the projeCls on the lisl he presented, and talked about
the reason for including these projects. The members present ugreed thut the commillee seems to be addressing
dead issues. whereas tbey should move onto areas thut havc not been previously addressed. The members stated
that there is no need to expound on ddails 011 some issues, and prescnted NPDES as an example since the EAC
has no control over it nor ~ny input. A brief updute would be sufficient.
The members present exprcssed their individual opinions 011 the task leader position, and agreed that this might
hasten the reviewing of issucs if prcsented wilh all Ihe ualn, providing ccrtllin guidelines tlrt adhered to. Ms.
Garris recommended thnlthe EAC ncccplthe premisc of task lcnder nnd see how it works out being careful that
guideline's are' followed. ,
Mr. Hunt stated that he will presentlhe synopsis of the comments buck to the meeting at the next session. At
this time Mr. Miller notified the committee thul the EAC is on the agendn for November I, 1993 Cor its annual
review~ Ms. Garris offered to be a volunteer to presentlhe validity of the BAC to the commissioners. Question

'Mr. Dnvis slaled he believes the commillee has slraycd from ils mission. He believes the commission wants to
hear the cilizen's concerns, and wishes EAC to rillcl' through that and present the issues to them. Some of the
differences between the Environmental Advisory C0l11111iUee and other Doards were reviewed, and Mr. Davis
presented some oC the tasks/projects he believes the EAC should be involved in. '

A disc\ISsioll was held by the members in allendance and their response to issues presented at the meeting.
Ms. Sharpc stated she believes it would be uufortunate for the City of Clearwater and the environment if the
EAC was disbanded. Mr.. Melkoninn stated she was pleased that the City of Clenrwnter had the foresight to
establish'the committee. Ulltilthe purpose of the committee is changed, the EAC should nct as an advisory
board by giving pros and COliS; staying within orgallizations procedures, and gelling involved with new concerns.
She believes the commission should be encouraged to keep the EAC, and assist in making the committee
stronger. The Chairman stat~d that onc oC the main' problcms is that the EAC is n,oL notificd of new
projects/issues iil a Limely fashion. Mr. Hunt reviewed thc main three functions of the EAC. Mr. Miller's input
was also requested.

Garris declined the nomintltion. Mr. Davis slated he wonld ,be wilting to serve, with limitations. he would be
unable to altend al\ commission meclings as suggested earlier.

A. REQUEST FOR PROVISION OF SANITARY SEWEns
Mr. Miller presented a handout received on October 4. 1993, a Resolution from the Pinellas County Commission
requiring thal the City lo hook up nil the septic lllllks in the County mens without nnnexation, Mr. Miller stated
thnt Clcnrwnler's Ordinance stntes in order to do that there hns to be n lettcr from the Pincllns County Health
to resolvc lhe problem indicating a severe hellllh III oblem. Much of Allen;s Creek problem has been causcd by
the nUlrient load from the sepue tanks into the creck. Discussions hnve been held on how to rcsolve lhe
fillllncilll burdcn to the public for the hookup, which is II significant amount. The issue here is whether
Clearwater should allow silllilalion hookups without llnnexation. Qucstion ,wa5 raised who would be required
to carry the largest IOjld portion of the expense. The members ngrecd they did not lmow enough abollt the is~;ue
to express opinion at this timc.

. Mr. Davis informed the EAC member thatlle presented u,proposal on the Buy Grant befo~e tbe Tampa Bay
Estuary Program. He has'proposed to NEP that they llse his boat as a focal point in their program, to develop
n, dock side educational program. . Mr. Da',is proceeded to give a brief outline of, the progmlD, and the grant
package. The program is being modeled aCter the Hudson River Reclamation Park Program in New York.
Mr. Miller informed the members that a letter has been scntto ,Pillellas County notifying them that Clcnrwatc~
would like to participate in the Mapte Swamp Reslorntion Watershed Munagemcnl Project in the area of
Lnkeview and Hercules. This project was' , '

A COMPREHENSIVE WATERSHED MANAGEMENT PLAN

THIS AGREEMENT is made and entered into this day of
, 1993, by and between the Southwest Florida Water Management
District, a public corporation created by Chapter 61-691, ,Laws of
Florida, as amended for itself and on behalf of the Pinel las-
An~lote River Basin Board, herein~fter collectively referred to as
the "DISTRICT," and Pinellas County, hereinafter referred to as the
"COUNTY," and the City of Clearwater, hereinafter referred to as
"CLEARWATER," and Safety Harbor, hereinafter referred to as "SAFETY
HARBOR," political subdivisions of the State of Florida.
WIT N ESE T H :
WHEREAS, the Alligator Creek Comprehensive. Watershed
Management Plan study area, hereinafter referred to as the "STUDY
AREA II , encompasses approximately 5700 acres in central Pinellas
County as outlined on attached Exhibit HA," attached hereto and
incorporated herein by reference; and
WHEREAS, the DISTRICT, through the SWIM Department, has
determined that basins in Pinellas County are critical pollutant
sources to Tampa Bay; and
WHEREAS, the COUNTY, CLZARWAr!'ER, and SAFETY HARBOR have
requested the DISTRICT'S assistance in the development and
implementation of a Watershed Management Master Plan, hereinafter
referred to as the "MANAGEMENT PLAN, II to the extent of jointly
funding an engineering study of the Alligator Creek watershed,
preparation of MANAGEMENT PLAN and documenta, and implementation of
some or all recommendationsr hereinafter referred to as the
npROJECT(S)," as a result of the study; and
WHEREAS, the DISTRICT, through the cooperative funding program
of the Pinellas-Anclote Basin Boardr has agreed to participate on
a 50/50 cost share basis with local governments on selected
projects consistent with the priorities of the Basin Board and the
DISTRICT; and , '
WHEREAS, the DISTRICT through the.Pinellas-Anclote Basin Board
has budgeted funds in its 1993 Fiscal Year budget for this purpose:'

WHEREAS, the parties hereto have reached an agreement to
solicit and engage the professional services of an engineering
consultant firm, hereinafter: referred to as the "CONSULTANT,lf to
d~velop the MANAGEMENT PLAN and perform the implementation phase
including, but not limited to, design, permitting, and,construction
services for one to three of the MANAGEMENT PLAN recommendations.
The parties are in agreement that CLEARWATER shall administer 'the
CONSULTANT contract. The COUNTY, CLEARWATER, and SAFETY HARBOR
shall engage the services of a construction firm, her~inafter
referred to as the "CONTRACTOR, II to construct the PROJEC'l'(S) as
designed by the CONSULTANT in each of their respective
jurisdictions if it is agreed to by all Parties that construction
of any of the recommended PROJECT(S) is appropriate.
NOW THEREFORE, in consideration of the ~mutual covenants and
conditions contained herein, the parties hereto agree as follows:

ARTICLE I - Scope of Work
1. The MANAGEMENT PLAN is intended to evaluate .the Alligator
creek Watershed in order to identify problems requ1r1ng
management of resources affecting water quantity and quality, ,
and na~ural habitat. At a minimum, the MANAGEMENT PLAN shall
address existing flood situations, erosion, and stormwater
pollution. The MANAGEMENT PLAN shall include, but not be
limited to, items to be further described in a Scope of Work
that, will be developed and approved by all parties and shall
address wherever possible the COUNTY, CLEARWATER, and SAFETY
HARBOR Comprehensive Plans' Goals, attached 'as Exhibit "A."

The Planning Phase will include the initial collection of
design and water quality data, the diagnostic evaluation
of the Alligator Creek Watershed, the usage of an
appropriate' linked watershed/waterbody model that is
approved by the COUNTY, CLEARWATER, SAFETY HARBOR, and
the DISTRICT, a comprehensive watershed management plan,
and recommendations for~ ~site specific physical
improvements including public property availability
and/or property acquisition information. At the end of
the Planning Phase there will be an "ASSESSMENT MEETING"

The COUNTY, CLEARWATER, SAFETY HARBOR, and the DISTR~CT shall
jointly prepare the Request for Proposal (RFP) and Scope of
Work for the services to be performed by the CONSULTANT. The
Scope of l'lork will specifically detail the design
considerations to be followed in the development of the
MANAGEMENT PLAN. Both the RFP and the final Scope of Work
shall be subject to written approval by the DISTRICT.

of the parties to the Agreement at the close of which a
decision will be made on whether the MANAGEMENT PLAN
should proceed into the Implementation Phase.
b. If at the close of the ASSESSMENT MEETING there is
unanimous agreement to continue with the Implementation
Phase of the 11ANAGEMENT PLAN, the Implementation Phase
will commence and will include the design and permitting
of the top three (3) prioritized PROJECT(S) recommended
in the Planning Phase of the MANAGEMENT PLAN, and the bid
advertisement, award, and construction of one (1) or more
of the top three (3) prioritized PROJECT(S).
c. If at the close of the ASSESSMENT MEETING there is
unanimous agreement not to continue with the
Implementation Phase of the MANAGEMENT PLAN, this
Agreement will be terminated in writing.
3. The PROJECT(S) shall be prioritized based primarily upon the
potential effectiveness of reducing pollutant loads and
flooding conditions over the entire STUDY AREA, and
secondarily, on the potential for increasing natural'habitat,
and the availability of pUblic-owned property on which to
construct the improvements. The MANAGEMENT PLAN shall clearly
state the 'priority issues and scope of Work shall direct the
CONSULTANT ~o develop a method to prioritize the PROJECT(S).
The prioritization process and results shall be presented at
the ASSESSMENT MEETING by the CONSULTANT. All parties shall
provide written approval or disapproval of the top three (3)
prioritized PROJECT(S) to CLEARWATER within two (2) weeks of
the ASSESSMENT MEETING.
4. It is acknowledged by the parties hereto that the COUNTY,
CLEARWATER, arid SAFETY HARBOR shall be solely responsible for,
the implementation of the prioritized PROJECT (S) of the
MANAGEMENT PLAN within their respective jurisdictions. prior
to the implementation of the prioritized PROJECT(S) of the
MANAGEMENT PLAN, the COUNTY, CLEARWATER, and SAFETY HARBOR"
shall submit an implementation schedule to the DISTRICT for
review and written approval, showing scheduled completion
dates of the prioritized PROJECT(S) in their respective
jurisdictional area that can be completed within a three (3)
year period based on each participant's stormwater revenue
projections and construction cost estimates from the Planning
Phase of the MANAGEMENT PLAN.
5. The COUNTY, CLEARWATER, and SAFETY HARBOR agree to use similar
and consistent criteria (design standards and construction
specifications) for purposes of developing the features of the
MANAGEMENT PLAN within their jurisdictions.
6. It is the intent of this Agreement to develop a comprehensive

watershed management plan which is mutually acceptablo to all
jurisdictions within ,the watershed and the DISTRICT. I~ is
further intended that each jurisdiction will adopt the
MANAGEMENT PLAN and' use it to guide their deci.sions in the
basin.
7. CLEARWATER shall be responsible for engaging the services of
the CONSULTANT to perform the tasks required to complete the
MANAGEMENT PLAN. The DISTRICT, COUNTY, CLEARWATER, and SAFETY
HARBOR shall have one voting seat on the committee to selent
the CONSULTANT. The final selection of the CONSULTANT shall
be subject to the DISTRICT's written approval.
9. CLEARWATER shall administer, manage and supervise the
development of the MANAGEMENT PLAN resulting from the RFP.
Proper performance of all work undertaken pursuant to this
Agreement is ultimately the responsibility of CLEARWATER.
10. The DISTRICT'S performance under this Agreement is conditioned
upon the development and approval of the detailed Scope of
Work, the development of the Request for Proposal, and the
engagement of a CON~ULTANT. If for any reason a CONSULTAN'r is'
not under contract within one hundred eighty (180) calcnd~r
days subsequent to the completion and execution of this
Agreement, this Agreement shall be null and void and the
DISTRICT shall have no further obligations thereunder.

11. All CONsuvrANT (s) I CONTRACTOR (s), subcontractors and suppl iers
are under contract to the COUNTY, CLEARWATER, or SAFETY HARBOR
and not to the DISTRICT; all compensation and payments to them
shall be' the responsibility of the COUNTY, CLEARWATER, or
SAFETY HARBOR and not the responsibility af the DISTRICT.
12. CLEARWATER shall require the CONSULTAN'r to provide to a
proposed Project Budget to all parties. The proposed Project
Budget shall consist of a detailed cost itemization by task
with manhaurs, hourly rates, and project personnel based upon
the approved Scope of Work. The proposed Project Budget shall
be reviewed and approved in writing by the DISTRICT prior to
ratification of the consultant contract by the COUNTY,
CLEARWATER, and SAFETY HARBOR. Any revisions or updates to
the Project Budget shall be reviewed and approved in writing
by the DISTRICT Project Representative prior to disbursement
of DISTRICT funds.

17.' The DISTRICT, COUWry, and SAFETY HARBOR shall be provided
thirty (30) calendar days to review and comment on all drafts
and final reports; and CLEARWATER shall provide to each the
DISTRICT, COUNTY, and SAFETY HARBOR upon completion of all
work products, one (1) copy of all reports, maps, modelling on
computer disk, and ~eproducibles of the construction plans,
and other documents prepared and paid for with any and all

18. If it is agreed to by all Parties that construction of one or
more of the recommended PROJECT (S) is appropriate, ,then,
during the process of design of the PROJECT(S) by the
CONSULTANT, CLEARWATER shall coordinate with the DISTRICT,
COUNTY, and SAFETY HARBOR during all phases of the PROJECT(S)
design and permi tting ~ The COUNTY, DISTRICT, and SAFETY
HARBOR shall review and approve, in writing, the design at the
30%, 60%, 90%, and 100% design stages.
19. The DISTRICT, COUNTY, and SAFETY HARBOR shall, upon request,
,assist CLEARl'1ATER in the acquisition of available information,
data and reports including but not limited to as-builts,
drainage maps, design reports, maintenance records,
topographic surveys, utility surveys, and rights-of-way
surveys considered pertinent to the Planning and
Implementation phases of the MANAGEMENT PLAN. U~e of all-
available information and ongoing studies that may assist the
CONSULTANT in the development of the MANAGEMENT PLAN shall be
maximized.
20. The COUNTY, CLEARWATER, and/or SAFETY HARBOR shall act as
applicant on all applicable construction permits, in their
respective jurisdictional areas and be responsible for
applicable fees, if any. Any county/city building, site
clearing,' work in right-of-way, or other county/city issued
permit will be the responsibility of COUNTY, CLEARWATER, or
SAFETY HARBOR as appropriate.
21. The PROJECT(S) will not fulfill current or future regulatory
requirements placed upon the COUNTY, CLEARWATER, or SAFETY
HARBOR for construction permits or to remedy an environmental
violation nor. will it be submitted for mitigation credit to
any state regulatory/jurisdictional agency. It may be used to
demonstrate reduction of non-point source pollution for
Federal ~rograms.
22. The COUNTY, CLEARWATER, and/or SAFETY HARBOR shall perpetually
perform the necessary exterior maintenance of the PROJECT(S)
in their respective jurisdictional areas and the, hydraulic
operation and maintenance of the PROJECT(S) improvements in
their respective jurisdictional areas. The standards and
criteria contained in the Basis of Review adopted by Reference
in Rule 400-4.091(1), Florida Administrative Code, (F.A.C.),
apply to the design, performance, operation~ maintenance and
monitoring to provide reasonable assurances of the proposed
stormwater management system required in Rule 400-4.301(1).
The COUNTY, CLEARWATER, or SAFETY HARBOR, as appropriate, will
be identified as the entity responsible for all operation,
maintenance, and monitoring requirements. Operation and

maintenance activities shall include, but not be limited to
~uch activities as: Removal of undesirable plant types or
exotics by a process that will not harm desirable plants,
cleaning of bleed-down filters, if any, and' cleaning of
sediment traps, if any. Monitoring activities will be
identified as a specific condition on the DISTRICT permit and
will identify a minimum period required to establish
successful wetland plantings survivorship.
23. The COUNTY, CLEARWATER, and SAFETY HARBOR shall perform all
necessary construction management on the PROJECT(S) in their
respective jurisdictional areas,. including but not limited to
. construction survey, inspection, bidding and supervision, as
follows: the COUNTY, CLEARWATER, and SAFETY HARBOR will
conduct the construction bidding process with DISTRICT
participation and construction supervision will be performed
with DISTRICT participation. The contract between the COUNTY,
CLEARWATER, or SAFETY HARBOR and the awarded bidder shall
provide for a performance payment, and guarantee bond and
comprehensive liability insurance naming both the DISTRICT,
COUNTY, CLEARWATER, and SAFETY HARBOR as insured parties. To
ensure the awarded bidder agrees to these requirements, the
COUNTY, CLEARWATER, and SAFETY HARBOR shall include these
requirements in their respective bidding specifications.
24. This Agreement shall be effective on the last date of signing
by the parties involved. proj ect costs incurred by the
COUNTY, CLEARWATER, and SAFETY HARBOR prior to the effective
date of this Agreement are not reimbursable by the DISTRICT.
ARTICLE II - Funding
13. The DISTRICT shall fund fifty percent (50%) of the MANAGEMENT
PLAN development and PROJECT(S) implementation costs up to a
total amount not to exceed six hundred thousand dollars
($600,000) . Cost sharing by the COUNTY, CLEARWATER, and
SAFETY HARBOR under this Agreement shall be on the basis of
contributory drainage areal as follows: COUNTY, nineteen and
two tenths per cent, (19.2%), not to exceed $230,400i
CLEARWATER, twenty eight and one half per cent(28.5%), not to
exceed $342,000i SAFETY HARBOR, two and three tenths per cent
(2.3%) I not to exceed $27,600. The Total Project Budget shall
not exceed One Million Two Hundred Thousand Dollars
($1,200, 000) . The total proj ect Budget shall include, an
amount not to exceed Five Hundred Thqusand Dollars ($500,000)
for the Planning Phase and an amount not to exceed Seven
Hundred Thousand Dollars ($700,000) for the Implementation
Phase. If property acquisition is required to implement the
PROJECT(S), and acquisition is ag~eed upon by all the parties,
the cost of property acquisition may be included as part of
the total cost to be shared between all parties according to
the aforementioned percentage. In the event that total

project costs exceed One Million Two Hundred Thousand Dollars
($1,200,000), the DISTRICT, the COUNTY, CLEARWATER, and SAFETY
,HARBOR, by mutual agreement, may provide additional funding or
reduce the Planning Phase or the Implementatio~ Phase,
CONSULTANT Scope of Work, and/or STUDY AREA. Any funding by
the DISTRICT is contingent upon funds being budgeted for
commencement or continuation of the MANAGEMENT PLAN by the
DISTRICT's Governing Board and pinellas-Anclote Basin Board.
Any funding by the COUNTY, CLEARWATER, and SAFETY HARBOR is
contingent upon funds being budgeted by their respective
governing bodies.
14. CLEARWATER shall submit invoices and back--up documentation
monthly ,along with a progress report to the DISTRICT with
written substantiation that the invoices are accurate and in
accordance with terms of this Agreement ~ All progress reports
accompanying invoices shall describe the work accomplished to
date and indicate the percentage, of work completed. The
DISTRICT' shall reimburse CLEARWATER for a total of fifty
percent (50%) of the amount of the invoice less retainage that
have been submitted to CLEARWATER by the CONSULTANT provided
CLEARWATER certifies it is consistent with the Project Budget,
and it is determined to be in order for payment by the
DISTRICT. Upon receipt of proper invoices as described, the
DISTRICT shall, within thirty (30) calendar days, remit
payment to CLEARWATER up to the total amount allocated by the
DISTRICT for each task in the Project Budget. The DISTRICT
shall be provided with duplicate CONSULTAN'l~ invoices and
progress reports for review at the same time they are
submitted to CLEARWATER. within sixty (60) calendar days from
the receipt of each properly documented invoice from
CLEARWATER, each of the CITIES shall forward payment to
CLEARWATER for the agreed percentage of the total invoice
amount minus retainage.
15. It is understood by the parties that the COUNTY, CLEARWATER,
and SAFETY HARBOR are responsible for the appropriate
expenditure of the funds provided to it by the DISTRICT and
shall only expend such funds pursuant to the terms and
conditions of this Agreement and shall not utilize such funds
for any other purpose. It is also understood by CLEARWATER
that all equipment and non-expended supplies purchased with
funds provided by the DISTRICT shall be the prop-erty of the
DISTRICT and shall be returned to the DISTRICT at the
termination of this Agreement.
If the COUNTY, CLEARWATER, and SAFETY HARBOR do not complete
the construction' of the PROJECT(S) within the specified
timeframe, the COUNTY, CLEARWATER, and SAFETY HARBOR shall
reimburse the DISTRICT for the full amount paid to each of the
parties in excess of what money has been paid out by the
COUNTY, CLEARWATER, and SAFETY HARBOR. It is mutually agreed

that the above time frames for the commencement and completion
of the final design and construction may be extended for valid
cause if mutually agreed, in writing, by all parties.
ARTICLE III - proiect Representative

16. The COUNTY, CLEARWATER, SAFETY HARBOR, and the DISTRICT shall
each designate.a single Project Representative who will serve
as a liaison between the DISTRICT, COUNTY, CLEARWATER, and
SAFETY HARBOR on all Project related matters for the purpose
of maintaining coordination and review of the MANAGEMENT ~LAN
during the Planning and Implementation Phases. Each
Representative shall be notified of, and attend all project
meetings which will be, at a minimum, held monthly to review
the administration of ,this Agreement for the duration of the
Project, to review and comment on interim reports, drafts,
maps and other documents, and to make site visits, and attend
public information meetings. The Project Representative will
be . responsible for transmitting instructions, receiving
information, and interpreting and communicating DISTRICT,
COUNTY, CLEARWATER, and SAFETY HARBOR policies and decisions
relating to the ,MANAGEMENT PLAN and PROJECT(S). All
correspondence or inquiries relating to the MANAGEMENT PLAN
and PROJECT (S) ~hall be directed' to the attention of the
Project Representatives. Phone logs shall be kept by
CLEARWATER Project Representative and distributed to all
Project Representatives as a record of MANAGEMENT PLAN and,
PROJECT(S) status.
ARTICLE IV - Terminatio~
25. It is understood by the parties hereto that the DISTRICT may
terminate this Agreement in whole, or in part, after giving
ten (10) working days prior written notice to the COUNTY,
CLEARWATER, and SAFETY HARBOR if at any time the DISTRICT
determines, at its, sole discretion, CLEARWATER and/or its
consultant, contractors, suppliers, or the are not performing
in accordance with the terms and/or conditions of this
Agreement.
26. If. stich a termination of the Agreement occurs, the DISTRICT
shall pay to CLEARWATER all properly documented fee~ and costs
for services performed in accordance with this Agreement prior
to the date of termination.
27. To the extent allowed by law, the COUNTY, CLEARWATER, and
SAFETY HARBOR shall defend, indemnify and hold harmless the
DISTRICT, .its Govern'ing BOard, officers, employees and agents,
from and against any and a~l actions, causes, claims"demands,
judgments, payments, recoveries and suits of any kind, arising

out of or occurring as a result of any act or omission of

ARTICLE VI - Insurance

30. Prior to issuance of a Notice to Proceed, COUNTY, CLEARWATER,
and SAFETY HARBOR shall submit a letter to the DISTRICT with
the following points included:
A'. The COUNTY, CLEARWATER, and SAFETY HARBOR are a political
subdivision of the state of Florida. As such., it is
entitled, to the limits of liability contained i~ Section
768.28 and Chapter 284, Part II, Florida statutes.
The COUNTY, CLEARWATER, and SAFETY HARBOR shall maintain
in force worker's compensation benefits in accordance
with florida Statutes for the duration of the Agreement.

The COUNTY, CLEARWATER, and SAFETY HARBOR shall provide
the DISTRICT the same defense of suits and payment of
claims as afforded the COUNTY, CLEARWATER, and'SAFETY
HARBOR that arise out of and in the course of this
Agreement as permitted by law.

'The COUNTY, CLEARWATER, and SAFETY HARBOR will provide a
letter to the DISTRICT evidencing self insurance
according to Florida Statute 768.28.
E. The DISTRICT shall receive thirty days prior written
notice from the COUNTY" CLEARWATER, or SAFETY HARBOR of
any change or cancellation of any of the required
coverages including the liability coverage.
D.
ARTICLE VII - Duration/Period of Performance
28. By participation in this Agreement, the DISTRICT, COUNTY,
CLEARWATER, and SAFETY HARBOR assume the responsibility for
the completion of the MANAGEMENT PLAN and PROJECT(S) as
approved by all Parties and funded by this Agreement. The
parties agree that time is of the essence, and the parties
shall use their, best efforts to complete the MANAGEMENT PLAN
within twenty four (24) months after the execution of this
Agreement, and to complete the PROJ:ECT (S) within three, (3),
years subsequent to the completion of the Planning Phase and
the acceptance of the MANAGEMENT PLAN. This Agreement shall
expire on unless it is' completed or terminated earlier
or specifically extended in writing.

'approximately three Sand Dunes. Me. Baker has informed me Uiat the best way to handle'the
Dunes is to' request a permit for removal; The permit would indicate the costly effect of
. 'continual ~emoval of sand from Pier 60 parking,. South Beach parking and North Beach Palm
. l'avilion parking.. The permit would also indicate that Ule Dunes would be replaced on higher
ground, 'Y~~re Ule, would not cause Ule extended maintenance problem. The replacement of
, tile Dunes would mitigate Ule removal.

Tho Public Works Deportment has for some time been concerned with the problem of the
removal of wind~blown slJnd from the parking lots and other public facilities al Clearwater
Beach. After each storm, as well as when normal wind-driven sand accumulates, vve must
gather and remove sand from public facilities at the beach. In the Spring of 1990 we
dredged 4,000 cubic yards of sand which had accumulated in the Clearwater Harbor cove
adjacent to Coronado Drive (where the pirate ship docks). We believe that certain sand
dunes along the beach adjacent to our facilities are significant contributors to this consta'nt
maintenance problem. It is our desire and intention, with youfperroission of course, to
properly seek a permit for the removal of these dunes.
It is our Environmental of rice's assessment that the uso of the property maintenance
consideration is the best strategy for obtaining the necessary permits for the removal of
the dunes. We believe that we can tuke the palm trees and sea onts out, remove or
spread the sand on the beach, and replace the trees and oats in their exact previous
configuration. It mayor may not be a permit requirement that the dun'es be mitigated by
re-establishing a like number in a'location less sensitive to sand accumulatioil impacts.
Our Environmental office would apply to the Florida Department of Environmental
Protection for the permits on the basis of the dunes' interference with the maintenance of
public facilities, and our Infrastructllre crews would accomplish the work. I believe we can
'handle this in-house and within our existing budgets. We do not beliove that the existence
'of the dunes in this particular circurnstollce has been a major contributor to the accretion
of the b<?8Ch, nor would their removal have a negative effect on the beach's stability.
The dune clusters aro in threo locutions - those located approximately midway between the
Adams Mark Hotel and the South Bouch Pavilion, im!11ediately adjacent to our parking lot;
those located approximately opposite the swimming pool ond parking facilities immediately
south of the Holiday Inn Surrside; and those located adjacent to our north parking lot near
the Rockaway Pier.

Would you please conduct a study on all land in the City of Clearwater that is considered. to be
environmentally sensitive, that has yet to be developed. List that land in order of priority of '
sensitivity to the environment, as well as potential pending future developments.
Look at land that is necessary for the storm water runoff treatment program that is underway,
as well as land that is critlcal to the cleaning of our waters through mangrove growth
opportunity. Look at land lhat is loaded with rare species of trees.
Also, bring forward a list of all funds available for the acquisition of this land that has been set
aside by various non-profit agencies throughout the country J like that brought forward in the
debate on the ZOM development. Also, any agencies thnt the Pederal and State government that
provide funds for purchases of the same type of land.
I would suggest that you use county, state and federal agencies and non-profit agencies
throughout the land to help cooperate in this project. so as to bo able to accomplish it in the
shortest amount of time, with the least amount of tie-up of City staff time. 1 would assume that
this would take more than 8 hours to accomplish and therefore, the 8 hour rule must be invoked,
and therefore ,must be put before the City Commission for approval.
This Commissioner does not want to face another ZOM development, without f1rst 'having all
of the knowledge and aU of the facts wellln advance of what properties are endangered
throughout our City, and then be put into a corner where he has no choice but to, ~ote for the
development. If this property had been cited prior to the developer bringing it forward,and it
had been designated as such, the City could have had better and stronger ordinances on
environmentally sensitive laud. We should look at having ordinances on environmentally
sensitive land. as well as general ordinances. Thank you.

Dear Commissioner Deegan,
I don't know how Abdon Pallash arrived at the title of' his August
14,' 1993 Tampa Tribune article II Panel Urges Clearwater to Buy,
Pres~rve Site'!. This is what I'd call editorializing the news.
Abdon.did not attend either of the' EAC meetings and for the record,
Mike, Fol ey and I did not spearhead the effort 'to buy the 1 and as
a preserve. Brian Morris brought the issue to the committee at the
regular EAC meeting in July, 1993. At the special 'meeting on July
13th Brian made the motion:
"Since the EAq'was not aware of the proposed deveiopment on this
property until the July 8, 1993 meeting, at this time the committee
moves to 'ask the Clearwater City Commission to r~view,this site and
look' at it as a unique environmental area that is of value to the
citizens of Clearwater and consider purchasing the site .for
conservation use." I made the friendly' ame'ndment to strike the word'
preservation, and replace it with the word "conservation".
Primarily, the EAC as a whole was concerned that the members were
. never asked to review the use of this coastline .property on Tampa
"'Bay. .Mike Foley reminded the members th~t the EAC Bylaws of July
19, 1990 state that "duties of the committee include: ,
Recommendations' to purchase properties for preservation of unique
ecosystems".

The subject o'f the preservation of trees, mentioned in the Tribune
article, was not a major part of the EAC discussion since the
developer's plan exceeds the tree code requirements.
Clearw'ater has bought vacant lots and commercial properties to
build parking lots 0:: other public facilities. Certainly, the
purchase'of land for stormwater retention and growth management
considerations should be as important to the commissioners.
One of my major concerns, expressed to the EAC, but not in this
Tribune article, is that the cost of providing government .services
for the residents of this ne\oI development may exceed the tax'
revenue generated by the condominium complex.

.If "the Environmen~al Advisory Committee accomplished nothing.more
than educatin~ ten citizens~ each year, on the diversity and difficulty
of environmental issues in Clearwater,' it would be worthwhile.
"Unfortunately. we are oiowing new ground in an area whic~ has been sadly
neglected in Clearwater for too lonq. It's like being attacked by bees
and not knowinq which to slap first. I think we're making progress.
Althouqh we haven"t accomplished what we hoped. We have at 'least
made a beginninq. Certainly the Environmental Advisory Committee must
. continue iri some form. To say that recreati6n, beautification and
marine affairs ne~d citizen inout:and not the environment is to i~nore
the multiple environm~ntal problems facinq Clearwater, All of these
advisory boards have dealt with controversial issues in their time.
It's not surprising that we have done so.
I feel that we should have less debate and more decisions. We
should be creative in brinqinq the orqanizations and.citizens of our
community into the battle to save. our environment, rather than
recommendinq more tasks for the already overworked staff. Is it the
Sunshine Law which prevents us working as a committee to do some
environmental education as a qroup?
I, personally, have learned a lot and appreciated working with
creative and'carinq people to do what we can to protect our
environment.

I'm sor~y that I was the only member of our committee present,
.Thursday~ at ~he City Commission meeting to hear attorney Tim Johnson'
express his riqhteous indiqnation that his client had been "expelled"
from our meetlnq. The Mayor was so busy assuring 'himthat we had been
properly disciolined." .the Commission so anxious to hear from the
people of Seville after keeping them so late at night, that the,whole
issue of whether or not the City should purchase the property was never
,discussed,
Of course we should not have asked the developer and his
.' representative to leave a "nubl icU meetina. However, 'in the emotion of
.the moment,. havina iust been'told we'd be sued i'f.we tried to 'stop the
, developm~nt and not understandinq what that meant, it is not surprisinq
that none of us remembered this fact,' Al thouqh stated in a' hesi tant
:voi6e, there is no question but what it was intimidatinq to be toid we
would be sued. Only a lawyer can tell us whether this was ~ form of
hara~sment or not.
There are times when the moral imper~tjve is more imoortant than
the leqalitv of an issue. Our recommendation to the City Commission
~as, I believe, morallv'rioht and we should have hud the courage td
pursue it. Instead of ~ritin9 to chastise us for our'leqal snaffu(if
that's what it 1s), the Commission should; in5tead~ send the City
Attornev to advise us what we can leqally do to petition our qovernment
to purchase this bi~ of environmentally important land in our city,
At any rate, I offer, for your consolation~ if that's all we are,
to have, the words of ~resident Theodore Roosevelt:

who points out how the stronq man stumbled~ or
where the Doer"of Deeds could have done better,
The credit belonqs to the man who is actually in
the arena; whose face is marred bv dust and
