to consider the-following requests:
1. 430 South Gulfview Blvd. (Adam's Mark Caribbean Gulf Resort) - variance from
Chapter 39, Coastal Construction Code, for construction of a tiki bar within-
18 feet of the seawall.
2. 2950 Glen-Oak Avenue (Friendly Village of Kapok), Lot 519 - variance from
City of Clearwater, Code of Ordinances, Section 146.008 (b) (1), for a
finished floor elevation of 1618" in lieu of the required 181, for a-total. '
variance of 114".
3. 2950 Glen Oak Avenue (Friendly Village of Kapok), Lot 554 - variance from
City of Clearwater, Code of Ordinances, Section 146.008 (b) (1), for a
finished floor elevation of 14'7" in lieu of the required 18', for a total
variance'of 315". '
4. .1140•Mandalay Point Road (Harrison) - variance from Chapter 39, Coastal
Construction Code, for construction of a screen enclosure within 18 feet
of the seawall.
5. 3130 Gulf-to-Bay Blvd. (Marathon Petroleum Co.) - variance from,City of
Clearwater Flood Control Ordinance, for a finished floor elevation of 8.69 feet,
in lieu of the required 10.0 feet, for a total'variance of 1.31 feet.
Florida Statute 286.0105 states: Any person appealing a decision of this Board
must have a record of the proceedings to support 'such an appeal.
Citizens may appear to be heard or file written notice of approval or objection

' -Chairman Logan called the meeting to order at 1:55 p.m. rive-cases on the agenda to
be heard.
430'South Gulfview Blvd. (Adam's Mark'Caribbean Gulf Resort) - requesting a variance
from Chapter 39, Coastal Construction Code, for construction of a tiki bar within
181eet of a seawall; and•a variance from the City of Clearwater Flood Control
Ordinance for a finished floor elevation of G.76 feet.
Representatives:
'Ramon ' Gomez, General Manager, Adam's blark
Paul Hackler, Chief Engineer, Building Services Manager, Adam's.Mark
Mr. Gomez presented the case stating that October lst they had a structure on the
tiki deck burn down by what is believed to be arson.. The applicant is asking to
reconstruct it within inches of what the existing building was. It was a bar to serve
the outside deck. The variance requested is for two feet. The existing'tiki fleck that
was built was 16 feet from'the seawall and 18 feet is required,-for a variance of two
feet so it can be rebuilt as it'was.
Discussion ensued that there was a prior variance granted when the structure was t
destroyed in, Hurricane Elena.
Further discussion ensued'about the floor elevation and it was determined that a
request for a floor elevation variance needed to'bd added to the application.
It was determined from the flood zone map that the applicant's elevation is 14 feet,
Zone V15, and that a variance of 6.76 is required.
Mr. Straub asked if there were plumbing fixtures in the bar. It,was determined'that
the area is like a small kitchen without cooking, with blenders, soft-serve ice cream
machine, cash registers, etc.
Mr. Onufer'stated that the variance had been given once before because it had to be
rebuilt. Mr. St. Jean mentioned a question if the City Ordinance says that if there
is a-loss through fire or hurricane that they retain.their rights, blr.'Onufer said
that he.did not think that was correct but that he would check into it. Mr. Walker
stated that he thought that pertained to the Zoning Ordinance. Mr. Onufer stated
that whenever there is a natural, disaster, the houses c' nr?ot be built back the way
they were, they have to be built up higher.

Mr. Logan mentioned the seawall tiebacks, and Mr. Gomez stated that they will continue
the process of maintaining the tiebacks.
Mr. Onufer stated that he had no objection as long as proper drawings'with the
engineer's seal are provided.
Motion made'by Member St. Jean, "Mr. Chairman, with rogard to the request for variance
from the Flood Insurance Regulations for a structure located at 430 5outh'Gulfview
Blvd., the Board finds it within its authority to act upon the request and hereby
grants the requested variance with the following conditions. That the variance include
a 6.76 flood elevation variance as well.as'replacing the structure in the same size
and shape as was in the original drawings." Motion seconded by Member Straub. Motion
carried unanimously'- variance granted.
2950 Glen Oak Avenue (Friendly Village of Kapok), Lot 554 - variance from City of.
Clearwater, Code of Ordinances, Section 146.008(b)(1), for a finished floor'elevation
of 1417" in lieu of the required 18.5' for a total variance of 3'11".

Representatives:
Joseph Papp, Resident Manager,'r.epresenting the owner's of the Park
Rita Sidenberg, Assistant Manager of the Park
Applicants explained that Lot 519 is the vacant lot that they have bought a mobile
home themselves to put on that lot. The other lot is a lot that they are hoping to
rent. It was stated that there have been mobile homes on those tots but there are
not any there now. They do not know what size home will go on Lot 554, they are.
just hoping to be able to get a variance so that they can rent the space out without
the people having.to come before the Board to get a variance in order to get a permit
.to move the'mobile home in there.
Discussion ensued about the addendum to the latest FEMA.regulations where they
delayed/suspended the mobile home requirements. Mr. Onufer stated that the ordinance
says•that they have to build to the new elevation or get a variance. The ordinance
hasn't changed so they have to come in for a variance. These are being permitted
but,the applicants are being advised that if they go down to a lower elevation, they
may be impacted with insurance whenever FEMA changes their mind about this again.
Discussion ensued about the flood elevation. It was stated that there was flooding
in,this area years ago, and that there are now retaining ponds there and a pump to
alleviate the problem. This park also has'pumps.
Further discussion ensued about flood insurance. It was determined that mobile home
owners generally carry flood insurance. Mr. Onufer stated that in the future flood
insurance may no longer be available through FEMA for mobile homes.

Mr. Onufer also stated that. pilings would be required in'addition to the proper tiedowns.
Motion-made by Member St. Jean, "Mr.. Chairman, with regards to the request for variance
from the Flood Insurance Regulations for a mobile home located at Lot 554, Glen
Oaks Drive'(Avenue)', Clearwater, the Board finds it within its authority to act upon
the request and hereby grants the variance with the following conditions: That
the variance reflect the language cited in the application." Motion seconded by
,Member Straub. Motion carried unanimously - variance granted.
Second motion made by Member Straub, "Mr. Chairman, with regards to the'request,for
a variance from the Flood Insurance Regulations for a structure (mobile home)
located at 2950 Glen Oak Drive; Lot 519, Clearwater, Florida, the variance request
is for 1110",'and that the.people be apprised of the possibility of problems with
their flood insurance if the suspension of FEMA regulations is lifted." Motion
seconded by Member St. Jean. Motion.carried unanimously - variance granted.
1140.Mandala Point Road (Harrison) - variance from Chapter 39,,Coastal Construction
Code, for construction of a screen enclosure within 1.8 feet of the seawall. .
Representative for Mrs.'Karla Harrison:.
Nelson Simmons, General Contractor.
Mr. Simmons presented the case stating that Mrs. Harrison has a 150-foot lot on one
side and 118 feet on the other, and when they built the seawall, they cut off 40 feet,
so she's working on about 100 feet on one side and 90 feet on the other, ,and everything,
is.jammed between the street and the seawall. She bought the residence with General
Harrison in.1954, and in-1959 they built an addition on the south and, and they built
the screen enclosure in question with a bedroom, bathroom, and in the front a
Japanese--type garden. This is a very integral part of her bedroom; it's all glass,
she looks through the screen enclosure right out onto the gulf. It is made out of
wood, and it has been repaired and maintained for the last 20 or 25 years and they
have repaired,it to this point. It has rotted now and it has to be replaced with,
Mr. Simmons suggests, aluminum, or wood. Ile wants to take down everything to the
existing floor and footings and build back up and replace the two wood beams for
,structure and 8-foot roof in the back, and wood louvers. Otherwise, it will all, be
aluminum. Mr. Simmons stated that he has examined the foundation and what they are
putting on is lighter than what is presently there so there will be. no weight problem.
The only problem is the distance from the seawall; she is approximately six feet
from the inside of the seawall`, and at the center she is about 6 1/2 feet on one end.
She has two screen enclosures there, but the other has been kept in better repair.
The original screen enclosure was built before the ordinance and now a variance is
required to rebuild it.
Discussion ensued about the seawall. It was stated that it is about 250 feet from
the structure to the water. Mr. Simmons stated that the,seawall was'put in in 1935
or 1936. The sand is now only a foot below the cap. Mr. Simmons stated that there
have been no major washouts in the area of the seawall and that the seawall is not
deteriorated too badly.

Chairman Logan called for a motion. Moti.on.made by Member Walker, "Mr. Chairman,
with regards to the request for a variance from the Building Code for a structure
located`at 1140 Mandalay Point, Clearwater, the Board finds it within its authority
to act upon the request, and hereby grants the requested variance." Motion seconded
by'Member Straub.
Chairman Logan called for further discussion. Mr. St. Jean asked for an amendment
to the,motion to indicate that-the'Y:equest is for a?replacement screen enclosure,
in aluminum." No'further discussion.
Motion carried unanimously -'variance granted.
3130 Gulf-to-Bay Blvd. (Marathon Petroleum Co.) - variance from the City of
Clearwater Flood Control Ordinance; for a finished floor elevation of 8.69 feet,
in lieu of the required 10.0 feet, for a total variance of 1.31 feet.
Representative: Brent Marshall, Marathon Petroleum Company
Mr..Marshal presented the case stating that the Company is developing a piece of
property on Gulf-to-Bay Blvd. just before you go over the causeway at-3130 Gulf-to-Bay
Blvd. Presently, there is a Hudson Oil Station there that has been closed and his
company has bought the-property.' The civil engineer that did the site layout for the
work used the existing elevation as best he could to come up with a drainage plan
that will meet the state's requirements, the city's requirements, 5WFMD's requirements,
and they have a 2400-square--foot, concrete blocl: building, that if .they meet the
existing minimum flood 'elevation of the building for the finished floor, it will be
setting about three to four feet higher than all the surrounding property. Also,
where the'customers would park to pull up to the building, working with the drainage,
grading, and such, the slope would exceed five percent,'which would cause an
inconvenience for pedestrian traffic.
Discussion ensued about interpretation of the code. Mr. Marshall stated that he
intended to floodproof the building,, and Mr. Onufer stated that a variance would still
be required. Further discussion ensued about interpretation of the code. It was
determined that a variance has been required in the past for similar circumstances as
this. It was further determined that floodproofing is required in order to meet the
criteria for permission of a variance. Mr. Marshall mentioned that there is also
a kioske on this site, and asked if that structure would also be included in the
variance; it was determined that it would be included.
Motion made by Member Walker, "Mr. Chairman, with regard to the request for a variance
from the Building Code fora structure located at 3130 Gulf-to-Bay Blvd., that.the
` Board finds it within its authority to act upon the request and hereby grants the
requested variance with the following conditions:, That the request will also include
the kiaske'as shown on the site plan and that the buildings must be floodproofed in
accordance with Chapter 39 and FEMA's requirements to an elevation of 11 feet.
Motion seconded by Mr. St. Jean. Motion carried unanimously » variance granted.
