Director', Building Department Mr. Logan called the meeting to order at 2:10 p. m.,and ad-. wised the Board that there was one case to be heard.' 804 Eldorado, Clearwater Beach. Owner - Pat,11ey Representative - Peter'Marich, Architect. Mr. Peter Marich, Architect, represented the owner at this hearing. Mr. F, Marich advised the Board the-project consists of tearing down an exist- ing residence and rebuilding. The major portion of new house uiill,b'e above flood plain. At this hearing Mr. Marich is seeking a variance to construct garage, and a foyer with bath facilities and an elevator underneath the residence which would be below flood plain, and also requesting variance'to construct ten feet into the 18 ft. seawall set- back area. The lot is located in B Zone Flood Elevation. Mr. Marich further explained that the existing seawall is seaward of the coastal construction line- it sits further back which is presenting a'problem. During construction plans are to tie the'seawall deadmen into the pil- ing foundation system. Because of the age of the existing seawall, its present condition is not known nor is it certain that deadmen currently exist and this will have to be verified. The existing resi- dence is located 20 to 25 ft. from the seawall, At this point Mr. St. Jean suggested that because-the garace/foyer con- struction is a request for variance from Flood Regulations and the re- quest for encroachment into the seawall set-back is a variance from the Building Code, that.these items be handled separately at,this hearing with separate motions for each. Reference was made to the,applica'tion to the-Building/Flood Board for these variances which also indicated a variance might be necessary for the proposed height of the new structure. Mr. Logan informed Mr. Marich that this is a zoning problem; this Board•could not rule on that problem and any request for a variance in- height of the new building would have to go through the Zoning Board of Adjustment and Appeals. Further'discussion followed regarding the condition of, the existi,ng sea- wall, location of present deadmen if any, and location of the new build- ing to be built-on the lot. Mr. Logan called for a motion on the re- quest for a 10 ft, variance to construct within the 18 ft. seawall setback area and a motion was made by Hank St. Jean as follows: n ?. E'4?.ei'h? P•t y i BOAA Building/Flood Control December 13, 1984 Page 2 MOTION: Mr: Chairman, with regard to the requested variance from the Building Code for a structure located at 804 Eldorado, I move for a de- cision by the Board as follows: the Board'finds it to be within its authority to act upon the.request;, and hereby grants the variance as re- quested. Mr. Logan informed Mr. Marich that the Hoard requires an engineer's draw- ing be submitted and approved by the City Engineering Department showing how seawall tiebacks will be handled to ensure proper future maintenance. The motion as made was seconded by Mr. Straub and carried unanimously. Request for variance granted. The second part'of the request for variance from'Federal Flood Regulations was next considered by the Board. It was determined that the stairwell would be an interior enclosed.stairwell leading from the foyer. Type of elevator being considered was explained and the Board found no problem with this installation. Andy Onufer explained and,read from F ENA regu- lations regarding bath facilities and emphasized bathrooms are not per- mitted-below base flood elevations in either A or B zones, except to comply with Florida's State Code which requires that sanitary facilities be lo- cated within 75 ft. of public swimming pools and bathing places and be accessible to the handicapped. A lengthy discussion followed between Board members with reference to FEMA regulations pertaining to break-away walls, insurance rates,, regulations concerning bath facilities, elevators, etc. Mr. St. Jean stated that he believes Board needs to consider that, the building that is on this lot now is going to be greatly improved by elevating a new building; that the elevator is an -item that is allowed in the flood zone; stairwells are permitted, and adequate garage and storage space is permitted. Mr. Logan asked if Board was prepared to make a motion and motion was. made'by Bank St. Jean as follows- MO TION: Mr. Chairman, with regard to the request for variance from the Flood Insurance Regulation for a structure located at 804 Eldorado,.I move for a.decision by the Board as follows,: the Board finds it to be within its authority to act upon the request and hereby grants the vari- ance requested as indicated: That the applicant be allowed";to construct a 700 square. foot enclosed garage providing that break away walls be designed and constructed to meet the intent of the flood ordinance; that the elevator lobby not exceed 300 square feet with or without stairwell and; that the Board does not consider the 40 ft. height building from grade nor the 30 ft. above high flood plain in its decision and that this decision would have to be discussed and approval obtained from either the planning or appropriate zoning authorities. Mr. Bethel clarified that the applicant would have to apply to the Zoning Board of Adjustment and Ap-- peals for any necessary height variance. Motion as made seconded by Mr. Straub and carried unanimously. The Board then proceeeded to discuss the next part of the variance request with.regard to bath facilities to be located in the foyer. Mr. Straub quoted FEMA regulations which specifically prohibit bath facilities to be constructed below flood elevation except.in public areas to meet State requirements. Mr. Logan stated that this Board has never granted a variance to permit these facilities in flood plain areas. After some addi-, tional discussion Mr..Logan asked for a motion and a motion was made by Mr. Straub as follows: MOTION: Mr. Chairman, with regard to the request far a variance from the- Flood Insurance Regulation for a structure located at 609 Eldorado, I.move for a decision by the Board as follows: the Board finds it to be within its authority to act upon the request, but denies the variance based upon the standing prohibition of locating residential bathrooms below the flood plain. There •was.no further discussion on the motion. Motion seconded by Hank, St. Jean and carried unanimously. Request for variance to install bathrooms in foyer area below flood elevation denied. A discussion followed between Board members regarding,reviewing all ap- plications for variances before,officially accepting such applications in the Building Department to eliminate any references for variances an ap- plicant might require from another Board. No formal procedure was es- tablished. Minutes of the November 28 meeting were reviewed and approved as submitted. The Board was advised that Mr. Andrew Nicholson had been contacted and had expressed his willingness to serve ron the Board replacing Mr. George Biron. Mr."Bethel will initiate proceedings through the City Manager to accomplish this.
