The meeting was called to order at 4:03 P.M. by the Chairman, Mr. Hunt, in Conferencc Room B at the City
Hall Annex on June 10, 1992.

The motion ca~ried unanimously.

Agenda was changed to accommodate Old Business, i.e., Environmental Advisory Committee's Mission
Statement.
II. OLD BUSINESS
A. DISCUSSION/REVISION OF UPDATED EAC MISSION STATEMENT
"
I
Mr: Hunt brought to the anention of the Environmental Advisory Committee his letter of June 7, 1992. He
stated. that these were his commcnts 'to the amended Environmental Advisory Committee's mission, and in
response to the Commission letter of May 8,1992. Mr. Hunt proposed that a portion of the amended mission
statement be made part of the Bylaws. " ,
Mr. DcBlakcr made a motion that theJirst two paragraphs of the EAC Mission presented in Mr. Hunt's letter
be approved and presented as the amended mission statement, with the replacement of1'review selecte~ projects"
for "oC controversial projects". These two paragraphs replace initial first paragraphs of Part "IV. Duties" of the
Bylaws. Motion seconded by Mr. Reuter.
A ,discussion followed referencing the EAC mission statement:
Mr. Jonson stated that the mission was the most important item' under consideration, and discussed some of his
concerns' regarding the mission statement as presented by Mr. Hunt. Mr. Jonson requested chnnging "'EAC
Mission" to 'tItem IV. Duties", in Attachment "A" of Mr. Huut's letter.

Ms. Garris stilted the commiuee must determine if it wishes to limit itself to only projects lhe commission wishes
EAC to review; or if, at times, the committee chooses to review specific selected projects themselves.
Mr. Davis approved !'review selected' projects!', stating that with this statement, if the City Commission docs not
select, it will leave it open for EAC to select projects. '
Mr. Hunt staled that he believes the EAC should be empowered to look into' a project if it deserves attention.
Mr. Perry questioned if the new mission statement was not contrary to the Commission's goal for the EAC. Mr.
D~Blaker stated that the EAC is modifying the Commission request, by limiting objectives of the EAC. Mr.
f:oley, stated he believes the EAC needs to be able La look at ongoing projects and make comments when
appropriate. No c1umge is required for Bylaws Sections I, II, or Ill.
A motion was made to approve the amended ByLaws. Vote was taken, 7 in fuvor, 2 opposed,{Mr. Jonson nnd
Mr. Davis). These arc to be submitted to the Cily Commission. .
n.' DISCUSSION/GENERATION OF TRt\NSMI'ITAL L1~TTER TO CITY.
Mr. Hunt proposed that the letter to the City Commission should include a reply to specific questions, explaining
EAC rational. Mr. Hunt stated that his outline presented a summary of last montlls discussioDt and that a review
uf this outline was required to make any necessary corrcctions.
A discussion followed in reference to each question:
Question A:
After review of Mr. Hunt's comments, tho conclusion of the EAC was that ''The EAC \vi11 be pleased to continue
serving as a sounding board for environmental policy issues including tbose suggested by tbe City Commission.
An "Open" citizens meeting for public input on environmcntul issllcs will be sponsored, at least annually, by the
EAC. Relevant City Staff support is essential to the success of these meetings." .
Mr. DeBlaker made ~otion for approv~l of this response. Motion was seconded by Mr. Perry. Motion carried
unanimollsly.
'Question B:
No change recommended. Mr. DeBlaker made motion to adopt Mr. Hunt's presentation. Motion was seconded
by Ms. Donovan. Vote was. taken, 8 in favor, 1 opposed, (Mr. Davis).
Question' c:
Mr. Jonson stated the Mr. Hunts wording was adequate and moved for its adoption. Motion was sccomled by
Mr. DeBlaker. Vote was taken; 8 in favort 1 opposed, (Mr. Davis).
Question D:
Mr. Hunt expressed his thoughts on the importance of the EAC in identffying environmental issues to the City
Commission. 'After some dis~l1ssion, revisions were made to Mr. Hunt's presentation. Motion was made LhaL
Mr. Hunt would arrange this in proper manner for presentation. See June 12, 1992lcUcr (aUached). Vote was
laken, all in favor.

A discussion was held by the ,commillee, and it WiIS agn:ed the EAC would continue to do selective project
reviews early in the co~ceptional phases when there is an opporllmity to present alternatives. The Environmental
Advisory Committee will make riny recommendations to the City Commission, while the project is still cnrly
enough in design to accommodate recommended changes. '
Mr. Miller suggested EAC present' their 6 month ag~nda program to the City Commission and obtain their
sanction.' Commission needs to see whut EAC wishes staff to do, nod then City Commission can agree, disagree
or modify.
MR. Donovan lnlerjected thut the EAe should just answer the quesliolls. "NO, the EAe. does not want to do
research, nor docs the EAC want to review projects". It was agreed that the EAC could have some positive
impact at the conceptual stage. Mr. 1-1 lint stated Lhat the EAC wishes to have the ability to make some comment
on issucs. ".r
Mr. Hunt made a motion to rephrase the response to Question E to renect the review of selected programs.
See June 12,1992 letter (attached). Motion was seconded by Mr. Reutcr. Mr. Miller suggested the old Bylaws
be attached along with the changes.
1. Identity Functional Problems
After reviewing Functional Problems as presented by Mr.Hunt, it was concludtd to drop itcms No.1,
2 and 4, and substitute alternative items. See June 12, 1992 Icll~r (attached).
Hem 3, The Sunshine Law, will remain.
III. NEW BUSINESS
Mr., Hunt discussed the updated Long Tcrm Agenda.
Committee discussion and revision followed. Mr. DcBlaker made motion to accept the Long Tenro
Agenda as revised. Motion was seconded by Ms. Garris.
Mr. Jonson commented that a meeting should be schedule in the agenda where environmental inventory
items would be discussed. '
Mr. Jonson stated he reviewed the NPDES Permits regarding the quality of waler failing to meet state
pollution levels, and requested that thiS issue be llddressed in the near future. Mr. Miller stated that
what was missing on the 6 month agenda was discussion of the Comprehensive Watershed Management
Plan for the City of Clearwater. Solutions to water quality problems within the City of Clearwater rests
with the Comprehensive Plan., It was determined that Watershed Management will be discussed at the
July meeting.
A discussion ensued on the Clcarwater Harbor Issue, which is to be part of the Long Term Agenda.
Ms. Donovan suggested working on two or three major umbrella type program, stating that she believed
the City Commission would prefer thc EAC to concentrate on a long term ongoing project
Mr. Reuter suggested thatlhcrc should be 20-30 minutes sel aside at meetings for comments from EAC
members on new items/projects to be introduced. Mr. Hunt stated this would come under "Other" of
the Agenda. Mr. Jonson stated that it would be uppropriate to address Mr. Rculer1s'commcnts, but at
one meeting, instead of several. "

Mr. Miller stated that since Watershed Management will be disclIssed at the next meeting, he will'
present a summary of Comprehensive Watershed issues at that meeting. Mr. Miller would also like to
present citizens concerns at thllt time. A roup will be prepared for the next meeting \0 indicate locations

, Mr., MiI!er notified the EAC members the status of the' Berle's property wetland violation. The case "
has gone to trilll and has been resolved as a landmark case, due ,primarily to the development of the
case by the Environmental Stuff. Mr. Miller gave the members II brief description of the penalty und
restoration required by ,City and Stute';-: Ms. Donovan suggested this should be brought to the attention'
of the public."

The City Commission would like to thank the members of the Environmental Advisory Committee for
their response to the Commission's inquiries concerning the EAC. The response to the Commission's
,concerns were discussed at Commission \Vork Session on June 29, 1992. The fOliowing modifications
and/or requests represent the consensus of the Commission for EAC action.
1. City Attorney AI Galbraith is to, attend the next meeting and discuss the Sunshine Law as it
applies to the EAC.
2. Modify EAC proposed changes to Article IV (Duties), paragraph 1, to delete I' ...through
appropriate sponsorship of public hearings... II Other amendments to the Bylaws recommended
by the EAC are approved. '
3.
Modifying the operating bylaws eliminating the use of subcommittees.

4. The committee is to meet a maximum of once per month.
,5. The 8-hour rule will apply to requests from the full committee. Project requests will be; .
requested by the full committee not from individual members.
6. The committee will provide an overview of specific projects as designated by the Commission.
7. The Commission requested that refined concepts agreed to by the full committee be brought
forward to them.

8. The Commission requested that the first priority project be a review of the environmental impacts
regarding Dunedin 'Pass.
9. The committee will continue for another year. At the end of this year, discussion will begin
to determine if the committee should be established by ordinance.

OPERATING BYLAWS FOR ENVIRONMENTAL ADVISORY COMMl'rnm

1. J\1ernllcrshlp unci Terms:
Stuff recommends that a hody of ten (10) cilizens who are permanent rcsidents of Clearwater be appointed by
the Commission. Following an advertisement for interested parties filed by the City Clerk, n pool of interested
citizens will be developed. Each Commissioner will appoint one (1) reprcsentntive for a 3-ycar term. The
remaining five (5) members will be appointed by 11 vole of the full Commission. Three of the five (5) members
selected from the pool and affirmed by a vole of the Commission shall serve for a 2-year lerm. Two (2)
remaining members selected from the poolllnd affirmed by a vott' of lhe Commission shall serve for II 1.ycar
term.
II. Meetings, Omccrs lIulI Rules:
(a) The commiuec shall meet qUllrterly and at such other limes as the board, by mlljority vote, may
find necessary.

provided in Seclion 22.06 of the City Code (i.e., three, (3) unexcused absences in a calendar year).

applies to the EAC.
2. Modify EAC proposed changes to Article IV (Duties), paragraph 1, to delete tI...through

authority or of any agency or authority of any county, municipal

B. A public meeting cannot be held at a facility 'or location which
discriminates on the ,basis of sex, age, race, creed, C010f, or'igin, or economic
status or which operates in a manner which unreasonably restricts public access
to the facility.
IV. Each member in attendance is required to vote on official decisions and
acts of the board or committee, and may not abstain. ^ vote must be recorded or

'member or to the member1s employer, business associate, or relative, in which
case the member is to publicly declare a voting conflict before the vote is
taken, avoid trying to influence the decision, and then file a conflict

C. Care is necessary if a bare quorum is present. Declaring a voting
conflict means that the member is not counted present; the quorum will be lost.

and nature of voting conflict memoranda of conflict previously filed are to be
considered by the appointing authority. ~112.3143(5). '
V. The statute does not prohibit a member from meeting with city employees,
or meeting with a member of a different board or committee. The law does not
prohibit all social contact between members of th~ same board or committee, but
experienced members refrain from social contacts except at public functions.
VI. Exemptions from the law are few in number a~d are generally unavailable to
city boards and committees.
VII. A violation of the law carries a criminal penalty, and the act of the board
or committee may he declared void.

A: There is a very 1 imited exception for a committee established "strictly for
fact finding.1I For example, in Cape Publications, Inc. v. City of Palm Bav, 473,
So.2d 222 (Fla. 5th DCA 1985), a staff committee with two non-employees sat in
while the city manager, interviewed three candidates for police chief. The city
manager performed the interviews, but the committee members asked technical
questions and offered comments on the qualifications of the applicants. They
were delegated no authority, and the city manager did essentially everything.
If they had been given the authority to screen, interview or recommend applica~ts
to the city manager, there would have been a violation of the Sunshine Law.
Oy contrast, in Bioe16w v. Howze, 291 So.2d 645 (Fla. 2d DCA 1974)" two county
commissioners were appointed by the county commission to gO'on ~ fact-finding
trip to interview Tennessee officials who had worked with two firms competing for
a contract. They agreed to recommend one. of the firms and met with a
representative of the firm, not in a public meeting, to discuss the firm1s
proposal. The committee then recommended that the county commission hire the
firm, and it did. The contract was declared void because of a Sunshine Law
violation, although the trip had been publicized in advance.
Q: Does the Sunshine Law govern a trip to inspect development projects and
gather information that may be useful later in evaluating a development project?
A: Yes. The trip will constitute a llmeeting!l from the time the members gather
until they disperse following their return. Trips are allowed if the minimum
requirements have been met; see AGO 71-361 (inspection trips) and AGO 76~141
(bus tours of city projects). ~

I. Momborship and Terms:
Staff recommends that n body of ten (10) citizeno who are permanent residents of
Clearwater be appointed by the conunisoion. FOllowing an advertisement for
interested parties filed by the city Clerk, a pool of interested citizens will
be developed. Each' Commilloioner will appoint one (1) repreaentative for a a-year
term. The remaining five (5) memberll will be appointed by a vote of the full
commission. Three of the five (5) members oelocted from the pool and affirmed
by a vote af the commission ahall aerve'for a 2-ycar term. Two (2) remaining
members selected from the pool and affirmed by a vote of the Commission shall
serve for a 1-year term.
II. Meetings, Officors nnd Rulee:
The committee shall meet quarterly and at ouch other times a8 the
board, by majority vote, may find neceQsary. .
The committee shall select a chairman, vice chairman and such other
officers as it may find necessary, from its membership.
(c) The committee may adopt such rule of procedure as it :finds
necessary, which shall not be in conflict with Florida law or
ordinances of the Clty.

(d) Each officer shall serve for a term of one year. The Chairman shall
be limited to a one year te:t'm of office and shall not serve
consecutive terms of office during appointment to the committee.

III. Removal:
The City Commission shall have the power to remove any member of the Clearwater
Environmental Advisory Committee for misconduct, any conflict or neglect of duty.
In addition, the city Manager shall have the power to remove any member because
of the unexcused abse.nce of the member from meetings of the Committee as provided
in Section 22.06 of the City Code (,i.e., three (3) unexcusedabsencea ~n a
calendar year).
IV. Duties:
The Clearwater Environmental Advisory Committee shall be aupported by city staff
and my review and make recommendations to the city commission concerning all
water, wastewater and stormwater programs or projects initiated by the city
exceeding $50,000 in construction coot or other programs selected by'majority
vote of the Committee ,which have other substantial environmental benefits or
consequences upon Clearwater's natural resources.
At the Committee's option, these other programs would include but not be limited
to: '
(1) Upland and wetland habitat preservation and creation.
(2) Natural shoreline restoration.
(3) Wetlands restoration to include fresh water and 'marine systems.
(4' Purchase of properties for preoervation of unique ecosystems.
Requests for information 'and staff work ahall be by consensus of the Committee
and in keeping with the city Commission policy regarding projects and requeats
for staff worle, Le., staff projocts or report a generated at the mC\jority request
of the committee, requiring more than eight (8) hours of work must a.lso be'
approved by a majority vote of the city Commission. .

The City of Clearwater, Environmental Management Group
initiated an ambient water quality monitoring program in
January of 1982. The program was suspended for revaluation
in the summer of 1991. The data collected from this program
has been organized into a data~ase which will be used as ,the
background information for a baseline water quality report
for the City of Clearwater.
There are nine drainage basins within City jurisdiction, six
lakes and'six'creeks systems were sampled fora total of 29
stations.

Fuel Transfer: From underground tanks to one gasoline
and two diesel stat'xons located on the fuel docks.
Five additional remote diesel stations are located at
various large slips in the marina for the fueling of,
permanent'commercial vessels.

b. The terminal facility is part of the 152 slip municipal
marina. The fuel dock has six spaces assigned for the
transfer of fuels. The largest vessel serviced at this
facility is 100 feet long with a fuel capacity of 6,500
gallons.
Mean Tide Range is 1.8 feet.
Currents 'flow NW to SE on Ebb Tide and SE to NW on
Flood tide. Water depth at the fuel dock is 12 to 14
feet. other water depths in the Marina are 8 to 12
feet. The Marina basin is bordered on the north by
Causeway Blvd., on the west by Coronado Orive, on the
south by Devon Orive and open of the east side to the
marina channel.

d. The area is favored with seasonal mild weather all year
round. The year round temperature is approximately ,
22.20C with average high temperature generally running
5.60 higher (27.aOC) and average lows 5.60 less
(16.70C). The average annuai rainfall for the area is
approximately 112 centimeters, and the majority of
precipitation occur~ during the months'of June through
September. Average sea temperature's range from a low
in January and February of 21.10C to a high of 300C
in August. Prevailing winds are from the northeast and
north during the winter months, while the remainder of
the year they are predominantly from the east and
south. Average wind speed is 7 to 16 knots. Visibility
in the area is not a problem.

a. The City' of Clearwater lIarbormaster is the
designated person in charge of this facility. lie also
has the responsibility for the training of employeets
in spill response duties.
b. The names, positions, and phone numbers of the terminal
facility response team are identified in attachment #1.
c. The owner of the facility is the city of Clearwater.
d. Additional city of ~learwater personnel for a pollutant
discharge are available from the Building and "

(3) NOTIFICATION,
a. Attachment #2 lists the U.s. Coast Guard and state of

and Marine Services personnel.
(4) VERIFICATION
a. The verification report will be made by the Marine

(9) RECOVERY AND DISPOSAL
a. Fuel spills of 200 gallohs or less, will be contained, ;
received and disposed of by the city of Clearwater.
The city will use a Hazard Material container supplied
by the city's 'Solid Waste division to transport
pollutant waste to an approved site.
b. For disposal of pollutant waste the city will use the
Waste Disposal facilities for pinellas county located
at Solid Waste Management, 2800 110 the Ave., st.
Petersburg, Fla., phone (813) 892-7565.
(10) TRAINING
a. First response training for employees identified in
attachment #1 of eight (8) hours will be conducted by
the city of Clearwater Fire Department. Attachment
#6 contains the first responder training agenda and
hours. Annual training review of the current facility
spill response plan will also be conducted by the Fire
Department and noted in each employees record.

required improvements In ,the area of Environmental Permitting to enhance service delivery, As a result of that
and my continuing desire to promote understanding of the Environmental Management Group's role for the City
of Clearwater, I have prepared this report of activities for the month of May. Please consider the information
contained wIthin this report and comment as necessary. I am considering a Quarterly review of this report for
tracking purposes and would like to have a final report that is useful for more than just my purposes.
The Environmental Management Group has three program areas: (11 an Administrative Program that comprises
the tasks necessary to manage the human and physical resources; 12) a Regulatory Program that regulates
, Envlronm.ental Protection for the City in accordance with City Ordinances. Rules, Regulations. and Policies: and
(3) a Watershed Management Program to plan for and manage the development and ope~ation of City facilities In
an manner that Is consistent with developed or developing plans and environmental laws. The Environmental
Management Group has a FTE Staff Positions. Including the addition of a light duty employee during portions of
~ay. total staff hours for May among' all programs was 1.364 hours.

1. Inspoctlons 142%): The reinspect ion of commercial landscape was initiated in the
northern downtown area (Phase B), As of May 29. 1992. 48 commercial properties
have been inspected and 33 have been determined to be In compliance with the original
landscape plans and ordinances. The remainder are not in compliance. One site has
received a notice of violation,

In addition, EMG Staff were largely responsible for the recent successful adjudication
of a landmark case by the State against a wetland violator In Clearwater.
2, AdmInistration (23%1: Staff initiated the development of a computerIzed sIte plan
review process and tracking system which is scheduled for completion In June. This
system will facilitate more timely review of building permit applications and Inspection
scheduling for Environmental purposes. .
3. Lund Rogulatlon (20%): EMG approved the WalMart l'andscape plan and issued 22
:rree Removal Permits. Staff continue to work with the City Attorney to revise Chapter
9B of the City Ordinances to relieve administrative and technical problems and
Implement a revised ree structure to improve the revenue:cost ratio. This review has
. been underway since January, 1992.
4. Water Regulotlon 115%1: The project of most significance during May has been
Rogers Barbecue. This site rCQuiled relocation of a retention area to facilitate future
Pinellas County improvements. Staff worked with the developer to resolve project
difficulties and facilitate project development.

WATERSHED MANAGEMENT PROGRAM
1. Environmental Permit Acquisition 140%1: Significant changes were made to this
program area through program redirection and shifts away from Watershed Planning
in favor of Environmental Permit Acquisition, Comparatively. time spent on permit
issues In May was up mOlt! than 138% over January when concerns began to be
expressed about the permit acquiSition effort. Overall. during May, Staff completed
development of a revised permit acquisition process and implemented procedural
changes that provided EMG the opportunity to review projects during the conceptual
development stage. In addition. a permit acquisition support request form and a
computerized process tracking system was developed to improve process tracking and
efficiency. Staff is presently refining the system to Improve project accountabllity.
2. Materials Management 122%): EMG Staff Is arranging for the proper disposal and
recycling of lighting transformers for Parks and Recreatton that contain Polychlorinated
Biphenol contamination, Staff is also arranging for the proper disposal and recyclino
of waste oil filters for Fleet Maintenance and is arranging for the proper disposal of
Mercaptan and Mineral Spirits wastes for the Gas Department. In addition. Staff is also
working on future waste disposal needs and a minimization plan for the Gas
Department.

Florida Petroleum Llllbility and Insurance Program. This will reduce third party liability

Mean Tide Range is 1.8 feet.
Currents flow NW to SE on Ebb Tide and SE to NW on
Flood tide. Water depth at the fuel dock is 12 to 14
feet. other 'water depths in the Marina are B to 12
feet. The Marina basin is bordered on the north by
Causeway Blvd., on the west by Coronado Drive, on the
south by Devon Drive and 'open of the east side to the
marina channel.
The area is favored with seasonal mild weather all year
round. The year round temperature is approximately
22.20C with average high temperature generally running
5.60 higher (27.S0C) and average lows 5.60 less
(16.70C). The average annual rainfall for the area is
approximately 112 centimeters, and the majority of
precipitation occurq during the months' of June'through
September. Average sea temperature's range from a low
in January and February of 21.1oC to a high of 300C
in August. Prevailing winds are from the northeast and
north during the winter ,months, while the remainder of
the year they'are predominantly from the east and
south. Average wind speed is 7 to 16 knots. Visibility
in the area is'not a problem.

(2) ORGANIZATION
B. The City of Clearwater lIarbormaater is the
designated person in charge of ,this facility. lie also
has the responsibility for the training of employee's
in spill response duties.
b. The names, positions, and phone numbers of the terminal
facility response team are identified in attachment #1.
c. The 'owner of the facility is the city of Clearwater.
d. Additional city of Glearwater personnel for'a pollutant
discharge are available from the Building and
Maintenance Division 'phone 462-6610, Public Works
Department phone 462-6585, and Solid Waste Division
phone 462-6657.
(3) NOTIFICATION
,a. Attachment #2 lists the U.S. coast Guard and state of
Florida phone numbers to be called for notification of
any spill.

In the event of a spill, the city of Clearwater
Emergency Manager phone 462-6795 will be contacted
immediately. Attachment #2 also includes management
and cleanup contractor (for spills over 200 gallons)
phone numbers.
c. Visual inspections for leaks and spills will be
continually conducted each day by Fuel Dock attendants
and Marine Services personnel.
(4) VERIFICATION
a. The verification report will be made by the Marine
Operations Supervisor with the following information:
1. Time and date.
2. Exact location (slip number).
3.' Estimated size of spill in gallons.
4. Source of spill (if known).
5. Any other information that may be useful.
(5) ON SCENE ASSESSMENT
a. The ongoing assessment report will be made by the
Harbormaster, Assistant Harbormaster or Marine
Operations Supervisor.

(9) RECOVERY AND DISPOSAL
a. Fuel spills of 200 gallons or less, will be contained,
received and disposed of by the city of Clearwater.
The city will use a Hazard Material container supplied
,by the city's Solid Waste division to transport
pollutant waste to an approved site.
b. For disposal of pollutant waste the city will use the
Waste. Disposal facilities for Pinellas County located
at Solid Waste Management, 2BOO 110 the Ave., st.
Petersburg, Fla., phone (813) 892-7565.

TRAINING
a. First response training for employees identified in
attachment #1 of eight (8) hours will be conducted by
the city of Clearwater Fire Department. Attachment
#6 contains the first responder training agenda and
hours. Annual training review of the current facility
spill response plan will also be conducted by the Fire
Department, and noted in each employees record.
(11), TERMINAL FACILITY SPILL CONTINGENCY PLAN
a. This plan will be kept current at all times and will be
available for inspection upon request by state
inspectors.

This submittal is to acknowledge r~cciipt of City of Clearwater
Purchase Order ff 3013-92, confirming third party' contracting for
oil spill response. ~
Diversified Environmental Services, Inc. will be pleased to
serve as the designated response contractor for the City of
Clearwater Municipal Marina.
Our response will' be' initiated by calling our 24 hour
response line at (000) 706-3256. '1'110 necessary equipment,
materials, and manpower will be dispatched from our facility at
1825 Knox Rd., in the Port of Tampa, Fl. We understand that the
City of Clearwater will be providing it's own "first response",
and that we will 'be retained to provide pdditional support within
the four hour framework mandated by current regulati~n8.
A'copy of our DNR Spill Prevention and Response Inspection
Certificate' will be forwarded t'o you when issued.
Enclosed for inclusion in your facility contingency plan is
a copy of our current e~uipment inventory. Updated verBions will
be supplied as applicable.

GOVERNMENT IN THE SUNSHINE LAW
I. The "Government in the Sunshine Law, II in one sentence~
A 11 meet i nQs of any' board or commi ss ion of any state agency or
authority or of any agency or authority of any county, municipal
corporation, or political subdivision, '
except as otherwise provided in the Constitution, at which official
acts are to'be taken are declared to be public meetinQs open to the
-.public at all times, and no resolution, rule, or formal action shall
be considered binding except as taken or made at such meeting.
Section'286.011(1), Florida Statutes (1991).
II. The rule is broader than it appears from the statutory language:
A. "Board or commission" includes advisory committees.
B. "Meeting" includes any 'discussion of public or official business by
two or m6re members of the same board or committee, whether or not a formal
meeting has been called, even if official acts are not proposed to be taken (such
as a "work session").
1. An informal meeting or even a telephone call between two
members is a "meeting" if the business of the board or committee is discussed.
A non-member cannot be used as a conduit or go-between, telling Member B what
Member A thinks, or Member C what A and B think.
, 2. There is even some authority that a single member can conduct
a "meeting" if the member has been delegated authority to act for the board or
committee, such as to negotiate a contract.
III. A proper meeting 'requires notice to the public, a location which is open
to public access, and a set of minutes for recording in records open for public
inspection.
A. A tape recording is not required, but if the meeting is taped, the
tape is a public record.
B. ~ public meeting cannot be held at a facility or location which
discriminates on the ,basis of sex, age, race, creed, color, origin, or economic
status or which operates in a manner which unreasonably restricts public access
to ,the facility.
IV. Each member in attendance is required to vote on official decisions and
acts of the board or committee, and may not abstain. A vote must be recorded or
counted for each me~ber present. ~286.012.
A. The exception is when there would be a special private gain to the
member or to the member1s employer, business associate, or relative, in which
case the member is to publicly declare a voting conflict before the vote is
taken, avoid trying to influence the decision, and then file a confl ict
disclosure form. ~112.3143.
B. There is an exception to the exception, and that is when the salary,

expen5es, or other compensation of a public officer is on the agenda, in v/hich
event the,public officer shall not be prohibited from voting. 9112.313(5).
C. Care is necessary if a bare quorum is present. Declaring a voting
conflict means that the member is not counted present; the quorum will be lost.
. D. Hhen a board member is being considered for reappointment, the number
and nature of voting conflict memoranda of conflict previously filed are to be
considered by 'the appointing authority. 9112.3143(5). .
V. The statute does not prohibit a member from meeting with city employees,
or meeting with a member of a,different board or committee. The law does not'
prohibit all social contact between members of the same board or committee, ,but
,experienced members refrain from social contacts except at public functions.
VI. Exemptions from the law ate few in number and are generally unavailable to
city boards and committees.
VII. A violation of the law carries a criminal penalty, and the act of the board
or committee may be declared void.
A Couple of Tvpical Questions
Q: Gan a subcommittee of a board or committee be appointed 'as a !Ifact findingU
subcommittee?
A= There is a very limited exception for a commi~tee established "strictly for
fact finding." For example, in Cape Publications. Inc. v. City of Palm Bay, 473
So.2d 222 (Fla. 5th DCA 1985), a staff committee with two non-employees sat in
while the city manager interviewed three candidates for police chief. Thecity
manager performed the i ntervi ews, but the committee members asked techni ca 1
questions and offered comments on the qualifications of the applicants. They
were delegated no authority, and the city manager did essentially everything.
If they had been given the authority to screen, interview or recommend applicants
to the city manager, there would have been a violation of the Sunshine Law.
By contrast, .in BiQelow v. Howze, 291 So.2d 645 (Fla. 2d DCA 1974), two county
commissioners were appointed by the county commission to go on ~ fact-finding
trip to interview Tennessee officials who had worked with two firms competing for
a contract. They agreed to recommend one of. the firms and met with a
representative of the firm, not in a public meeting, to discuss the firm's
proposal. ' The committee then recommended that the county commission hire the
firm, and it did. The contract was declared void because of a Sunshine Law
violation, although the trip had been publicized in advance.
Q= Does the Sunshine Law govern a trip to inspect development projects and
gather information that may be useful later in evaluating a development project?

requirements have been met~ see AGO 71-361 (inspection trips) and AGO 76-141
(bus tours of city projects). .
