Chairman Logan called the meeting to order at 2:03 p.m. Two cases
on the agenda to be heard.
612 Harbor island (Carpenter) - requesting a variance from Chapter 391
,
Coastal Construction Code, for construction of a swimming pool within
18 feet of a seawall.

Mr. Shields E. Clark, past president of West Coast Engineering} Corp.,
presented the case. Mr. Clark stated that he specializes in seawalls
and repair of seawalls. Before work was started the owners were
cautioned'as to maintenance of the seawall, etc. A filter system was
installed, and all of the.tiebacks and rods were examined.
Mr. Sam Kirkland inspected the seawall and stated that the entire area
of the seawall was exposed. They found that there were no structural
horizontal cracks in the panels. They also exposed the seawall tieback
rods into the cap. The cap was also in very good condition. No
structural cracks, other than'a few cracks perpendicular,to the house
that could be associated with stress in expanding of material. The
tieback rods are in excellent shape; they are encased in PVC. They
went back to the anchor system, whichlYsetting back approximately 19.
feet, and they are down approximately 5 or,6 feet, and they are in
good shape. They then put i.n•a drain system which was designed by
West Coast Engineers, which encompasses a 4-inch PVC perforated pipe;
'it is then wrapped in filter cloth material,.adapting down to 2-inch
PVC pipe which comes through the wall. They feel'that this will release
any hydrostatic pressure-that develops behind the wall, and with all
other variables being as they are and from what they found with their
survey, they see no problem with the wall.
Mr. Clark discussed the fact that he had previously discussed the
matter with Don Beachler in Engineering, and was not aware previously
that he would have to appear before the Board.

Mr. Schields explained that they are using the seawall as a deadman,
and it will be an integral part of the.pool deck. They are placing
the pool'so that they have a crack-free, reinforced-slab, which will
take the wave wash, 'which will run back into the water when the waves
fall upon the slab. The wave wash that is captured in the other areas
will go down into'the filter system. These precautions should provide
about 35 years without any particular problems withthe seawall.
Mr. Nicholson stated that the work that was done after discussing the
matter with Don Beachler did not require coming before the Board.
Further discussion ensued that the matter before the Board, is the,full
18-foot encroachment because the slab goes all'the.way to the wall.
Further discussion ensued about the location of the tiebacks into the.,
deadman and how new rods would he spliced in if the rods should rust.
Mr.. Clark,explained the procedure they would use: Bore a hole.through
the seawall, put a square plate with a bolt, and tie that around 'a
piling so that it can't rotate out. 'Furthe,r discussion ensued about the
replacement of piling and deadman and the procedure to-be followed.,
Discussion ensued that the owner was aware that provisions must be made
for maintenance of the seawall. Discussion ensued that a security
system was also installed for. the safety ?of children.
Chairman Logan called for a motion. Motion made by Member Nicholson,
"Mr. Chairman,' with respect to the application of Dr. and Mrs. Jay
Carpenter'; 612 Harbor. Island, for a variance to construct within 18
feet of a seawall, that this Board has jurisdiction, and the item
is covered under Chapter 39, Coastal Construction Code, of the Building
Code, and I further move that this Board grant t'he,variance for a deep
structure no closer than'6 feet from the wall, but a'variance of the
full.lB feet to allow the decking to reach to the seawall cap."
Discussion ensued about the dimensions, and'Mr. Nicholson stated that
'the motion reflects the.dimensions represented to the Building Department..
Motion seconded by Member Walker, Motion carried unanimously. Variance
granted.
14 Midway Island (Rubin) - requesting a variance from Chapter 39,
Coastal Construction Cade, for construction of a swimming pool within
18 feet of.a seawall.
Mr. and Mrs. Rubin were present and provided sketches to the Board for
review. Mr.,Rubin stated that the property is too narrow to install
a pool unless it encroaches into the 18'foot setback. He stated that
they had. this checked by an engineer and 'if any more 'deadmeri`are
required, they will be installed'.

The Board reviewed the drawings and the engineers drawings'. 'Mr.
Rubin stated that they required the pool for health reasons also.

Mr. Nicholson explained that the purpose of the Board was to discuss
the provisions of the code and to help the applicant better work with
the'contractor, etc. Discussion ensues] that the code requires the
18'-foot setback•for maintenance,of the seawall, and that a filter
system is required on new construction. Discussion ensued that the
engineer involved'in the. case has experience.with this type of
construction. Discussion ensued that the deck be constructed so
'that it could be broken away cleanly without having to break up
too much of the concrete In the event'that it would have to be
removed for repair of the tiebacks. i
Mr. Logan stated that this was similar to other cases heard by the
'Board and that the engineers report was proper,,and that as long as
the City Engineering Department approved it, it would be approved..
Member Nicholson made the motion: "I would move that the request,`
for variance from'Mr. Saul Rubin, 14 Midway island, to accommodate
construction of,a'swimming pool in his back yard, it'is'within the
jurisdiction of this Board to'rule on the matter, that it is
covered under Chapter 39, of the Coastal Construction'Code, of the
Standard Building Code,.and. I move that a variance be authorized,
fora 6-foot encroachment for the deep structure, the swimming pool
shell, and a total of a-10--foot encroachment, the 4.extra feet being
for a surface'structure, the decking, and that that be granted, subject
to Engineering.involvemezit in the anchor system of the seawall on
th'e proper modifications of the seawall anchor system to be consistent
with the provisions of the code for maintenance of the anchor system."
Motion seconded by'Mr. Straub. Motion carried unanimously. variance
granted. Meeting adjourned at 2:301'p.m.
