Onufer Chairman'Logan called the meeting to order at 2 p. m. in the AnnexConfer- ence room and proceeded directly to hearing the first of three cases on the agenda. 715 S. Gulfview Blvd., (Hilton Hotel) - requesting a 4 ft.,variance from Federal Flood regulations to construct a Tiki bar at an elevation of-8 ft.' Mr. John Rieter, vice president of Goodsmith Enterprises represented the owners of the-hotel - Lane Industries, Inc. Mr. Rieter informed the board the structure is a wood frame structure Tiki bar and for the most part is an open type facility. Responding to questions from Chairman Logan, Mr. Rieter told the board this is a permanent type structure with a poured concrete floor and includes plumbing. Site plan and plans of structure were submitted. it was determined location is in V-13 flood zone.' Design originally created by a Chicago architect but en- gineer of record is Charles Cline who has modified design to ensure ade- quate anchoring of structure and resistance to high winds.. Discussion' followed regarding necessity of stems in the foundation. Applicant was cautioned to check with his insurance people to make sure the addition of this building will not have an impact on the Hilton main structure which could increase insurance'rates to an extent that it would make the cost of having this Tiki Bar prohibitive. A motion was made by Hank St. Jean. MOTION: With regard to the request for a variance from the Building Code and Flood insurance regulation for a structure located at 715 S. Gulfview Boulevard, better known as the Hilton.Hotel, the board finds it to be with- in its authority to act upon the request and hereby grants the variance with the following conditions: .(l) that'a.Florida registered engineer ob- tain a soil test and determine the length of the stems that shall be placed under the foundation of the structure; (2) that this variance will allow the finished floor at an elevation of 8' supported by a 2' grade beam. Board member Nicholson informed the board of a possible conflict of interest inasmuch as he is employed by George F. Young who performed the original survey but were not involved in the design or the engineering of the project. The motion was,amended to include timber decking within the 18 ft..sea- wall area provided it can easily be moved to permit adequate maintenance of•the seawall. Board of Adjustment & i?ppeal Building/f'lo'od Control February 26, 1986 848 Eldorado Avenue -- (Kleinberg) - requesting variance from Coastal Con- struction Code to reconstruct storm damaged privacy wall partially encroach- ing into 18 ft. seawall setback area. Robert G. Varner, contractor, represented the owner at this hearing and in- formed the board the property is adjacent to a public access to the beach and the wall is required for privacy reasons and also as a safety measure to deter public from using walkways behind the owner's property. Maximum height of the wall will be 5-1/2 ft. tapering down to seawall level. Wall will be of poured cement rather than concrete block to provide more under- pinning. Discussion ensued between board members Nicholson and onufer re- garding merits of construction of a concrete substanial wall and a light- wei,ght,wal1. Lightweight wall could be a missile hazard in event of a hurricane.. Andy Nicholson's concern is with any construction that would interfere with proper maintenance of seawall. It was determined State has given owner approval to rebuild the wall. A motion was made by board member St. Jean., MOTION: 'With regard to the request for a variance from the Building Code for a structure located at 848 Eldorado Avenue, the board finds it to be within its authority to act upon the request and hereby grants the variance with the following conditions: (1) that a design professional be consulted and that this be so indicated on plans submitted to the building department and (2) that the applicant consult with the Planning and Zoning Department and take necessary steps to meet their requirements. Andy Nicholson stipulated that main concern is that consultant ensure proper maintenance of seawall. Motion duly seconded and upon vote carried unani- mously. 974 Eldorado Avenue - 15 ft. variance requested to construct a swimming pool within the 18 ft. seawall setback area. The property owner, Art Pepin, was represented at the hearing by Ray Rossi of Aquamarine Swimming Pool Company' who informed the board it was not possible to construct the pool without en- croaching into seawall area. Property is in zone 2 and a discussion followed regarding code•requirements of Section 3906.2(b)3, which stipulates a pool excavation can be no closer than 18 ft. to any major structure not, con- structed on an adequate pile or mat foundation. Three variances might be required,.one for 18 ft. seawall setback, one for 18 ft. setback from house and one for deck within 18 ft. of seawall. A discussion followed between board members before a motion was made by member St. Jean. MOTION: Mr. Chairman, with regard to the request for a variance from the building code, Chapter 39, for a structure to be located within 18 ft. of the seawall and within 18 ft. of the residence, the board finds it within its authority to act upon the request and hereby grants the variance with the following conditions: (1) that the owner obtain services of a profess- ional engineer and submit a design to the building and engineering depart- ments for, review and approval and (2) that the design engineers provide a method of inspection of the tiebacks. Motion amended to require consul- tation with the City Engineer for the prevention of scouring action and other effects on the structure. Motion duly seconded and upon vote carried unanimously.
