Ayres Also present: Mr. John Richter -- Planning-Department Mr. Walter Hilton - Chief, Permits & Inspections The meeting was called to order in the Operations Center, City Hall Annex by Chairman Batstone at 2:00 p. m. Mr. Hilton was called out of meeting. Replaced by Mr..George Owens. Case 1. Placid Harbor Condominiums, 329 Island Way. Case presented by Messrs. Coxhead, Plank and Evans of Windwood Development Company. Requesting an additional extension of their building permit #3507-D. Board had stipulated that the 150 day extension granted at the meeting of,.July 28, 1982 was the last extension the board would grant. The developers informed the board that for the first time in many months the economic picture has taken an upward turn and their bank seems to be=more receptive towards,providing the financial backing needed to get, the project moving. In response to questions from Mr. Batstone, Mr. Coxhead informed the board that they had worked with the city planning department and had reached a mutually agreeable compromise in meeting new zoning requirements that have gone into effect since the project first started. John Richter spoke in opposition to-granting any additional extension, citing five extensions already granted and that while compromises were, reached between the planning department.and the developer towards meet- ing'current zoning requirements, the project is non-conforming on six points; (1) building coverage,(2) impermeable surface coverage (3) maxi- mum height.' (4) .floor area, ratio (5) open space and (6). density. Further while it has been stated that.an additional extension would harm no one, planning department contends it is,not fair to other developers who conform to zoning codes and construct their projects in timely manner. Mr. Batstone stated all developers are granted hearings by this board if and when they are faced with a situation requiring such hearing and this developer has aright to again appear before the board in this appeal for a further extension. 11-3-82 Board of Adjustment & Appeals Building/Flood Control November 3; 1982 Page 2 Further discussion followed between Board members and developer. While developer agreed that the City,and the Board had been more than generous in granting of extensions on this building permit, he assured the Board that they have been doing everything possible to proceed with construction and at'this time prospects of financial-backing appear to be better than at any time since the start of.the project. Mr. Logan made motion as follows: "Mr. Chairman, with regard to the re- quest for a variance from the Building code'for a structure located at 329 Island Way, the Board finds it.to be within its authority to act upon the request-and hereby grants the requested variance with the'follow- ing condition:"this -is absolutely the final extension the Board will grant on this Permit 9858D." Six month extension granted by unanimous, vote. Under other,business -- (a) Research of-codes substantiated the fact that a variance is not necessary when the value of any remodeling or alterations to a- structure is less than 50% of the value of such structure. (b) Mr. John Logan was elected to serve as Chairman of the Board, succeeding Mr. Batstone who has resigned from the Board as of November 31, 1982. (c) Several names.were submitted as possible appointments to this Board. namely, Mr. Ronald P. Rowand, P. E., Rowand, Inc, - Mr. Bobby L. Holmes, Tile Contractor - Mr. George R. Biron, McFarland-Johnson, Engineers - and Mr. Frank'Shanon, Engineer, Florida Power Corp. Ayres -.Director, Building Department Members - Building/Flood Board of Adjustment and Appeals COPIES: Lucille Williams - City Clerk SUBJECT: BUILDING/FLOOD BOARD OF ADJUSTMENT AND APPEALS .E DATE: October 25, 1982 After the last meeting of the subject Board on October 20, 1.982, Mr. John Batstone, Hoard Chairman, informed me that, ti after some twenty years of serving on the Board, he wished not.' to be reappointed upon the expiration of his present appoint- ment in December, 1982. By copy of this memorandum I am requesting that by November 15, 1982, each of the Board members provide me-with one or two names of persons for the City's consideration as bossible replacements for Mr. Batstone. I will compile a list from the names submitted and forward it to youtso that you . may make the appointment in a timely manner. Section 111 of the Standard Building Code, requires that the Board be made.up of one architect, one engineer or general contractor,' and three,members at large from the building in- dustry. Upon Mr. Batstone's retirement from the Board, the remaining four members will consist of one architect, one electrical sub-contractor,-and two general contractors.
