Mr. Logan opened the meeting at 2':06 p. m. and.immediately pro-
ceeded to hear the cases before the board.
Case I -,Thomas Dushas, 800 island Way - requesting 8 ft. variance to
' permit construction of swimming pool 10 ft. from seawall. Mr. Daniel
E. Aldridge, Landscape Architect, presented the case for his client who
''desires to build a swimming pool at the rear of his property. Lot size
prohibits construction'of a pool without encroaching into the 18'ft. set-
back area,. Engineer's plans submitted showing modifications to ensure
proper maintenance of pili.n'gs have been approved by City Engineering
Department. Since plans submitted meet with Engineering requirements,
no problems foreseen by Board members, although Mr. Ayres cautioned
applicant to be sure 'all other setback requirements are met.
Mr'. Straub made motion that the board finds it to be within its.authority
to act upon the request and hereby grants the variance, based upon the
Engineering Deparā¢tment'sl approval and subject to, the approval of the
Zoning Officer. Motion seconded by Mr. Cornett and carried unanimously.
Eight foot variance granted.
Case II - Park Place - Gulf-to-Bay Blvd., & Park P.iace - requesting
variance from Building Codeto allow installation of sprinkler.system
in lieu of 1-hour fire resistant ceilings as required in Section 301.3(c)
of 1982 Edition cf the Standard.Building Code. Msrs. Larry ' Wolfe and Dexter
Hoffman represented Metro Development Corp, and'Mr..Howard Stewart repre-
sented Architects with Smallwood, Reynolds, Stewart '& Stewart in pre-
senting case to the board. Representatives had previously, met with
personnel from the'Building and Fire departments to discuss fire pro-
tection requirements for this shopping center, which will consist of
three one-story specialty shops, totalling 50,000 square feet. To conform
with Chapters 9 and 6 of the Building Code; structures of this type and

size require non-combustible, Type 4 construction, one-hour fire pro-
tection, no sprinklers required. Metro's architects are requesting
permission to substitute a fully sprinkled, unprotected type four con-
struction. A question and answer discussion followed between board
members and Mr. Stewart regarding the type of construction proposed by
the developer and the type.materials used in this construction. Plans
submitted by theā¢developer are for all three buildings. Therefore,
variance granted would be for all three buildings. In behalf'of the
Fire Department, Nick Lewis recommended that the board act favorably
upon this request for variance and stated that.the fire department feels
the type construction proposed',by the developer to be superior to require-
ments of the,building'code. Mr. Logan stated he felt the variance re-
quest to be reasonable and asked for a motion. Mr. Cornett moved that
the board finds it to be within its authority to act upon the request and
grant the 'variance from the Building Code as requested. Motion seconded
by Mr. Straub and carried unanimously. Variance granted.
Minutes of the Board meeting of August 10, 1983 were reviewed and
approved as submitted.
