The meeting was called to order by Chairman Logan at 2:30 p. m,- One
case to be heard.
783 Bay Esplanade - Rogers K. Haydon, Jr. - a request,for a 4 ft. variance
from Federal Flood Regulations to construct a residence at 8 ft. elevation.
The applicant had been granted a variance on April 13, 1983 but there was
a question as to whether the variance was contingent on part of an existing
structure being used in connection with new construction. Existing structure
was razed and applicantthen started construction of new residence without
using,any portion of previous building. Stop-work order was placed on the
new construction by the Building Department. At a meeting on November 16,
the board ruled the variance granted on?April 13, 1983 was based on existing
building being used in conjunction with new construction and advised appli-
cant to reapply. for a variance based on con:-truction as it is now planned.
Mr. Rogers Haydon, owner of the property at 783 Bay Esplanade, informed the
board it is his desire to build a home on his lot to be compatible with the
neighborhood and surrounding homes. Mr. Logan briefly reviewed circum- .
stances pertaining to previous variance granted; the fact that the previous
variance was granted based on part of an existing garage being used with the
new construction, and the fact that the existing garage was torn down when
it was determined it was not feasible to use it in any paxt of the new con-
struction. Chairman Logan asked whether anyone else wished to discuss this
application or make any comments. Maurice Flint, owner of the property at
785•,Bay Esplanade, asked when notices for this hearing were mailed and was
advised that these went out to all property owners within 200 ft. of the
property involved on November 22, 1983.
There were no further questions or comments; no one spoke in,opposition and
Chairman Logan asked for a motion. Mr. Straub moved with regard to the re-
quest for a variance from the F,1ood Insurance Regulation for a structure
located at 783 Bay Esplanade, this being a reasonable request, the board
finds it to be within its authority to act upon the request and grant the
variance as requested. Motion seconded by Mr. Cornett. All voted aye.
Variance granted.
A brief discussion followed.between board members and Dr. Flint regard-
ing swimming pool installations within 18 ft. of seawalls. Also in a letter
addressed to Mayor Kelly, copy of which was given to Chairman Logan, Dr.
Flint had addressed other questions he had pertaining to zoning problems,
which are not under the jurisdiction of this board. These he will 'pursue
further through proper departments.
The Minutes of the meeting of November 2, 1983 were reviewed and approved
as submitted.

The meeting was called to order by Chairman Logan at .2:10 p. M.
Two cases on agenda to be heard. Inasmuch as the representative for the
first case on the agenda (PACT) had not yet arrived, the board proceeded
to hear the next case.
215 Bayside Drive - requesting a variance from Coastal Construction Code
3906.2 pertaining to construction within 18 ft. of a seawall. Mr.
Charles'Curtis of Curtis Pools represented the owners, Randolph W.'
and Marie Crawford. Size and contour of owner's lot prohibits con-
struction of- a swimming pool without utilizing part of the area within 18
ft. of seawall. Applicant requesting a 5.5 ft. variance for construction
of the pool and a 12 ft. variance for construction of a deck. Engineering
plans were submitted to the City's Engineering Department illustrating
modifications to be made to seawall to permit adequate maintenance of
tiebacks and plans were approved by the Engineering Department. After
some questions relative to dimensions, Mr. Logan called for a motion and
Mr. Straub moved.with regard to this request for variance from the Build-
ing Code for the structure located at 215 Bayside Drive, the Board finds
it to be within its authority to act upon the request for variances based
on approval of plans by the City Engineering Department.'and grants the
variances as requested. Motion seconded by Mr. Cornett and carried
unanimously.
Representatives from PACT still had not arrived to present their
case. All applicants at the time they are notified of the date and time
set for their hearing are informed (in writing) that they or their repre-
sentative must be.present at the hearing to present their case. PACT was
so informed.. After some discussion Mr. Logan put into motion that the
board refused to hear this application concerning the exit light variance
because of non-representation and because application fee was not paid.
The motion carried unanimously. It was the further consensus that upon
proper re-application and payment'of application fee, the Board would
hear the case at a future date.
Minutes of the previous hearing were reviewed and approved as
submitted.
