J. Ayres, Board Secretary Members absent:' Mr. John Batstone Mr. John Logan Also present: r Mr. Walter Hilton - Chief, Permits & Inspections The meeting wascalled to order in the Operations_ Center, City Hall Annex by Acting Chairman Walker at 2:05 p.m. The Board im- mediately proceeded to hear the cases on the Agenda. Case I - MOCCASIN LAKE PARK - owned by City of Clearwater. Mr; Ream Wilson,'director of:the Parks & Recreation Department, presented the .case for the City. Variance requested to allow a mobile unit to be placed at site and to remain on the site fora period of five years. Mr. Wilson informed the Board of the many cases of vandalism that have been encountered since the start of development of the park.. Many fires have been started. Park consists of approximately 50 acres; is heavily wooded; and expensive solar panels, windmills; etc. have been installed in this environmental and energy education center. A fire, particularly during.dry spell, could destroy entire park. Plan is to have police officer live in a mobile home within the park. It is felt this would this would-serve as deterrent to prevent further acts of vandalism. Police.officer would purchase his own mobile home unit; hence request for five year time period for unit to remain at site. In response to questions from Board, Mr. Wilson advised plan would be to'hook up'to City Utilities which are close to park, at?City expense. Police Officer would thereafter be responsible for Utility bills. Mr. Wzalker questioned, whether there might. be objections to mobile unit from nearby neighbors and Mr. Wilson responded that so far neighbors have been very receptive to the park as a whole and it is felt that they would welcome-police officer's presence, Most nearby residents have shown a protective attitude towards the park. MOTION: (By Mr. Straub) - With regard-to the request for a variance from the Building Code fora structure located at Moccasin Lake' Park, 2750 Park Trail Lane,'I move for a decision by the Board as follows: Granted as requested. The Board finds it to be within its authority to act upon the request to place a portable mobile home in Moccasin Lake Park for a police officer to live on the site for a period of five years. Motion seconded. Three affirmative votes. Motion carried. 9/15/82 . ,?.• . •s`?:uEi?%???i?c#3t,`rk?'?iT:,?;??ii4?,: • 4 A. o y. .A Board of Adjustment & Appeal Building/Flood Control Wednesday, September 15, 1982 Case II - CLEARWATER MARINA - Pier & Bait Stand relocation -pier owned by City of Clearwater. Mr. Andrew M. Nicholson, Oceanographer, Public Works Department represented the City in this request for variance from Code Sec-. 2002.1 to permit waiver of toilet facilities. Project in- volved is creation of facility to accomodate Capt. Anderson II Cruise Boat which will involve moving of a pier and the bait stand on the pier. A 10 x 14 £t. addition will be added to existing bait stand to house certain supplies to protect from the weather, and for security reasons. Closest manhole is at other end of parking lot, at a higher elevation, and not practical to, gravity-drain into it. Public toilet facilities are available at Marina service station nearby, and exist- ing bait stand has been operating without toilet facilities. However, code states "any public buildings" must provide toilet facilities and since public does have access to bait stand, Board's approval for waiver of,toilet facilities is necessary. MOTION: (By Mr. Cornett).- with regard to the request for a variance from the Building Code for a structure located at Clearwater Marina, 25 Causeway Blvd., I move for a decision by the Board as follows: Granted as requested. The'Board finds it to be within its authority to act upon the request and hereby grants the variance as requested. Motion seconded by Mr. Straub - three affirmative votes - motion carried. Case III - SHORE LANES - 1445 U. S. 19 South - Owner Mr. Len Casey. Request for an extension of permit to allow mobile unit to remain at rear of property for an additional year. Mr. Casey acquainted the Board with problems his business had experienced with vandalism prior to installation of this unit. There were instances of break-ins to his building and many instances of break--ins and damage to customers' cars while his business was open and cars in the parking lot. Mr. Casey is sure that the presence of this,unit acts as a deterrent as there has been only one minor case of vandalism since its installation. The unit is completely self-contained. When the owner is in town he occupies the unit; at other times, lights are turned on automatically so that the unit appears to be occupied. There have been no complaints from neighbors and Mr. Casey stated his mobile home unit appears to blend in with the adjacent mobile home park. MOTION: (By Mr. Straub) - with regard to the request for a variance from the building code for a mobile home to be located at the rear of the bowling center.at 1445 U. S. 19 South for security reasons, I move for a decision by the board as follows: the board finds it to be within its authority to act upon the request, and hereby grants the variance re- quested for a period of one year. Motion seconded - three affirmative votes - motion carried. Case IV - SEVILLE 14 CONDOMINIUM - 2650 Pearce Drive - Representative, Mr. W. E. Armbruster from Crisp Property Management. Mr. Hilton passed out copies of the code in question - Section 3108, Exterior Balconies. The Building Department had stipulated that in the repair of the bal- conies and the railings thereon, if replacing only a portion of railing, would not have to comply with present code; however, if replacing the entire railing, must comply with code as it exists today as in Section 1108. The problem here is with spacing between vertical guard rails. Mr. Ayres presented background of the case to the Board and explained - 2 -- r,7' f Board of Adjustment & Appeal Building/Flood Control. Wednesday, September 15, 1982 Page 3 the Building Department's interpretation of previous code versus present code. Considerable discussion followed between board members, Mr. Ayres,,Mr. Chaplinsky and Mr. Armbruster regarding previous code, present code, and new code'(not yet available) and interpretations thereof. ;Mr. Walker requested a motion or a discussion on a motion. If railings are to be allowed to remain as-presently installed, Hold-Harmless Agree- ments would have to be executed to protect the City and the Board, as well as the condominium association. Mr. Armbruster stated such agree- ments could be made part•of deed on each unit involved. Further, this agreement would be notarized and put into public record to run with each of the individual units. MOTION: (By Mr. Straub) - with regard to the request for a variance from the Building Code for a structure located at 2650,Pearce Drive, Clearwater, Fl. I-move for a decision by the Board as follows: that the Board'f Inds it to.be within its authority to act upon the request subject to the following conditions: 1. Within six months from this date, the (Seville 14 Condominium) association provide the City of Clearwater with a Hold-Harmless Agreement-regarding railings on the specified building, and that this Board be held harmless. 2. That this Hold-Harmless Agreement be a matter of Public Record to run with the condominium property, i.e., to be attached to the deeds. I move that we'hereby grant the variance. Mr. Chaplinsky suggested that individual apartment numbers be stipu- lated in the motion in place of "specified building Motion so amended. Motion carried. Under other business, Mr. Ayres informed the Board of the history of-the popcorn wagon, located at 2030 Gulf-to--Bay. City Commission granted permission to install popcorn concession but did not specify time limit. Upon request for clarification, Commission stated their intent was to permit concession to operate simultaneously with their lease at this location. The only mechanism to permit installation of this stand was under the "temporary building" ordinance which allows only a 120 day time limit. However, because of Commission action this concession was given temporary building permit to run with their lease at this location. Mr. Ayres felt that the Board should be apprised of the circumstances pertaining to this temporary permit. Minutes of the meeting of July 28, 1982 approved as corrected.
