The meeting was called to order at 4:05 P.M. by the Vice Chairman, Mr. Foley, in Conference Room B of th~
City Hall Annex on, May 13, 1993. ' ,
, An issue was raised by Ms. Garris, regarding Ms. Lanza's representation of the EAC position on the Dunedin
Pass issue, and questioned whether or not she had been appointed to do so. Discussion of this question was
deferred to next the meeting, Ms. Garris slated she was not aware that the EAC voted against opening oC
Dunedin P,ass, and was informed by the Vice.Chnirman that the position of the committee was that there was
no compelling environmental rationale for pursuing the reopening of the pass.
I. ROUTINE AGENDA
A. REVIEW MINUTES FOR APPROVAL
Correction to minutcs, Ms. Melkonian wished to, be recorded as making the motion to adjourn at the April
meetipg. Mr. Miller corrccted date on page two, first paragraph last line to read I'.....to the Commission May
17, 1993." There were no further corrections, a motion was made by Ms. Melkonian to approve the minutes us
corrected, seconded by Ms, Garris. The motion passed unanimously.
B. CONFIRM AGENDA
Due to the facl thallhe majority of members on the EAC arc new appointees, Mr. Foley requested SWFWMD
to present inCormation aD Watershed Management and on the geographic information system. This would give
the members a bettcr understanding of issues to be discussed.
It was dctermined that Mr. Miller would present an update on Stevenson Creek .aL Lhe time he presents the
. NPDES update.

A brief presentation was given by Mr. Foley on his review of the City Comprehensive Plan. He made reference
to his,comments thut were forwarded to ull commillee members with the previous minutes. Mr. Foley stated
that the Comprehensive Plan lists various city planning categories, and the two reviewed by him were Drainage
and Conservation. A brief discussion foHowed ubo\lt the goals, objcctives and policies of the plan, and the
difficultics encountered in attempting to accomplish the goals by the specified date., Beside watershed
management, there is the maintenance nnd enhancement of wildlife and native vegetation to'be considered. Mr.
Foley expressed his concerns in having the EAC understand the main purpose of the comprehensive plan prior
to presenting recommendations to' the' commission.

Mr. MiJlcr gave a brief description of some of the llctivities the city is involved with such as planting of native
vegetution, ditch cleaning, etc. He stated that more ultcntion needs to be bJ(vcn to public information on native.
, plants. T~ Mr. Miller's knowledge there is no progrum to manage conservation areas. ,However, there is an
ordinance that prohibits intrusion of aquatic, interior or coustalland. If construction is scheduled in these areas,
Environmental will be informed. Some of the Environmental objectives of the Comprehensive Plan, as presented
by Mr. Foley were reviewed and disclIssed.

B.
N1JDES UPDATE
For new member's information, the Ell A hus u permitting requirement called the National Pollution Dischllrgc
Elimination System, (NPDES).' Mr. Miller stated thnt Part I of the permit was submitted on April 15, by
Pincllas County on Clearwater's behalf; and PurtH is in the process of being prepared. The members attention
was directed to mute rial received with last minutes, wherein was enclosed n draft of a model ordinance for the
prevention of pollutants to the storm Water system being reviewed by City. Mr, Miller rc'quested the EAC to
review the ordinunce and also consider the issue, who would enforce the ordinance, and how would Clearwater
administer. this program. A handout, wriUen by Pinellas County on Joint Control of Pollutants within Pinellas
, County; A brief discussion regarding this draft followed. Mr. Miller discussed the information requirements for
the Part II of the permit which is to be submitted by May 17) 1993, ant.! that EPA has given an extension to
September 1993 for the management plan.
, C. STEVENSON CREEK
Mr. Miller presented a summary of the revisions of Stevenson Creek, Phase II Design. He stated thalthe City
Manager, CDM, nnd Public Works have completed reviewing the redesign, and have decided Lo stop the project
at Jeffords and Hillcrest, and go along with Alternative II. Mr. Miller discussed the issues that will be presented
to the City Commission, reviewing the three alternativcs that are to be presented, and gave brief descriptions
of the ellch lIlternulive. The presentation beforc the Commission has been scheduled for June 15 to obtain final
approval.
Mr. Miller notified the committee thaI un AgendllItem hus been prepared for tllc June 3 Commission meeting
to prcsenllhe Mid Pinelllls Wlltershed Comprehensive Plan) and requested EAC to consider any further motions
for possible presentation at that meeting.

D. SWFWMD PUESENTATION ON WATEI~SHED MANAGEMENT ANI> GIS COMPUTER
APIJLlCATION
Mr. Wirth of Southwest Florida Water Managtlmcllt Districl wns prescnted 'to give an overview of the Mid
Pincllas Watershcd Management Plan, which will eCfecllhc co\;rol11l\cnl grcatly. Thc Cily hm; been exploring
thc possibility of purchasing the GIS Computer, which is a gruphic informalion system to identify pieces oC a
walershed which win aid in the Watershed Managemenl ph\1\ning.
Mr. Miller introduced Rand Baldwin, an Intcr~governmenl Coordinutor for SWFWMD, who has worked closely
. on' the Mid Pinellas cost funding submittal. In turn Mr. Baldwin introduced Mr. Druce Wirth, Dircctor oC
Resource Project Section. Mr. Wirth gave a brief description of watershed and what is involved. Watershed
Management has two different entities, consisting of the SWFWMD Governing Bourd, lInd the Anclotc River
Basin Board. Details were'given regarding the responsibilities of each board nnd a description on the millage
split between thc Governing Board and the Anclote River Basin Doard. SWFWMO has adopted surface watcr
criteria which needs to be met by new construction; however; SWFWMD docs not have jurisdiction over land
use, Mr. Wirth presented some details on what will be required by SWFWMD to outain wnter quality. In order
to identify troubled areas, a detailed comprehensive date collection is required of the syslem. A determination
needs to be made as to where pollution is coming from und what is expected oC the project before any funding
would be released for contract. Mr. Miller updated EAC members on Ihe status of the InterlocaJ Agreement
between SWFWMD and the Mid Pinellas Group and severnl issues were llrcsenteu by SWFWMD thut needs
to be met before finalization of agreement. Mr. Wirth stated thllt the llPpendices will give morc deluil as to what
needs to be accomplished in regard to water qualily and habital considcrulions. 'It may tuke two or lhree years
to obtain a plan, which may not be implemented until severn I years later. Mr. Wirth staled thut olher cities do
not have as much commitment to waleI' quality as is being sought with the present wlltershed management plan.
The pr!mary issues of the plan me to address water quality lInd get it buck 10 where it should be.
Mr. Steve Dicks was introduced to discuss the Geographic Information System, (GIS). Mr. Dieks is the Manager
of the mapping section Cor the district for SWFWMD working on the GIS Information system for 6 years. GIS
is a computerized data base that allows for efficient sloring, retrieving and manipulating data that arc put on
mups. CompUlcr Aid Design (CAD) system uSlld by engineers include dntn which arc drawings, but not
mapping. This is useful for engineering work. GIS tics together, not only the duta, but also the mup parts and
allows for manipulntion of data entered, Mr. Dicks went into del nil how the system works, and explained what
is involved. The map part is a series of points that cun be wells, traffic lights, manhole covers, arcs or lines,
rouds, power lines, etc. Polygons arc used to represent pal'cel boundaries, wetland bounduries, etc. Mr. Dicks
gave a presentation on how these lines are identified to u table. Informalion is readily uvniluble ubout an area
that is casily Oooded. He presented un example how groups IIrC put together, indicating how all the datn of GIS
arc associated LO a common coordinates of e~\rth surfaces, so tlmt thcy 1\11 overlay. The ll\yers can be mixed or
maLched. Key features are maps, datu describing thc.i maps ulld ullthe maps lire ull tied together. Various
~~pplications were discussed. He explained the different pnckugcs nvnilublt; that can be used for this system, and
whaLtype of information is included in various packages. Cost varieli on the information presented in packages.
A brief presentation was given on data exehunge. Mr. Wirth presented 1111 the vmiolls issues to consider in
obtaining ~I GIS. The City oC Cleurwater docs nul uwn software fur GIS presently, purchusing has been
postponed. The county docs have a COlIsideruble IImollnl of dnlllthllt Clearwater could IIse. All of Clearwater's
work hus been on CAD, works well ut drawings, but nUlnlnllrihllte dlllll. After CAD there is ARC CAD, which
is an enhanced CAD, the ARC INFO, und IIwlI lhe Gcnvisillll. Mr. MiJler slIlhal thut the County hus offered

Mr. Miller notified Ms. Lanza Ihatthe City's goal is not to duplicate any existing efforts that fire out there, and
the City will not go out to restudy Aliens Creek. For all purposes AlIens Creek Study and complete and very
,comprehensive. Referencing to Alligator Creck, studies arc currently ongoing, and there is no intent of
duplication. Mr. Miller stated that Cleiuwater ,viii be the administrator of all lhe paper work on the Mid
Pinellas W~tershed Management.Plan.
, Mr. Miller informed the member's that the cost share contribution to the Watershed Management Plan by the
County 'and City of Clearwater are still being discussed, and presented the funding and participation issues that
were invol~ed,with the Watershe.d Management Plan. He also cxplain~d NPDES involvement in this plan.' Mr.
Miller informed the EAC that all the counties around Tampa Bay are participating thru the Estuary J;'rogram
trying to improve water quality, and contributing to the NEP Program financially.

Mr. Foley questioned when the City will readdress water reuse. This to be discusscd at the next mecting. Ms.
Garris made a motion that the City proceed with the Mid Pinellas Watershed Management Plan and spend up
to 1.3 million, regardless of other municipalities'linnnciul participation, thereby continuing our leadership role
'in this environmental effort. Motion was seconded by Jill Mclkonian. A discussion followed. A vote was taken,

Dependent on the stormwater management plan are Objectlves16.4, 16.6 and 17.1

wIthout contractual agreement by SWFVVMD? What Is the legal authority?

Each of the above ObjectIves contain PolicIes that have passed their dates. The.
Implementation of a stot'mwater managemenl plan program may be more difficult than
previously thought by the Comprehensive Plan writers.

· Increase' Environmental Group staff in watershed management department to achieve
the stated goals as soon as possible.
· Hire a consultant firm to begin a watershed marmgement plan as soon as possible as
per the RFP dated May 28, ,1991. '
· Require Environmental Group to begin n watershed management program ASAP In
whatever form is possible with current slaff and under current condltlons.
· It Is the responsibility of SWFWMD and Pinellas County to prepare and Implement
watershed management plans. The ctty should request SWFWMD and/or Plnellas
County to prepare a watershed management plan for the city.
· If the City can show that there Is a best eHort being made to achieve the stated goals

having functional hydrological characteristics by May 1990.

· Prepare a floodplain ordinance which wlll, protect the floodplain Including
requirements that will preve~t new construction in the 25 year floodplain and require

· 'Require enforcement of County ordinance 83-21, Floodplain Man'agement,whlch

per the RFP dated May 28, 1991.

· It Is the respollslblllly of SWFWMO and Pinellas County to prepare and Implement
watershed management plans. The city should reque5t SWFWMD and/or Plnellas
County to prepare a watershed management plan for the city.

· Prepare a floodplain ordinance which will 'proted the floodplain including
requirements that will prevent new construction In the 25 year floodplain and require

width of the stream or 50 feet (whichever is greater) or some greater requirement.
· Require enforcement of County ordinance 83-21, Floodplain Management, which
affects entire County. '
· Require the adoption of a flood damage ordinance similar to County ordinance 77-12
which serves to minimize public and private loss do to flood conditions, and protects
natural floodplains and protecltve barriers.
22.3 Objective- Maintain and enhance wildlife and native vegetation by May 1990.
What Is being done to satisfy this Objective? Tile Clly is actively removing Brazilian
pepper. When pepper Is removed is native vegetation being planted?
The EAC may desire 10 consIder these recolllmenqatlons:
· Train dllch crews in the propagation and protection of some beneficial native plants
especially In aquatic areas, roadsides and parks where normal weeding ~ctlvltles
occur. This may also help reduce weeding and sprayIng requirements In the future.

WHEREAS, the federal Clean Water Act (33 U.S.C. 1251 et seg.),
as implemented by regulations of the u.S. Environmental Protection
Agency adopted November, 16, 1990 (40 CFR Part 122), make necessary

the adoption of local ordinance provisions relating to the
Stormw~ter System; and
WHEREAS, the City is seeking to comply with all provisions of
WHEREAS, the City Commission of the City of Clearwater,
federal and state law; and
Florida, is empowered to manage, operate, and control a separate
storm sewer system; and to regulate connection to such separate
storm sewer system pursuant to its home rule powers and pursuant
,to the Federal Water Pollution Control Act, also known as the Clean
Water Act, as amended, ,33 U. s. C. 1251, et seg ("the Act"); and
WHEREAS, the City of Clearwater Code of Ordinances, Chapter
32, Utilities, provides that the City shall have the power to
construct and maintain major drainage systems.
WHEREAS, the City Commission hereby finds and determines that
the regulations adoptedby'this Ordinance are the least restrictive
means necessary to achiGve the aforementioned goals and promote and

Clearwater, Florida; and

WHE~EAS, this Ordinance pertains to the regulation of water of
the City and the 'regulation of any activity tending to,pollute the
surface waters of the City; and
WHEREAS, compliance, with the Ordinance does not eliminate the
responsibility of co'mplying with' other applicable EPA, DER, or
Southwest Florida Water Management District (SWFWMD) regulations.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE

SECTION 1.
INTENT.
This Ordinance is adopted by the City of Clearwater for the
purpose of maintaining efficient, economic and safe operation of
the Separate Storm Sewers, and'for the protection of the health,
safety, and general welfare of the public within all of the City of,
Clearwater.
This Ordinance is intended to prevent and abate
pollution through the regulation and control of connections and
discharges to the City of Clearwater Separate Storm System and to
limit the use of the City of Clearwater Separate Storm Sewer System
to the collection, conveyance,treatment" and disposal of
Stormwater through appropriate regulation and enforcement. The
prohibitive discharge standards contained herein were developed
under the authority of Section 5 of the Act and 40 CFR 122,
applicable DER, SWFWMD regulations ,and applicable home rule power.
SECTION 2. DEFINITIONS.
The following definitions shall apply' to the provisions of

(b) Director - the Director of the Public Works Department of
the City of Clearwater, Florida or an Authorized Official.
(c) Discharqe- any direct or indirect entry of any solid,
liquid or gaseous matter.
(d) Illicit discharqe - means any discharge to a municipal
separate storm sewer that' is not composed entirely of storm water
except discharges pursuant to a NPDES permit (other than the NPDES
permit for discharges from the municipal separate storm sewer) and
discharges resulting from fire fighting activities.
(e)

,collecting, storing, and transporting Stormwater owned by the City
of Clearwater but not including any fpcilities intended to be,used
in accordance with applicable law for collecting' and 'transporting
sanitary or other wastewater.

SECTION 3.
INDUSTRIAL ACTIVITY.
(a)
General Prohibitions - Any Discharge into the' Stormwater
System in violation ~f' any federal, state, water management
district, county, municipal or other law, rule, regu lation or
permit is prohibited.
(b) Specific Prohibitions By adoption of industrial
activity stormwater regulations or by issuance of industrial
activity stormwater permits, or both" the Director may impose
reasonable limitations as to the quality of Stormwater (including
"
without limitation the designation of maximum levels of pollutants)

discharged into, the Stormwater System from, Sites of Industrial
Activity.
Any' promulgation of such regulations and issuance of
permits by the Director shall be in accordance with applicable law.
,( c) Administrative Orders - The Director may issue an order
to any Person to immediately cease any Discharge determined by'the
Dire~tor to be in violation of any provisions of this ordinance, or
in violation of any regulation or permit issued hereunder. ,
(d) NPDES Permits - Any Person ",ho holds a National Pollutant
Discharge Elimination System (NPDES) permit shall provide a copy of
, ,
such permit to .the Director no later than the, later of: 60
calendar days after the effective date of this ordinance or sixty,
60 calendar days after issuance.
SECTION 4. ILLICIT DISCHARGES.
(a) General Prohibiti~ - Except as set forth under Section
4 (c) of this ordinance or as in accordance with a valid NPDES
permit, any Discharge to the Stormwater System that is not'composed

that it is n?t properly managed or otherwise is not acceptable, the
following Disch~rges are exempt from the general prohibition set
forth under Section 4 (a) of this ordinance: flows from fire
fighting, water line flushing and other contributions from potable

This prohibition is retroactive and applies to
connections, made in the past; regardless of whether made under a
permit, or other authorization, ,or whether permissible under laws
or prac'tices, applicable or prevailing at the time the connection
was made.

indirectly responsible for such Discharge, then such Person shall
also take immediate action to ensure the containment and clean up
of such Discharge and shall confirm such telephone notification in
writing to the Director at P.O. Box 47481 Clearwaterl Florida
34618-4748, within three calendar days.
(d) , Administrative Order - The Director may issue an order to
any Person to immediately ,cease any Discharge, or connection to the,

SECTION 6. INSPECTIONS AND MONITORING.
(a) Authori tv for Inspections - Whenever necessary to make an

inspection to enforce any of the provisions of this ordinance, or
regulation or permit issued hereunder, or whenever an Authorized
Official' has reasonable cause to believe there exists any condi~ion
constituting a violation of any of the provisions of this
ordinanc~, or regulation or permit issued hereunder, any Authorized
Official may enter any property, building or facility at any

area-wide inspections shall be based upon such reasonable selection

Industrial Activity) to undertake such reasonable monitoring of any
Discharge ( s) to the Storrnwater System and to furnish periodic
reports '. '
SECTION 7. PENALTIE~.
Failure to comply with the requirements of this Ordinance or
any Permit or approval granted or authorized hereunder shall
consti tute' a violati.on of this Ordinance.
Violations of the
provisions of this Ordinance shall upon conviction be punished by

provisions of. Section 1.12, City of Clearwater Code of Ordinances.
If a violation should continue, each day'of such' a violation shall
constitute a separate offense.
SECTION 8. CIVIL REMEDIES.,

In addition ,to, the penalties provided in Section '7, the City
Commission of the City, of Clearwater is hereby 'author'ized to
institute any appropriate action or'proceeding, including suit for
injunctive relief, in order to prevent or abate violations of this
Ordina~ce. ' The City Commission of the City of Clearwater is also
authorized to' impose and recover a civil penalty for each violation
of this Ordinance in an amount not more than Five Thousand Dollars
($5,000) for each offense.
,SECTION 9. SEVERABILITY.
If any provision of this Ordinance or the application thereof
to any ,person or circumstance is held ,invalid, it is the intent of
the City Commission of the City of Clearwater that the invalidity'
shall not affect other provisions or applications of the Ordinance
which can be given effect, without, the invalid provision, or
application, and' to this end the provisions of this Ordinance are
dec~ared severable.

public corporation created by Chapter 61-691, Laws of Florida, as
amended for itself and on behalf of the Pinellas-Anclote Basin

the participants of the Mid,Pinellas Group, consisting of Pinellas
County and the Citi.es of Clearwater, Dunedin, Largo, Safety Harbor
and the Town of Belleair, political subdivisions of the State of

WHEREAS, the GROUP has requested the DISTRICT'S assistance in
;the deyelopmentof a, comprehensive watershed management plan;
hereinafter referred to as the "MANAGEMENT PLAN, II to the extent of
jointly funding engineering consultant services for said MANAGEMENT

County have entered into an agreement to develop

1. An engineering consultant firm shall be engaged to develop a
comprehensive MANAGEMENT PLAN for the ,watersheds including a
'detailed plan for implementation. The I~AGEMENT PLAN is
intended to evaluate the watershed' in order to identify
problems requiring management of resources affecting water
quantity and natural habitat. At a minimum the MANAGEMENT
PLAN shall address existing flood situations, erosion and
stormwater pollution. The ~mNAGEMENT PLAN shall include, but
not be limited to those items as further described in Exhibit
II B", and shall address the individual GROUP participant 's
Comprehensive Plan Goals, attached ,as Exhibit' "C", wherever
possible.
2. The GROYP shall, in coordination with DISTRICT staff, prepare
the Request for Proposal (RFP) and Scope of Work for the
services to pe performed by the CONSUTLANT. This Scope of
Work will specifically detail the design considerations to be
followed in the development of,theMANAGMENT PLAN.
3. The City of Clearwater shall have the lead responsibility for
solicitation of the consultant. The DISTRICT, and each member
of the GROUP shall maintain one voting seat, (1) on the
committee to select the CONSULTANT.

The City of Clearwater shall administer, manage and supervise
all contracts'resulting from the RFP. Proper performance of
all work undertaken pursuant to the consultant contract is
ultimately the responsibility of the City of Clearwater.
5. The c6nsultant(s) chosen shall provide to the GROUP and the
DISTRICT a Proposed Pro ject Budget. lJ.'he Proposed Project
Budget shall consist of a detailed cost itemization by task
based upon the Scope of Work. IJ.lhe Proposed Project Budget
shall be reviewed and approved in writing by DISTRICT staff
prior to final ratification of the consultant contract by the
GROUP. Any revisions or updates to the Project Budget or the
Scope of Work must be approved in writing by the GROUP and the
DISTRIc'r.

The DisTRICT shall fund fifty percent (50%) of ~he study costs
up to a total amount not to exceed one million, three hundred
thousand dollars ($1,300,000). DISTRICT payments to the City
of Clearwater shall be for a total of fifty percent (50%) of
the amount of the invoices that have been submitted to the
City of Clearwater by the engineering consultant firm
perfonning the study. Disburseme,nts by the DISTRIc'r will be
made within sixty (60) days after receipt of quarterly
invoices from the City of Clearwater provided th~t,the amount
i.nvoiced is commensurate, with the work perfonned. The
DISTRICT shall be provided with duplicate consultant invoices
and progress reports on the same time schedule they are
submitted to the City of Clearwater. It is the intent of,this
agreement that the participants share the cost of the
MANAGEMENT' PI)AN in direct proportion to their respective
contributory drainage areas as delineated in Appendix "A".

properly documented invoice from the City of Clearwater, each
of the GROUP participants shall each forward payment to the
City of Clearwater for the agreed portion of the total invoice
amount. The Total Project.shall not exceed two million six

All consultants, subcontractors and suppliers are under
contract to the Ci ty of Clearwater and no't to the DISTRICT;
all compensation and payments to, them shall be the
responsibility of the City of Clearwater and not the
resp~nsibility of the DISTRICT.
, The participants of the GROUP and the DISTRICT, shall designate
a single Project Manager who, will serve as a liaison for'the
purpose of maintaining coordination for developmen.t and review
of the MANAGEMENT PLAN. Each Representative shall be notified
of, and attend all project and status review meetings, which
will be held monthly to review the administration, of this
Agreement for the' duration of the project, to review and
commen't on interim reports, drafts I maps and other document,s,.
and to make site visits, and, attend public information
meetings. The Project Nanagers will be responsible fOl:
transmitting instructions, receiving information, and
interpreting and'comunicating DISTRICT and GROUP policies and
decisions relating to the MANAGEMENT PLAN. All correspondence
or inquiries relating to the MANAGEMENT PLAN shall be directed
, to the attention of the Project Managers.

The DISTRICT and GROUP shall be provided one (1) month to
review and comment on all drafts and final reports; and the
City of Clearwater shall provide to the DISTRICT, upon
completion of all studies, five (5) copies of all reports,
'maps, and other documents prepared and paid for with any and
all funds contributed by the DISTRICT in connection with the
MANAGEHENT PLAN.,

11. The DISTRICT ~nd GROUP shall, upon request, assist the City of
Clearwater in the acquisition of all available information,
d~ta and reports considered pertinent to the studies. Use of
all'available information and ongoing studies ,that may assist
in the devalopmen~ of the MANAGEMENT PLAN shall'be maximized.
12. ThLs Agreement shall be effective on the last date of signing
by the parties involved. Project costs incurred by the GROUP
prior to,th~ effective date of this Agreement are not funded
by the DISTRICT.
, 13. This Agreement embodies the entire Agreement and u'nderstanding
between the parties and is subject to change, alteration and
modification only upon the written Agreement of the GROUP and
the DISTRICT.
14. 'It is understood by the parties that the City of Clearwater is
responsible for' the appropriate expenditure of' the funds
provided to it by the DISTRICT, and shall only expend such
funds pursuant to,the terms and conditions of this Agreement
and sh~ll not utilize such funds for any other purpose.
,15. It is understood by the parties hereto that the DISTRICT may
terminate this Agreement, after giving thi~ty .( 30) working
days prior written notice.to the City of Clearwater~ if at any
time the DISTRicT, at its sole. discretion, the City of
Clearwater and/or its consultant, contractors, suppliers are
not performing'in accordance with the terms and/or conditions
of. thi.s Agreement.
16. If such a tennination of the Agreement occurs, the
participants shall pay to the City of Clearwater all properly
documented fees and costs for se'rvices performed in accordance
with this Agreement prior to the date of termination.
17 . All studies, shall be completed and all final reports submitted
within three (3) years of the execution date of this Agreement
unless all parties specifically agree to extend the date 6f
completion in writing.
18. ,It is ~cknowledged by the parties hereto that each participant
of the GROUP shall be solely responsible for the
implementation of the MANAGEMENT PLAN within their
jurisdiction. Upon completion of the study, the GROUP shall
submit an' implementation schedule to the DISTRICT for review
and approval, showing scheduled co~pletion dates of a
prioritized group of projects that can be completed within a
five (5) year, peFiod based on each GROUP participant' s I,
,stormwater revenue projections and construction cost estimates
from the MANAGEMENT PLAN. '

DACKGROUND
Chapter' 40 CFR Part 122 requires, t:he protection of surface
,waters in' part through the development of stormwater management
plans. State Water Policy, Chapter 17-40, F.A.C. has established as
the goal of surface water management programs to protect, preserve
and restore the quality" quantity, and environmental values of
';later resources through programs that include effective stormwater
management for existing and new systems, vhich shall seek to
protect, maintain and rest6re the functions of natural systems and
the beneficial uses of waters.
,Pinellas' County's Comprehensive Growth Management Plan,also
includes this ~irective but adds significant' detail to the
direction through 9ther- policies and goals making these management
plans very comprehensive and holistic in nature and extending the
planning area to the uplands within 'the watershed (AppeI'1;dix C.1).

The City of Clearwater Comprehensive Growth Management Plan
reaffirms these directives (Appendix, C. 2) as does that of the
Cities of Dunedin (Ap'pendix 'C.3), Largo (Appendix C.4), Safety
Harbor (Appendix C.5), and the Town of Bellealr (Appendix C.G).
OBJECTIVES
The objective of this project is to apply an integrated
resource management approach to the water quality/quantity problems
,throughout the mid Pinellas watersheds in a cooperative effort in
order to determine the most' appropr~ate structural and non-
structural solutions to problems, with emphasis placed on non-
structural solutions.

Watershed' basins to be studied include those of Stevenson,
Curlew, Alligator,. Mullet, Bishop, Briar, Allen's and Belleair
Creeks three Coastal basins and Clearwater Beach Island. I],'he

although, Allen's Creek and Alligator' Creek. are indentified as

model, in Public Domain, for included watersheds to evaluate
various proposed activities in terms of potential impacts on water

strategies (structural, non-structural, BMP's, source controls,
etc.) in terms of their potential' for wa ter quality improvement and
stormwater management.
'rhe project is to develop a comprehensive watershed based
management plan, encompassing uplands, wetlands" surface waters,
subsurface waters; and management by public ag~ncies, public poJ,icy
and public law. The ,watershed management plan is to be prepared in
such ,a 'manner ,as to aid the GROUP in meeting the Goals and
Objectives of th~ir respective Comprehensive Growth Management,
.Plansr and in meeting the requirements of Chapter 17-40, FAC, and
of 40CFR Part 122. The MANAGEMENT,' PLhN will provide
recommendations for site specific physical improvements as well as
policy improvements, such as the establishment of specific
man~gement practices and stricter regulations, and implementation
priorities. . The MANAGEHENT' PLAN will' develop . a
beneficial/reasonable use level of service and a method to
de'termine project benefit costs,.
The MANAGEMENT PLAN will also include a review of mitigation
banking and a long 'range funding' plan for improvements for the
wa tershed. ,
,'The MANAGEMENT PLAN will maintain and enhance the current
balance of living resources through the inclusion of upland buffers
adjacent to, wetlands, options to preserve or restore native upland
and wetland vege ta ti ve communi ties and habi ta ts , and to remove
ecologically undesirable vegetation.
The PLAN will also' include recommendations for ongoing
monitoring to deJl10nstrate improvements to water quality, and'
ecological conditions brought. about as a result of recommended
projects, programs, ordinances, and policies. .

Thc City of Clearwater Commission has established a Public Citizcns Group, known as the Environmental Advisory
Committce (EAC), to advise Stnff and Ihe Commission on environmental programs for thc City of Clearwater. The
CommiUee ,was established to proactively assist in early formulation strategies and alternatives to accomplish watcr
quality projects and to advise on the best means to respond to new regulatory reqiliremcnts for monitoring and
enforcing pollution violations within Clearwater, To dalc, one topic that has predominated Committee deliberations
hus been comprehcnsive watershed planning.
Since the majority of the Committee arc reccIlt Commission appointees, Mr, Mike Foley, Vice Chairman of the '
Clearwater EAC has requested that the next meeting be set !lside to provide new members with tho opportunity to gain
a bclter understanding of watershed management nnd geogrnphic information system issues. He has outlined to me
an agenda for ,the next meeling and questions that he would like addressed before the full committee (See Attaehcd).
I would appreciate it if thc Southwest Plorida Water !vlanagcOlcnt District's would consider this request and provide
appropriate represcntalion 10 assist them in their discus~i()n of Watershed Management and Geographic Information
System issues lit Ihe subject meeting. Please keep in mind that of particular interesl to this Committee has been our
continuillgcrforts 10 obtain funding from the Pinellas-AncJolc Basin Board for the Mid-Pinellas Comprehensive
