The meeting was called to order a14:05 P.M. by the Chairman, Mr. Hunt, in Conference Ro~'m B. in the City
Hall Annex on October 7, 1992.

The Chairman informed the members that nominations for officers should bc done at present meeting, Witb
elections at next plonths meeting. The EAC members were also notified that a new committee member, Mr.
Dale Greene, has been selected to replace Mr. Bill Perry.. Acknowledgement was madeof Mr. Jonson's
resignation.

Mr. Miller expressed to the members that Watershed Management Planning is not only a very complex
lopic, but also an cvolving issuc, and attcmpted lo rclay some of the undercurrent problems betwcen
the biological and water qliality community. He also discussed the most appropriate ways to deal with
the issues. Mr. Miller staled that there is not a simple format to follow, nor a specific approach, only
'that the ultimatc goal is to improve walcr' quality and watcr resources throughout the County. He
stressed that all adjacent cities cooperation is required, in a joint venture, to help solve watcr quality
problems. '

Mr. Miller introduced Ms. Finch who prescnted to the committee IIn overview of where the City of
Clearwater is presently, relative to some of the ordinances controlling witter quality isslles. Ms. Finch
, attempted to present some of the complex Water Qnality issues.
A diagram Summary 01' Basin Watershed Problems, with indicators depicting specific concerns within
basins, was displayed. Ms. Finch, with the use of a legend on the diagram, (Attachment A) discussed
the major concerns, i.e., ordimmcc. controls, water quality as it is present\y perceived, and whether there
arc adequate BMP's (Best Managemcnt Practir.es). She also, discussed what stormwatcr pond designs
can best be used for treatment and practices to prevent pollution frOI11 ~ntcring thc storm system.
Ms. Finch reported that the City's present On.1inanccs arc insufficient to keep pollutants Ollt oC storm
water systems and surface water bodies. Thc public can only be directed and informed, but there is no
authority for enforcement.
Prcsent monitoring at Stevenson, Alligator and Aliens Creek basins verifies that Water Quality in these
systems is poor, An Ambient Waler Quality Monitoring Program has been re-instituted to assist in
obtllining pollutant levels from approximately 30 sampling sites. Ms. Finch proceeded to expound on
the requiremtmts for stormwater treatment ponds and their importance in maintaining water quality.
There arc no rules in effec'tto require homeowners or developers to correct older stormwater ponds
that do not functioning properly. There arc rules regarding erosion control, however insufficient staCf
to monitor llnd enforce. A discussion ensucd about the Ticketing Ordinance.
Thci members were informed that the present permitting process does n'ot allow the City to adequately
review industrial facilities that discharge into our Sanitary or Storm Systems. Inquirics were mude on
the possibility of other ordinances that could be used for enforcement of pretreated disch'arge to the
Sanitary System. Ms. Finch explained how Largo's pretreatment permit process works. A discussion
ensued ubollt monitoring Clearwater Ha.:bor and Clearwater Beach.
Mr. Miller thunked Ms. Finch for her presentation, then proceeded to review stafrs current Watershed
'Planning Efforts. He prescnted several charts on Watershed Management and Slormwater Utility
Funds. A lengthy presentation was made on the issues in Attachment B. Mr. Miller stated that it was
the philosophy of Environmental Management that pollution in streams comes from land usage more
than activities within streams; therefore concerns are primarily focllsed on about what can be' done to
improve ordinances and source controls. Several charts were presented referencing Stormwatcr Utility
Funds. Revenue, Distribution and'Watershed Managements Expenditures. (Blthru B6 Charls attached)
Mr. Miner discussed the different interpretation of \.bc inten\. of Stale waler policy and federal
stormwater legislation between the City Clearwater and Pinellus County. He also explained how the
NPDES portion was separate from the overall Comprehensiv~ Watershed Mflster PIau for Clearwater,
and the efCecl the county's participalion has on these efforts. Members were also informed that a
decision was made notLO pursue the Comprehensive Watershed Plan for Clearwater. All that is now
being developed is the NPDES, with emphasis on Allen's Creek. The EPA needs to be convinced that
the procedure al Allen's Creek is lhe best approach to correct water quality problems. Until then, there
is no plan by the Counly LO pursue altepuation ami water quality treatment in other basins at the present
time. That issue was discussed in more detnil.
Reference was made to the NPDES Subcommittee Illeetingst chaired by the county, and where all City.
County unl! 0.0,1'. members meet and discuss the NPDES activities; Members were notified that the
City oC Clearwater is represented al these meetings.

Mr. Miller proc~cded to present a breakdown of thc expendilures from the Stormwater Utility Fund,
and presented t;harts with figures. The committee members were informed lhut a different type of
monitoring system wiII be required, and therefore will decrease some of King Engilll~cring contractual
services. .
. AddHionnl discussion was held on the City of Clearwater obtaining effective ordinhnces. Mr. Jonson
suggested proposing to the City Cornmissioll that the City adopt the county ordinance so the city and
. county can be consistent. Mr. Foley interjected Ihattherc lire various ways of enforcing violations thru
other agencies, such as HRS and state rules thru DER. Mr. Foley stated he realizes thlltthe city docs
. need enforceable City Ordinances.
The EAC members were nOlilied of n new concept thnt could effect the Stormwater Fee. process in
Clean\'llter. An ullcmpt will be made to come to an agreement with SWFWMD, that if ponds arc
properly maintained by commercial bu.siness and meet requirements, some of the fees could be returned
to participating commercial businesses.
Some discussion was'held on a current pilot Neighborhood Program, supported by the National Estuary
o Program ulorig with the Agricultural Extension Services. A meeting was held with the Chamber of
Commerce in an attempt to get some cooperative effort to do a similar program. Some details were
presented toward effecting this Lype of program.
Mr. Miller also stated thutthe overall scope and direction of the Allen's Creek project is much broader
than the original intent of Allclls Creek, agreed to by the City. Discussion enslIed 011 what the County
. was actually doing, It was noted that while the City is participating financially and technically in the
study phase of the project's agreement in how the money is to be expended or implementation. The
COllnty is expecting the municipal governmcnb to pay for these duties within their jurisdiction.
Mr. Hunt requested a report on the expenditures to date of Stormwatcr funds. Mr. Miller presented
a slide depicting the disbursement of the funds from the Stormwater Utility Fee; and also. a chart
referencing the expenditures of the overnll budget. Graphic charts depicting operating arcus and
percentage of expenses arc aU ached. Mr. Miller discussed Capital Improvement Projecls (See
attachment B-6), describing present projecls, ulld proposed projects.
A queslion was raised thut only a half of. the Slormwall~r Utility Furid is being used for new projects,
Le, water quality, and olher half for maintenance that previously was accomplished under other funds.
Mr. Miller explained the logic to such expenditures. Mr. Hunt commented that the original purpose
of the Utility Assessment Fund did not include repair of storm sewers, nnd inquired if there was a list
available indicating specific expenditure for individual projects.
An issue was mised that 3.4 million dollurs was collected from the SlormwaLCr Utility Fund and only
$600,000 is available for f\11\\T~ \\Inter qua\hy projects. Mr. Jonson stated a presenlation was made at
a Homeowners Association where discussion indicaled that properly was to be purchased with funds
from the Utiliiy fce for the pLlrpose of improving water quality.
Mr. Miller requested lhat the EAC continuc to discuss the Watershed issued and not adjourn without
some conclusion 011 the issues discussed by the EAC. Mr. Hunl stated it was difficult to present any
iinmediutc comments because the presentation covered so mimy diverse issues. Mr. Hunt stuted he
needed copies of the charls to study prior to presellling any questions. Other EAC members arc to be
mailed churts also for review. Mr. Hunt requested that Mr. Miller generate a list of some identiliable
projects thlltthc EAC mcmberscan review amI presenlto the Commission~ Mr. Jonson recommended
that elllphasis should be pluced on smllller scale projects within the City using Stormwater Utility funds.

backed the original plan. Mr. Miller also explained that management was waiting to see if NPDES and
Allen's creek stu~y \Vould 'be of IIssistnncc in nchieving goals.
Mr. Jonso,n suggested some recommendations be made by lhe EAC to the Commission, IInd presented
two options that cun be presented indicating concerns of the EAC. Mr. MiI1er discussed how the City
. Ordinances effect some of the erosion problems which exist within Clearwater; The City Ordinance
would have to be changed to allow the city to go onto private properly for the purpose of improving
drainage.

Ms. Finch stated thut when the Allen's Creck study is. completed, the EAC ,...ill be asked for their
support'to the City Commission.
Now that the County has agreed that Clearwater can implement drainage'projects in Allen's Creck, stafr
is presently developing a project in Allen's Creek. The City is proposing to design a project that would
not interfere with consultants dcsigns. '
Committee decided to continuc discussion on thesc issues at next meeting.

Mr. Hunt slated that lifter. reviewing charts, he ,"Quid attempt to come up with specific questions for
further review at lhe next meeting.
Mr. Hunt thanked Ms. Finch for her attendance.
Mr. Hunl wished it to be recorded tllatlhc EAC supporls the Commissions position on endorsing the
Sign Ordinance.
Mr. JOl1son gave il farewell statement to lhe commillec members, stating he enjoyed being parl of the
committee and expressed it was difficulllcaving knowing there were many issues facing the City that
a.e not casy to deal with. He requested the commiuee to continue their crforts to support the City stuff
on these' complex issues. Mr. Jonson thanked Mr. Miller and slaff members for all their assistance.
The Committee expressed their regrets at Mr. Jon50n resignation.

resumed monitoring water qGality and that existing City
ordinances may'not ~rovi~e adequate enforcement ,authority to
. insure,prevention of stormwater system pollution. Publicity
is important to achie~e continued voluntary compliance with,
pollLl"tion control guidelines. Mr. Miller will .review the
effectivity of. existing County ordinances within the City.

Identified, desirable, Clearwater plans have been, ,and
will continue to be, delayed awaitihg coordination with
County and adjacent local government actions. The EAC ,
~ncourages the Environment~l Management Staff to continus to
'pursue cost-effective joint efforts, howev.r, ~mph~sis
should also be placed on identifying smaller scale projects
totally'within City jurisdictic,n which can be int"tiated on a
more timely basis using some of the accumulating Stormwater
Utility assessment funds. Improvement/enhancement of some,
of the retention/treatment ponds in the downtown ar~a might
be corisidered. Mr. Miller will review candidate efforts.
The November EAC meeting will continue to address and
provide explicit comments on the Watershed Management' Plan.
2. The EAC strongly endorse? ~he City Commission determ-
ination to enforce the 1985 sign ordinance. These aesthetic

Watershed'Management Plan Issues:
1. Clearwater had a disproportionately small voice in,
generation of the rec~nt Alle~s Cr~ek action plan.
Resolved: Clearw~ter should insist on having a voice in
proportion to its funding contribution during future jointly
funded efforts in conjunction with County/lnterlocal govt's.
Resolved: Cl~arwater should proceed to address environmental

recommendations.
2~ The Stormwater Utility fund presently has an ~ppioximate'
$1,000,000 balance and will receive an additional ,$600,000
by Sept 30, 1993. Public Works recommended use of these
funds from 1 Oct'92-30 Sept'93 includes the following items:

In.addition, the DOT is trying to maintain a balance between safety
and 'landscape. Clear-cutting was . selectod by engineers,
historically, as a safety measure. Overcoming this prejudice will
require citizen overview such as the Coalition provides. Now that
the law spells out the requirement, this should help change past
trends.
Furthermore, the 1992 Transportation Act, directs all planning to
lIprovide for the compatibility...with the surrounding.natural or
rnanmade environment." Thus we are working toward a system more in
harmony with the environment.

The DOT is also to cooperate with'local communi~ies to plan the
landscape. Your. letter to Mr. Nagamia should answer your questions
concerning the coordination between state and municipal
requirements.

agreeing to provide this landscaping if the City will maintain it. Perhaps the North
Area Committee of the Chamber would be interested in working with the City to
complete this agreement with DOT. This would be a real'service to the citizens of.

This letter is in support of your grant request to the Tampa 'Bay National
Estuary Pr'ogram for an outdoor classroom and native habitat restoration project in
front of the Countryside High School. "
The Coalition of Homeowners consists of neighborhoods from within the City
of Clearwater. Our organization's 1992 goals included an objective to improve the
water qu~ity in Clearwater Harbor, Tampa Bay and other surface water bodies. Our .
'activities thus far have been toward encouraging the City of Clearwate'r to embark on a
recycled water use program ~nd to encourage the effective use of storm water utility
fees to improve water quality.
Your proposed project represents a special effort toward improved water
quality. There are two aspects of your project which are particularly valuable from our
point of view: the classroom area' will be open on weekends for use by the residents of
, the surrounding area (there is no similar facility in the immediate area) and the
pfoximity to a major roadway. This later aspect provides a unique opportunity for a
large number of motorists to see an. environmental restoration project take shape and
the benefits thereof. Hopefully this will encourage individual water quality
conservation within all of Clearwater.

budgetary constraints, was not included in the plans. However, if local goven:tment wishes that
'the area be landscaped, we will work with them on accomplishing this provided ,they agr~ to
main~n .the landscaping through. a memorandum of agreement with the .Department. This
agreement will ensure that the landscaping will be propcrlymaintained so as not to create a
safety hazard for the motoring public. '

It has come to my attention that'city boards may have formed subcommittees in order
to facilitate the activities of the boards. . '

Please be aware that any and all subcommittees are subject to the same sunshine law
requirements as the full board or committee. That means all meetings must be noticed to the
public and minutes must be produced. Any actions taken by boards or corrymittees based on
recommendations of subcommittees that do not follow the requirements of the sunshine law
can- be invalidated.
Also. please be aware .that conversations, between two or more board members.
regarding board business held in hallways, parking lots, etc. are inappropriate as they are also
subject to the sunshine law.
I realize some of you may feel this is too constraining. However, it is the law and
failure to abide by those requirements could jeopardize all actions of your respective. boards.
Also, yiolation of the law carries criminal penalties for anyone convicted.

, Last April, we talked about the absence of landscape elements in the State
intersection improvement project at Highway 19 and SR580/Countryside. Since that
time, the access road to the west has been partially completed and does not comply
with either Pinellas County or City of Clearwater landscaping requirements.

Clearwater and County ordinances require a perimeter Jandscape buffer ,along
the public right-of-way. This buffer is to include shrubs and trees of specific4 height
and spacing. The completed portions of the project do not comply with this
requirement. Some portions of the project. which previously complied with this

As the change agency, I would have expected the Florida DOT to take a lead in
. ensuring the project's landscape elements are coordinated with businesses and public
officials. The purpose of this letter is to inquire whether this coordination is taking
place.

It is wonderful to see the rapid progress taking place on the transportation ,
elements or tile project. Highway 19 certainly needs the interchange improvements in
this area. I al!l concerned that our desire to reduce traffic congestion may totally 'deter
us from goals to improve the surrounding environment as well. This concern was
reCognized in the Federal ISTEA act which provides funding for enhancement
activities, including landscaping. What are your plans regarding landscaping for this
project? '
