SPECIAL TOPICS 1. ,County Environmentallnvcsligutions " Mr. Miller introduced Detcctive Ankenbauer who is with Pinellas County. Dctective Ankenbaucr 'informed mcmbers of his background and education. There are lwo investigators in Ole Pinellas area. Detective Carlson, who is under contract with the solid waslc and assigned to land fill, and nIl littering cases, and Detective Ankenbauer who handles criminal investigations. A brief description was presented regarding the variety of complaints (cilizens and DER), procedures and volume of cases that Dctective Ankenbau~r handles. The County is in the process of starting a year round drop off station, for. household har.ardous waste. 2. City Regulatory Enforcement Stutus . Mr. Mike Quillen was introduced by Mr. Miller. He briefed the commiUee on the active enforcement cases tbat , the City is involved in. He'dispussed the Clcarwater Chemical Company and the problcms encountered while inspecting the site. The present active enforcement cases mainly involve wetlands, such as mangrove cases; The City works in conjunction with the cQunty. Mr. Quillen went into detail on the Oceohi case. Violators were met on site and tlle property owner \\111 be required to return the site to its original condilio~. Mr. Hunt expressed the committee's concerns of landscapers not being aware of rules governing the prote,ction of Mangroves, etc.. A discussion followed regarding various methods that can be used to educatc'the public. Ms. Garris suggested a questionnaire be given to contractors by the County/City, as a: pre~requisite prior to r,ecciving Hcenses. Ms. Garris suggested having an ordinance where the contractor would be liable for fines, as well as losing their license. B. GENERAL TOPICS 1. Commission Actions Mr. Miller distributed a copy of the City Commission Goals a'nd PoliCies Manual to each committee member. Mr. Miller also notified the committee members of an invitation from the City Manager, ~xtended to members of EAC to attend a presentation on financial forecasting. 2. Other Mr. Miller presented committee members copies of the new organizational management program. explaining the changes that had' occurred. III. SUnCOMMITI'EE STATUS REPORTS A. Wastewatcr Reusc No comments B. Watershed Management Mr. DcBlaker discussed the EPA Meeting he attended on February 14,1992. Mr. DeBlaker ' also notified committee of the meetings held with King Engineering On the statns of the Stormwater Watershed Management. C. Publicity Ms. Garris expressed her apprecilltion of Ms. Donovan's assistance offer. A discussion followed about Mr. Hunt's memos not being received by city commission. A motion was mmle by Mr. DeBlnkcr that the Chairman makc a summary statement and forward it directly to the City Commission with copies to Environmental Managemcnt (current month summary Allnchment A). This was seconded by Mr. Reuter. All in favor,molion carried unanimously. I). Regulatory Enforcement " A discussion was held on recycling, and what assistance the EAC Committee can provide. It was recommended thnt the Wnstewater Reuse and Legislation Subcommittee supply Ii list of items that the Environmcntal Advisory Committee is specifically interested in seeing what the legislature cim improve upon. This then will be fonvardcd to thc Chairman of the PineUas Legislativc Delegation, requesting the chairman to address recycling concerns, of the' Environmental Advisory Committee. Mr. Foley felt that the EAC committee should be notified of any new environmcntal ordinances written by the City, when in the draft stage. A subcommittee can then review the ordinance. Foley expressed interest in ordinances dealing with code enforcement regarding pollution. Mr. Foley asked Mr. Miller whether there was a police officer available who was versed in environmental crime enforce'ment. Mr. Miller stated he would investigate this malter. Ms. Donovan suggested that Environmental violations should be brought to the attention of the Policc Dept. E. Orgunizution/Budget " Mr. Jonson and Mr. Miller held it meeting on Murch 31, 1991. Mr. Jonson slated that the , tentative budget for Environmental Management Department and Stormwater Utilities were reviewed. Mr. Johnson also discussed the stormwater utility revenues and expenditures, and expressed his concerns on liJ:nited revenue for water quality improvement funds. Discussion was held on how to ,prioritize items. Mr. Perry recommended that EAC attempt to create priority list of desirable projects.' Mr. Hunt requested the Committee's concurrence with his presentation on the topics to be considered in the next 8 months. Mr. Hunt noted that some of the items set as goals by the Commission have already been addressed by the EAC. A discussion ensued including some The committee also discussed the difference between NPOES and the Comprehensive Watershed Management Plan. Mr. Jonson stated that issue is still opened, and also that the committee needs to be aware of what is happening in the city budget. Rice, Deputy city Manager Subject: Creative Loafing1s April 8 - April 14, 199~ article entitled "Cleanup or Coverup?" by Claude Kennedy Date: April 10; 1992 The article "Cleanup, or Coverup?'1 in Creative Loafi~g by Claude Kennedy (attached) stated the three lots on Plaza Street in North Greenwood .the City donated to Pinellas County Habitat for Humanity are contaminated with toxic waste! The' city did donate three lots on Plaza street to Habitat for Humanity for the construction of three houses for the working poor. These lots are shown on the attached map as lots 5, 7 and 8 on Plaza street between Vine and Pennsylvania. Habitat for, Humanity is an ecumenical, Christian out-reach organization that builds houses for 'the working poor. All labor and materials are donated gifts and the mortgage generally runs about $150 per month. Habitat built three houses on North Missouri Avenue last year. ,The. article stated that these lots were contaminated with toxic wastes from the city's old Fleet Maintenance Facility. These buildings now house the City'S Parks and Recreation Department1s Parks Division and Recreation Facilities Division. In 1988, fhe Fleet Maintenance facility was qualified for the state' 5 Early Detection Incentive (EDl) program based on the fact' there were underground gas and diesel tanks on site. The city proceeded to pump out the tanks and fill them with concrete slurry. Tests performed at that time showed there was underground pollution from the underground tanks. The underground tanks that were filled and the five test wells are shown on the attached map. The 1988 table included in the Creative Loafing article is only accurate in that it includes the test results from 5 test wells submitted with the city's application for the EDl program. However., the' data in the table for wells 4 and 5 are transposed. Most significant is that the underground pollution was on the western most portion of the Fleet Maintenance Facility at test wells 4 and 5. The ground water flow is to the west or away from the Habitat lots (See attached map). Therefore, the pollution that existed in 1988 could not have polluted the three lots given by the City to Habitat because the ground water flow was away from,the lots. '- .' 'I , ,i". ... This is not truel This underground pollution has not contaminated the city's drinking wator. The Pinellas County Public Health and Engineering Division has conducted a drinking water survey. No municipal or private 'potable drinking water wells are located within an one-half mile radius of ,the old Fleet Maintenance Facility! In fact, no ,municipal well is within several miles the old Fleet Maintenance 'Facility. I authorized the hiring of Imperial Testing Labs to perform soil borings and ground water tests. They used several tests that tested for diesel and gasoline constituents. Both the soil and ground , water were tested by using 6 soil borings and 6 wells. The tests were performed on March 2, ,1992 and the lab'tests March 3 and 4. A report to the city was completed and received on, l1arch 11 that showed 11 and, showed all petroleum constituents were below detectable limits (bdl). The test results are attached. Please note that ,the article made, a significant issue' in the analysis of behzene. The city's test showed no benzene. Tha results of these tests show that the lots the City gave to Habita~ for new housing are not contaminated. city staff did discover an underground' used oil tank in the alley between the houses and the old Fleet Maintenance Facility. 'This tank is scheduled for'removal by mid-June. This tank has not p~oduced any detectable contamination. The facts are that the land the city gave to pinellas Habitat for 'Humanity is not contaminated. These are the regulations regarding the subdivision of land (City Code Chapter 133) and the regulations regarding other site development not involving the subdivision of land (City Code Chapter 137). Chapter 133 provides stormwater diain~ge requiremen,ts which allow the City control over discharges to storm sewers; including review of all discharges from ,industrial sites which' are created through the subdivision of ,land. Chapter 137 supplements these storm drainage requirements and applies them to all sites, including industrial, which are undergoing development. The review process implemented as a result of these Chapters includes City of CI~arvlater Environmental Group review of water quality , , concerns. DESCRIPTIONS OF AUTIlORITIES Legal authorities to control the contribution of pollutants to the municipal storm sewer system are inte'rspersed throughout the City's Co~e. City Code Chapter 133 governs subdivision of land. Under Section 133.004, whenever land within the City is subdivided, a plat must be recorded. An adequate stonnwater drainage system designed by a Florida registered engineer compatible, with the City master drainage plari, and subject to approval by the city engineer, including necessary open ditches, retention/detentiot1 areas, pipes, culverts. bridges, intersectional drains and drop inlets, shall be provided for the proper' drainage of all surface water. Submission of design calculations shall be required by the city engineer. 2. ' Lots s~all be laid out so as to provide positive drainage away from all buildings and individual lot drainage shall be coordinated with the 'general storm drainage pattern , for the plat. Section 133.033 requires filing of construction plans, including storm drainage system plans, for any area to be subdivided. The sampling program was not designed to depict ac~rate seasonal characteristics. For each year of the program, any given site may have been sampled monthly (12 times) for one year, while for other years the site may have only been sampled a few times or not at all. This somewhat sporadic temporal sampling pattern, nevertheless. includes enough data points for each location such that a summary of water quality in these water bodies was provided by calculating the mean, maximum and minimum values for the entire period of record. These data are tabulated in Appendix B. Guidelines have ,'primarily been developed by the Southwest Florida Water Management District (SWFWMD) as administered locally by the Pinellas C~unty Department of Environmental . . , Management. In addition to ~WFWMD requireme~ts, the City of Clearwater Department of Public Works bas published its own manual for storm drainage design criteria. The various state, county, and municipal. agencies and/or departments that have' programs pertinent to the City of Clearwater are outlined below. I J ! FLORIDA DEPARTMENT OF ENVIRONMENTAL REGUlATION (FDER) The Florida Department of Environmental Regulation adopted Floridats State ~ater Policy (Chapter 17-40 F.A.C.) in 1991 which was created to clarify water policy as documented in Chapters 187,373, and 403 of the Florida Statutes and to provide guidance to the Florida Department of Environmental Regulation and State water management districts in rule and , , plan developments. A wide variety of water felated policies were promulgated in this Chapter including several policies related to stormwater quantity and quality. " Included in the general policies, for example, are those related to the 1) preservation, restoration, enhancement of management systems, and discouragement of' natural watercourse alteration; 2) protection of wetlands, floodplains, and aquifer recharge areas; 3) establishment of minimum flows ,and levels to protect water resources and the ecology of marine, estuarine, freshwater systems; 4) floodplains management; 5) construction and management of stormwater control structures; and 6) restoration and protection of ground ' and surface water through stormwater and wastewater treatment. 5~1 ,t .:~" .f'r' . Prior to the promulgation of the State Water Policy, the guiding state regulation related to stormwater management was Chapter 17M25, FAC, otberwise" known as the State's, Stormwater Rule. Adopted in 1982! the State Stormwater Rule set forth design and perforinance standards for both quantity and quality aspects of the stormwater management problem. As such, Chapter 17-25, FAC, was one of the first state regulations adopted nationwide to address water quality impacts from stormwater runoffs. Pursuant to Chapter 17-40, FAC, the State Stormwater Rule is scheduled for revision in 1992 to accommodate , more recent concepts on water quality management. soUTIIVIEsT FlORIDA WATER MANAGEMENT DIS1RICf (SWFWMD) , The Florida Department of Enviro'nmental Regulation bas delegated to tho, SWF~MD, to the maximum extent practical, surface water permit programs as well as stormwater regulation authority, pursuant to Chapter 17-25, F AC. The District requires a permit for all impacts to wetlands or construction, alteration or operation of dams, impoundments, reservoirs, appurtenants works or work as defined in the Plorida Water Resources Act of 1972 (Chapter 373, Florida Statutes). Permit applicants must obtain an individual, general, or noticed general permit. Chapter 40D~4t F.A.C., documents, the individual permit specifications for construction, alteration, or operation of surface water management systems. Chapter 40D-40 further documents the requirements for a general Of noticed general permit. General permits address both water quantity and quality and can be issued for upland projects from 10 to 100 acres in total size. General permits also apply for works serving public highway projects using state, federal, or local government funds. I . . " , " ( PlNELLAS COUNTY DEPARTMENT OF ENVIRONMENTAL MANAGEMENT (PCDEM) In February, 1990, the SWFWMD 400-4 and 40D-40 permitting authority in Pinellas County was delegated to the PCDEM. PCDEM, therefore, administers the SWFWMO 400- 4 and 40D-40 permit programs for any works within the City of Clearwater. ' CITY OF ClEARWATER DEPARTMENT OF PUBUC WORKS All stormwater systems within the City of Clearwater must not only comply with SWFWMD design criteria, but also must comply with those criteria more restrictive than SWFWMD specifications that are documented in the City of Clearwater manual of ,Storm Drainage Design Criteria. This "Design .Criteria" manual has been incorporated into City 'Code 'Section 137.01 by City Ordinance 4776-89 (3~16-89). A copy of the manual is inc1udedin Appendix C. Stonnwater permits are reviewed by both Engineering and Environmental Groups within , the City of Clearwater Department of Public Works. Permits are reviewed for attenuation aspects by the Engineering Group and for water quality, wetland, and upland preservation concerns by the Environmental Group. 5.2 FLOOD CONTROL PROmCfS , . Publicly owned organizations were contacted for information regarding any flood control projects that have been completed or are being conducted within the City limits of Clearwater. CITY OF CLEARWATER ,The Stevenson Creek Project is the only Flood Control Project conducted by the City of Clearwater. This project was initiated by trye Public Works Department, at the direction of the City Commission, after flooding damage occurred to residences along several reaches 5~3 ", "} , , I'> ," " ' I, (- of the creek. Phase 1 construction is currently underway. The remainder of tlle project is currently going through the permitting process, and construction is anticipated to begin in 1993. FEMA REPEITnVE LOSS PLAN The City of Clearwater ,has experienced several floods since 1978 resulting in private , , property dam~gc. According to the National Flood Insurance Program (NFIP), the City.of Clearwater has nineteen (19) repetitive loss properties. By defInition, a' repetitive loss property is one for whi~h two or more NFIP losses of at least $1,000 each have been paid since 1978. The repetitive loss properties are mainly concentrated in three (3) areas: Coastal Communities~ and areas adjacent to the streams within the Stevenson Creek and Alligator Creek drainage basins. These three (3) areas have been designated by the Federal Emergency Management Agency (FEMA) as being floodprone and have been assigned flood elevations. Two isolated properties (properties outside of designated floodprone areas) have also been identified as repetitive loss sites. The City of Clearwater, Florida, submitted a partial Repetitive Loss Plan application, in accordance ~th FEMA Regulations, on December 14, 1990. During the year,of 1991, the City has prepared this effective Repetitive Loss Plan. Pinellas County voted to allow the collection of an additional 1 cent sales tax (effective February 1, 1990) for the purpose of paying for capital improvements. This source of CIP funds will he available for 1.0 years. Each city, including Cleanvatert is receiving a fair share of these revenues to help fund their respective ClP programs. Table 6-1 shows that about 35% of the City of Clearwater's Stormwater Management budget for FY 1991/92 is expected to be funded by the "Penny for Pinellastl tax. '6-1 ' . STORM SEWER SYSIEM MAIN1ENANCE . , The City of Clearwater Public Services Department established a Stormwater Utility Section in January 1991. Since that time every major stormwateT artery (ditch, creek, stream, etc.) has been inspected arid cleaned as appropriate. The City is currently performing the , , , necessary cleaning and grass trimming to properly maintain ditches. No scheduled cleaning of the storm system is currently performed, however, crews are available to respond to problems as needed. In additi(:m, catch basins are cleaned as necessary, and known trouble spots in the storm drainage system are checked each week. EROSION CONTROL The City of Clearwater has produced a document of Erosion and Siltation Control Policy. The document states erosion and siltation control s~andards a~d procedures that apply to all physical improvement projects which are subject to the rules and regulations of ~he City of Clearwater Public Works Department. SIREET SWEEPING , The City of Clearwater street sweeping program currently includes 81 identified arteries and 24 parking lots (list included in Appendix C). The City of Clemwater Public Services Department currently sweeps 21 major arteries once per week on average. In addition to the roads swept by the Public Services Department, a private contractor sweeps roads and parking Jots in downtown and beach areas (see Appendix C) two ~nd three times each week, respectively. The street sweeping program provides excellent coverage within the boundaries of the City. Major arteries covering nearly the 'entire limits of the City are periodically swept. Most major and minor roads along the bea~hes are also swept. RECYCLING The State of Florida regulates "solid waste,tt which is defined in Section 403.703(13), Florida Statutes (1988 Supp.), and includes virtually all waste materials, including certain liquids and gases. In 1988, the Florida Legislature adopted the Florida Solid Waste Act (formerly Senate Bill 1192 and Cbapter 88-130, Laws of Florida) and by doing so established the first comprehensive approach to solid waste management an~ disposal. This Act constituted a major revision of Part IV of Chapter 403, Florida Statutes. The 1988 Act encompasses a wide range of issues and establishes many new regulations governing' the handling and disposal of solid waste. The Act includes a provision for mandatory local recycling programs which must reduce the volume of solid waste by 30% by 1994. The City of Clea~ater has established a comprehensive recycling program designed to attain the 30% solid waste volume reduction goal by 1994 set by the State of Florida. The 5-17 ~ ~ ,,' ~~' > . City of Clearwater's Solid Waste Division has distinguished nine ~rogram components to recycle newspaper, yard waste, glass bottles ao,d jars, corrugated cardboard, scrap metal and used appliances, steel cans, office paper, plastics and aluminum. Compo'nents range from curbside pick-up in residential areas (about 1,270 homes), yard waste conversion to mulch, to a series of eight dropoff centers conveniently located to serve the community. Detailed descriptions of the City's recycling program cO,mponents'is in Appendix C. , PUBUC EDUCATION The City of Cleanvater's Environmental Group has produced and disseminated a pamphlet to the general public regarding information to reduce pollution and aid in maintaining and restoring the aquatic environment. The pamphlet offers advice on limiting surface runoff, keeping surface runoff clean, and maintaining and restoring the native vegetation and natural slope of the shoreline. In addition, the City's Solid Waste Division distributes information to the public on recycling used oil, household hazardous waste, used tires and automobile batteries. INDUSTRIAL INSPECTION.. ILUCIT CONNECTION DETECTION The City of Clearwater currently does not have a pro-active industrial inSpection program. The City will respond to compliants with field inspections and testing' as necessary; such as dye tests, to trace sources. HAZARDOUS MATERIALS The City of Clearwater's Environmental Group within the Department of Public Works is currently developing and implementing policies for hazardous waste handli,ng, storage, and di~posal that are consistent. with State and County requirements. I , (' POllUTANT STORAGE TANK MANAGEMENT The City of ClearWater's EnVironmental Group within the Departme'nt of Public Works is currently developing a Pollutant Storage Tank Management Program in order to' comply ,with all F<;deral, State, and loca11aws. One of the expected results of this program will be to prevent pollution of the City of Clearwater surface water bodies 'and storm'water system. SPILL CONTINGENCY PlAN " , The City of Clearwater's Environmental Group within the Depart~ent of Public Works bas "developed a Terminal Spill Contingency Plan for the City of Clearwater Municipnl Marina. ~e plan was designed to comply with the requirements for the Department of Natural Re'so~~es Spill Certificate under Chapter 16N~16 FIorida Administrative Code.'
