BOARD OR ADJUSTMENT & APPEAL BUILDING/FLOOD CONTROL September 2, 1981 Members present: John Batstone, Chairman Forest Dean John Logan Joseph'Straub Roy J. Ayres, Secretary , Also present: Walt Hilton,.Chief of Permits. & Inspections Building Department The meeting was called to order byy.Chairman Batston at 2:10 P. M. in the.Conference Room, Operations Center, City Hall Annex, MINUTES:. The Chairman presented-the minutes of the meeting of July. 15, 1981 for consideration. No one spoke in opposition. Motion made minute's be approved as submitted; motion seconded and carried unanimously. Mr. Ayres entered meeting at 2:20 P. M. FORM OF MOTION: Revised form was reviewed and adopted for use at all future board meetings. CASE NO. I - Holiday Inn,.Surfside North Owner of property- John S. Taylor Representative -- Curtis J. DeYoung, DeYoung & Associates Mr. DeYoung presented case. Area for pool had been surveyed by.his firm and-constructed in accordance with approved plans 18 ft. from Coastal Construction Control line rather than 18 ft. from existing seawall, As-builts were prepared and submitted to'Engineering Department. Andy Nidholson reviewed and submitted detailed report'to the Building Depart- ment indicating pool as constructed would not present problems. Questions and discussions followed and confirmed no problems would be encountered in future maintenance of seawall. Also question as to whether-this case is within jurisdiction of Building/Flood Control Board was clarified, Coastal Construction code is in and a part of the`Building Code, adopted on a County-wide basis and made part of Building Code, Chapter 39. This board's appeal authority covers the entire Building Code. MOTION: Mr. Logan moved - "Mr. Chairman; With-regard to the request for a variance from the Building.Code for a structure located at 400 Mandalay for construction of a swimming pool 14.20 ft. from.the existing seawall, I move for a decision by the board as follows: Granted as re- quested. The Board finds'it to be within its authority to act upon the request, and hereby grants the variance as requested.'.' Motion seconded and carried unanimously. Granted as requested. „? ,I= ¦ .. ? tY.O1.,11:34LG j 1 + •3 ? p 3 3 CASE-NO. II -- C. D. Carley, Jr., 320 Harbor Passage (Owner) Representative - Mr. Randall Pickelmann- C. F. Curtis Const., Inc. Mr. Pickelmann presented case for owner advising size and contour of owner's lot presented difficulties in locating a swimming pool but if the 12 ft. variance requested is granted, a pool could be located between the'seawall and house.',.4 34 ft. continuous pour deck has been designed by an engineer, 5 ft. back from seawall, which will provide security to seawall during and after•construction. Also approximately two feet of open area - not con- creted - is provided between edge .of wall and pool deck to provide for any needed fill-and maintenance. Discussion followed regarding batter piles or deadmen to ensure proper bracing of seawall. MOTION: Mr. Walker moved as follows: "Mr. Chairman: With regard to the request for a,variance from the Building; Code for.a structure located at 320 Harbor Passage, I move for a'decision by the board as follows: that the board finds it to be within its authority to act upon the request, and hereby grants the requested variance,,with the following conditions; (1), that the engineering of the deadmen and bracing of seawall be approved by 'the Engineering Department." The motion was immediately amended to state that the conditions be waived upon confirmation of Andy, Nicholson's signature on the.plans in file. Motion-was duly seconded as amended and carried unanimously. Granted as requested. (Walt Hilton left meeting to check initials on plan and confirmed that the plan in file's has,been properly approved by Engineering Department). CASE NO. III - H. G. Hamilton Lot 5, Bldg., 10 Bay Esplanade With regard.to this case, Mr.'Ayres stated that because time did not permit a thorough examination,of plans, there is.a possibility that a Zoning variance might also be required, although preliminary examination did not indicate this to be a fact. Mr. Ayres advised, however, that the owner should be aware of this possibility before the fact, as if a zoning variance is necessary, the action of this Board today would not cover such a variance. Mr. Hamilton presented information as to location of this strand steel building, which will house beach vehicle(s) and beach chaires, umbrellas, etc. Equipment will be stored in building at night and brought out for beach usage during daylight hours. There is no electricity or plumbing involved. Will be on grade only slightly higher than present parking area. Some discussion followed but no problems seen. MOTION: Mr. Straub moved as follows: "Mr. Chairman: With regard to the request for a variance from the Building Code for a structure located at 10 Bay Esplanade, I move for a decision by the Board as follows: Granted as Requested. Mr.,Logan,abstained due`.to personal, interests. Granted as requested, Mr, Ayres reminded Mr.'Hamilton that it would be to his interest to check with Zoning Official in the Building Department before leaving,to ensure that-a Zoning variance is not required. Harrison Avenue Clearwater, Florida 33516 Be: Holiday Inn, Surfside North.- 1100 Mandalay Avenue Dear Mr, DeYoung: ' I am in receipt of your letter of August 10,,1981'regard- ing the,location of the Holiday Inn swimming pool at 18 feet from the Coastal Construction Control Line instead of 18 feet from the existing seawall. I have also received a memorandum; of even date from the Director of Public Works wherein he addresses the impact of the pool's location on tieback mainten- ance. Mr. Battle is of the opinion that the maintenance of the tiebacks will not be adversely•affected by the present location of the pool.' As you have observed in your letter, the pool as presently located is in violation of Section 3906.2 (a)2 of the City's Building Code. Although the error is slight and does not pre-- sent any major problems to tieback maintenance, the City staff does not have-the authority to vary the code. Therefore, before the pool can be released by the City for use, it will be neces::ary that,a variance from code requirements be obtained. The board having 'Jurisdiction over this particular require- ment is the Building Code Board of Appeals. I'serve as Secre- tary to the Board, and',application may be made through my office.
