from the provision of TiUe 44, crR... Sections "'60.3, 6B.4, and 60.5, the
followin; general stariiards have been es tabl1shed in Section 60.6 (a):

The NFIP variance criteria are based on the general principal of z:onin] law
'that variances 'pertain to a piece of property aOO ~ not personal in
nature. '!hough stan:3ards vary fICIn State to State, in general a properly
issued variance is granted for a parcel of pr~rty with Fhysical
characteristics so unusual that oorn;?lyiog 'With the ordi.nan.ce ....ould create an
exceptional hardship to the applicant or the surrourxling property or.mers.
Those characteristics lUSt be unique to that property and 'not be share:] by
ldjacent parcels. IIJ:he unique characteristic :a:wst pertain to the lam
itself, not to the structure, its inhabitantS, or tJle property owners. A

elevate the house on fill, the lot might drain onto the neighbors' property.
In this case, the size of the lot am 1 ts sta tus as the only wi1eYel~ lot
in the vicinity are the characteristics, that could reStllt in a hardship.

there are many other ways to alleviate the drainage problem (elevation on

applicant's hardship against the purpose of the ordinance. In the case of
variances from a flooj elevation reqJir~nt" this W'OUld nean aSKin; which
is more serious: the hardshiE that this irrlividual' applicant would face, or
the COitIl\I.lJlity's need for str icUy enforced regulations that protect its
citizens fran the dangers am dama-3es of floodi.n3? Only a truly
exceptional, unique hardship on the part of an' Wividllal prcp2rty would
j;ersuade local officials to set aside provisions of an ordinance designed

thousand dollars IlOre to elevate a house to CCWtply with t.he ordinance ard an
additional several thousand to build a wheelchair ranp or an elevl!tor to
provide liCcess to that house for a han:3ica~ Jnember of the family might at .
first glance seem like the sort of problem that could be relieved by a t
variance. However, whil~ financial considerations are always important to
property CMle.rs aOO the needs of the han::3icapped person certainly D..1St be
aCCCJulliXlated, these difficulties ~o not put this situation in the category
of -exceptional hardships. as they relate to variances. 'Ibis is bec4use,
first, the characteristics that result in the hardship are personal (the
I*1ysical ~ition ard financial situation of the people who propose to live
era the property) rather than pertainiD3 to the property itself. SecOnd, the
problem of day-to-day access to the bJildi03 can be alleviated in arry ale of
a number of ways (going to the additional expense of buildi03 6 ranp or an
elevator), without granting a variance. Third, the situation of ban::Ucapped
p:rsons occupying flood-prone hOUS103 raises a critical p.1blic safety
,concern. If a varianoe is granted and the buildin3 is constructed at grade,
it vill be absolutely critical that the harrlicaf:Ped or infirm person
evacuate vhen flood waters begin to rise, yet be or she may be helpless to
~ so alone. Not only does this p::$e an wmecessary danger to barrli~
pe (sons but also it places an ex t.r a demarx1 01'1 the cc:rtmmi ty f 6 er.erger.:y
services personnel who may be called up:m duri03 the early stages of the
flood to rescue them. In contrast, ,if the building is properly elevated,
the harrlicapped person can still be evacuated if there is sufficient warning
and assist:.a.oce available. If there is not, that person can, in all '
likelihood, survive the floo:i si.ltply by remaining at heme safely aOOve the
level of the noo3 waters.

by the variance, but likely only postp:>ned And perhaps ultimately
increased. It would be more prudent over the long run ooth for the property
o.mer and the camun.ity, if the variance were denied W the b:xre built at

nuisances. As umtioraed above, local flood ~e prevention ordin.5nces
(including elevation requireJtlPJ1ts) are interded to help protect the health,

p.1blic. In examinin; this requirement, lor--al boards should consider the
fact that every newly constructed building adds to local government
responsibilities 400 remains a part of the camnmity for fifty to one-
buno1red years. Buildings that ~e permi tt.ed to be constructed below the
base flood elevation are subject ~uring all those years to increased risk of
damage frau floods, while future owners of the property ard the cam:unity as
a whole are sUbject to all the costs, inconvenience, danger, ani suffering
that those increased flood damages bring. In addition, future ~rs aay
p..1tchase the property, unaware that it 1s subject to potential floo:3 '
damages, and can be insured only at very high flood insurance rates.

Insurance Rates
h'hile the building st.ardards in a local ordinance may be a1 tered by means of
it variance, the flCX>5 insurance p..1rchase requirement, which must be enforced
by leooing institutions, cannot be waived an:l thus may create severe
financial consequences for the property wners. Insurance rates for
structures built belC7W BFE can be substantially higher than those for
elevated structures. In many instances the rates' will be so high as to make
the structure essentially Wlinsurable because the o-.mers cannot afford the
premiUlll. 1his my not matter' to the original a.mer who applied for the
variance in the first place, but it may matter l\ great deal to subsequent
potential owners wo must forego, purchase of the property, or to subsequent
owners lIiho cannot fir:i3 buyers because of the high insurance rates" or to the
CC7.Irnllnity that firrls itself vith large n~rs of unsellable houses. In
addition, if the property is not insure:i and ca"lOClt be insured due to high
actuarial rates, there may be no furrls lIvailable to repair the structure if
it is seriOUSly damaged by a flood. Even disaster loans may not be
obtainable if the flcxxl insurance coverage required as a corrlition of the
loan' was availabl e only at very high rates. The resul t may be that the
present or.tner or a future O'Wner may choose to aban::3on the daIr.a3ed house
rather than repair it since tlle da..m3ges may exceed the eq'..Jity in the house.

variance can be properly granted. 1'he criteria are designed to screen out
those, situations in ~ich alternatives other than a variance are DJre
appropriate. It is, not" surprising that, when these guidelines are followed, ,
