The meeting was called to order by Chairman Logan at 2:05 p. m.
:in the Operations Center Conference Room, City Hall Annex. Henry.St:
Jean was introduced as a new member of the Board. Mr. St. Jean re-
places John Cornett who resigned from the'Board in early September.' One
case to be heard at this meeting.
724 Bayway Blvd.Island,Club of Clearwater -- requesting a variance from
building code to allow construction'of a swimming pool,within 18 ft.
of an existing seawall, Pete Stirling, owner/developer of-this condo-
minium, and Mike Kelly of National Fools apprised the board of circum-. r
stances necessitating this request for a variance.
Mr. Stirling told the board original-plans'for this project included a
small swimming pool for this, six unit condomiriium_ It later developed
that.the minimum sized pool permitted under State regulations for com-
mercial pools was a pool of 450 square feet, and it,was not possible to
fit this size pool on available area without extending into the 18 ft.
seawall set back. Three of the six units have already been sold at a
price of $300,0b0 awith one of the amenities being a private condominium
swimming pool,'thus this request for a variance.
Original plans submitted for this pool. showed pool extending into l8 ft.
seawall setback area as well as a portion of the pool deck extending
beyond developer's property line,and'encroaching into Clearwater Harbor.
Mr, Kelly was informed that even though the board approved the variance
request, documentation would have to be furnished to the Building De-
partment that any encroachment beyond condominium property line..was
with the approval of the other property owner who at that time was
thought to be the City of Clearwater. A title search has revealed that
the developers of this project -- Island Club of Clearwater - are in fact
the-owners of the property 'in question and documentation to this effect
has been furnished to' the building department. Mr. Kelly further in-
formed the Board of State Health Department's requirements for this com-
mercial pool and due to stipyulated 450 square foot minimum size, the
necessity for encroachment into the 18 ft. seawall area.
Chairman Logan asked for a motion.- Motion by Mr. Walker - with regard to
this request for a variance from the building code for a structure lo-
cated at 724 Bayway Blvd. the board finds it to be within its authority
to act upon the request, and hereby grants the variance as requested.
Motion seconded by Mr. Biron. all voted aye. Variance granted.
