" The meeting was called to order at 4:00 P.M. by the Chairman, Mr. Hunt, in C;;onference Room B at the City Hall Annex on May 13, 1992. " " > Mr. Hunt presented ~l modified agenda and comments (au ached) , to the committee members in response to Mr. , Wright's letter on the City Commission's Action regarding the Environmental Advisory Committee. Mr. Wright stated that the letter to commiltee members was a synopsis of the discu'ssions' held' by the City Commissioners. .., , " , " , '.~ , ; \1" . ""'"" Ms. Rice stated that the Commission recognized that the EAC had been given by-laws which included project review. However, the directions of the Commission are now being changed. Ms. Rice stated that some of the comments in the newspaper were not taken totally in context. The commission now wishes the EAC to be a visionary committee not a project review committee. The meeting proceeded: l. ROUTINE AGENDA A. REVIEW MINUTES FOR APPROVAL " Corrections on minutes by Mr. Jonson on the la!;t page "Item V. NEW Business, A.II Mr. Jonson wished the minutes, to reflcct thatUa discussion was held on altermitivc ways of e""pressing concern, and Mr. Miller was to take the issue to appropriate slaff, and follow up on this maller." No further corrections were made. > " A motion was made by 1\1r. Jonson,to approve thc minutes of May 13,1991 as corrected and seconded by Mr. Reuter. The motion carried ununimously. B. PLANS REMARKS Mr. Hunt stated that the present isslle was the need 10 look into tilt: items the Commission hud cited to the EAC, and then advise them of any problems the EAC might anticipate as a result of the cbanges. EAC DISCUSSION OF CITY MANAGER'S LEITER Mr. Hunl brought to the commiLtec's aflcntion the potential functional problems he foresees ns the mosl pressing, as noted in page 8 of his comments. Mr. Hunt discussed a few of these problems such as; the rewriting of the Bylaws, reducing city SlUff SUPPOrl, and the proposition defined in the newspap(:r, thnt lhe CommiUce meel quarterly. Mr. Hunt believes it would be difficult to achicvc cvcn limited objectives with quarterly meetirygs. Mr. Hunt then suggested that {:ach committee member stale what is most relevant, and what they foresee as the most pressing issue. A further discussion cnsued regarding the problems resulting from the direction the CommissioJl pr,oYided La the EAC: Mr. Folcy Commcnts: (of . ~. , I ,Mr. Foley discussed the Mission S!utcmcnt,und listed some of the improved programs> and issues covered by' the EAC. Mr. Foley sanctioned the chairman's efforts to schedule topics, with all members having input on future projects. He docs 'not view himself as working for the Commission, since no monies are exchanged. However, he feels he is working for the citizens of Clearwater. Mr. Foley stated that many questions have been addressed at the EAC meetings lhal were not discussed at Commission meetings. Mr. Foley stated he 'still has not seen alternative plans that will be funded by Stormwater Management monies, and 'that he is interested in reviewing some of the future Stormwater Management projects, '. '0 , Mr. DeBlakcr Coinmcnts: Mr. DeI31aker stated he was upset after rending lhe Tampa Tribune, and that lhe Commiaee operaled by the Bylaws tha'l were given LO the EAC by the Commission. Since many of the projects the Committee was interested in had already been initiatcd, and inpUl could no longer be madc, the EAC should to be notified in sufficient time so that 'allention could be given to future projects. Mr. De Blaker discussed the Stevenson Creek issue, nnd stated some issues arc too complcx for quartcrlY'meetings. He also commented that it would be difficult 10 work with fimilcd staff support, and that it is necessary to h;we some detail or information as to what the City is proposing to do, Mr. DeBlaker stated that the commiuee has had some lectures from staff, which, though informatiyc and enlightening, were not specifically requestcd by EAC. Mr. DeBlaker stated that in ,reference to "Item E", of Mr. Wright's leIter, lhat this was in conflict with the duties oribrinaUy assigned to the commiuce. Mr. DcBlaker asked "if the EAC does not do the' review, who will, do it? Arc we going to. as , citizens, give the staff a blank check to go out and spend millions of dollars without a review." He suggested that perhaps the commitlee should disband as part of the City Commission, and just have a Citizens Committee whieh requests under the Sunshine Law what the staff arc doing. Mr. DeBlakcr questioned the reason for all this. "Did we step on lacs by asking directions.'l ' , Mr: Junson Comments: Mr. Jonson stated that his understanding is that the C'ommiu~e was formed to provide some review lO projects before they gal started. Mr. Jonson also staled that it is very important that we realize that we arc advisory,to the City Commission, and should be doing what they feel is most appropriate and give full support in that mission. Mr. Jonson believes this discussion is very beneficial. Mr. Jonson Vludc specific comments on Hems A thrll E, stating he would like more clarification on Hem D, and believes that there is some conflict of objectives between Item A and Item E. . ,~':",::';":~;, '~:'. Wutson Commcnts: Ms., Wl\lson stilted she was overwhelmed by scope of EAC. and staled that il appears to work differently from the Library Board, and other city advisory boards. The Library Board is not involved in as many projects and rely on Sluff to Ilsk for the board's opinion on specific hems. A Management Survey was hired to assist the library hoard in ils Inng range plan. Mr.Pcrr)"s Cummcnts: , Mr. Perry slated that at the inception of the Committee there Was a very broad. but not a well defined scope of the charter. Mr. Perry commented on the list of priorities, with the City Commission huving highest priority. ~r. Perry believes that the commillce worked within the scope of the definition that was given to the commiUee, and cannot understand the significant change in 'direction. He has specific concerns to "Items Bit and "Item E" of Mr. Wright's letter. Mr. Perry also stated, since the EAC has no budgct, it would be difficult to do any research.' . An 11 DOllovun's Commcnts: . ,< . Ms, Donovan agrees with Mr. Perry's comments, However, she serves as a public servant, and will do what is requested of her. Ms, Donovan was amazed on how much time and efforttlic sub committees put forth. Ms. Donovan questioned "llem A" and "Ilem D'\ and what arc the goals and objectives of the Commission. Ms. Donovan'inquired that if a change of Bylaws is to be made now, what is to prevent a change of di~ection occurring again in the near future. She is interested in setting up goals and plans, but not if they arc going to be frequently revised. ' George Davis Ill's Comments: ',' . ~ l , Mr. Davis made rderence to the Mission Statement he received along with his appoinlment, and believes the committee did what the City Commission requested. He agrees wilh Mr. Jonson's inquiry as to how to achieve an effective line of communication between the Commissioners and the EAC, and would like clarification of this. If the Commissioners wish to change the charLer, Mr. Davis suggested that one meeting be set aside to discuss this. so that all is understood as to what is requested. Mr. Davis sugested Lhat it would be advisable if the Commissioners notify the EAC of their main concerns. If the items were limited, then EAC could act as 11 'citiz.ens committee to allvisc on projects. Then perhaps meetings could occur every 60 - 90 days. Mr. Davis stated the EAC needs to be effective. ' Peter Reutcrts Commcnts: Mr, Reuter presented his comments on why he believes a citizens advisory committee is necessary in revie~\'ing projects; and stated that the EAC was there to represent the taxpayers of. Clearwater and share also a responsibility to the Commission,' Mr. Reuter believes the Bylaws should not be changed, and that this recommendation be made by the EAC to the City. > Mr. Hunt staled that he believes, as was indicated by the Committee members, that the EAC has been doing, what they were previously elected to do. However, Mr. Hunt interjected that the issue presently is that the Commission has changed their course, and if the Commiuee desires to he continued, a new approach and set of lllternlltive objectives need to be defined, ' Ms. Rice expressed her response to comments made by the Committee. The consensus of the Commission was indicated at the boll om of the letter, "Consider lInd recommend to the Commission a set of goals in the form of a work plan to Ilccommodate the inlcndcd purpose". Ms, Rice'sllggcslcd Ihe Commiuce should rcfO{~lIs on the questions, and recommend to the City Com'mission a St~t of goals. A discussion evolved as to what the Commissioners wish the EAC lO do, ~lIld what the EAC has ulrendy accomplished. Mr. Hunt reminded the members that (he Commission hus givcn thc EAC new direction, and that the Commission W<lnts (he EAC to address the future view and not the implementation of ongoing programs. Mr. Hunt further diEclIssed the issues and problems confronting the EAC, and. what will have to be accomplished. Mr. Hunt went into discussion rcf(~ring \0 his attached comments on the letter to Commiuee ' members. Mr. Hunt stated his interpretation of what the Commission wants EAC to do, which is, to envision what ClclJrwnter should look like years from now i,n an cnviromncrital context, and what strategic plan might be propagated py the EAC to accomplish this. In' addition, the EAC should mJdress and identify new items that the Commission has not addressed previously. The rest of the questions arc simply'n maller of validati,ng thesc i!isues. Ms. Rice agreed with this stntemenl. I;. Mr. Hunt also stated that the way he understands it, the Commission wants the EAC to institute open meetings where citizens can bring up environmcntal issues, using the EAC as a sounding board. Mr. Hunt stated this would indicate open meetings, that would not occur more than once a year. A ,discussion evolved around this subject, with Mr. Hunl requesting clarification, . ".; ~ Mr. Jonson made a motion thal Question "B" not be identified as a principal goal of the EAC bt.:cause of the difficulty of implementing it. Seconded by Mr. DeBlaker. Moved and seconded. Unanimously approved. ~;. . Mr. Perry requestc.d clarification of Question "C". Inquired how can the EAC funCLion without city support. . Ms, Rice responded expressing the type of assistance Ihnl would be avaiJable. The conclusion Was that the EAe is to plan a vision, and if the Commission approves it, thereby they ulso approve whatever level of staff assistance' isr~quired. . Referencing Question"E", Mr. Jonson stated that perhaps the:: EAC should recommend in its set of goals, that the EAC recommend to the Commission that they would be happy to take on the revised EAC mission as a prime statement, but would also be available for project reviews if requested. f> In reply to Mr. Perry's inquiry, Ms. Rice stated that the new intended purpose of the Commission for the EAC, is to act as an advisory committee made up of citizens concerned about the environment. They also want the EAC to look into the future, and tell the Commission whutthcY'need to be focusing on. giving some work plans or ways to achieve that purpose. The Commission docs not wanl projects r~viewed that have already been .approved, howev(:r, they appreciated EAC looking into the NPDES and the budget. 4 It was decided that the first tusk was LO establish objeclives for tbe Enviromnentnl Advisory Commiuee, and once the City agrees with them, that a new revised long range agenda would be prepared. One of the items would be, that by ~\ specific date the EAC would have a vision and strategic plan. After discussion, it was decided a Mission Statement needs to be drafted before goals or objectives can be decided. Mr. Jonson volunteered to prepare the draft und Mr. Foley offered his assistance. Membership and Terms: Staff recommends that a body of ten (10) citizens who are permanent residents of Clearwater be appointed. by the commission. Following an adverti.sement for interested parties filed by the City Clerk, a pool of interested citizens will be developed. Each' Commissioner will appoint one (I) representative for a 3-year term. The remaining five (5) members will be appointed by a vote of the full Commission. Theee of the five (5) members selected from the pool and affirmed by a vote of the Commission shall serve'for a 2-year term. Two (2) remaining members selected from the pool and affirmed by a vote of the Commission shall serve for a I-year term. II. Meetings, Officers and Rulesz (a) The committee shall meet quarterly and at such other times as the board, by majority vote, may find necessary. (b) The committee shall select a chairman, vice chairman and such other officers as it may find necessary, from its membership. (c) The committee may adopt such rule of procedure as it : finds 'necessary, which shall' not be in conflict with Florida law or ordi~ances of the City. (d) .Each officer shall oerve for a term of one year. The Chairman shall be limited to a one year t'erm of office and shall not serve .consecutive terms of office during appointment to the committee. (Approved by E.A.C. May 15, 1991) III. Remova.l: The City Commission shall have the power to renlove any member of the Clearwater Environmental Adviaory Conunittee for misconduct, any conflict or neglect of duty. In addition, tho city Manager ahall have the power to remove any member because of the unexcused absence of the member from meetings of tho Committee aD provided in Section 22.06 of the City Code (i.e., three (3) unexcused absences ~n a calendar year). IV. Duties1 The Clearwater Environmental Advisory Committee shall be supported by City staff and my review and make recommendations to the City commission concerning all water, wastewater and stormwater programs or projects initiated by the City exceeding $50,000 in construction cost or other programs selected by: majority vote of the Committee which have other substantial environmental benefits or conoequences upon Clearwater's natural resources. At the Committee's option, these other programs would include but not be limited to: (1) Upland and wetland habitat preservation and creation. (2) Natural shoreline restoration. (3) Wetlands restoration to include fresh water and marine systems. (4) Purchase of properties for preservation of unique ecosystems.
