AGREEMENT

TIllS AGREEMENT made and entered into this '11 day of July,
1979, by and between the CITY OF CLEARWATER, FLORIDA, a municipal
corporation hereinafter referred to as "City", and ROY J . AYRES, of
Clearwater, in Pinellas County, Florida hereafter referred to as the
"Director"
WIT N E S8, E T H
WHEREAS, the "Director" has developed and perfected an "Energy
Code Short Form" which form has been copyrighted by the "Director"; and
WHEREAS, the State of Florida has adopted an Energy Code effective
March 15, 1979, under the terms of which legislation all cities in the State of
Florida are subject to the terms, provisions and regulations of such Energy
Code; and
WHEREAS, the "Energy Code Short Form" perfected by the "Director'!
precomputes for single family and duplex residences various requirements
which all builders must comply with in order to meet requirements set forth
in the State of Florida Energy Code; and
WHEREAS, the "Director" desires to make such form available for
City use in implementing and enforcing the new Energy Code;
NOW, THEREFORE, in consideration of the sum of One ($1. 00)
Dollar and other good and valuable considerations the parties to this agreement
do hereby agree as follows:
1. The !!Director'! does hereby agree to assign, set over and transfer
to the "City" the Energy Code Short Form which has been developed and
perfected by him.
2. The "Director" further agrees that the "City" will pay no other
sums of money to the "Director'! other than those amounts set forth herein
as consideration for the transfer of the copyrighted Energy Code Short Form
to the "City".
3. The "City" may, at its option, permit the use of the Energy Code
Short Form by other cities situated in Pinellas County, Florida. It may also

permit the use of such form by the Pinellas County government. In no
event is the Energy Code Short Form to be made available by the City to
any other City government or county government within this state without
the written consent of the "Director".
4. This Agreement is not meant to abrogate in any way the
Public Records Act.
IN WITNESS WHEREOF, the parties hereto have caused this
Agreement to be executed the day and year first above written.
